Book excerpt: A new way of understanding the essence of moral obligation The Moral Nexus develops and defends a new interpretation of morality—namely, as a set of requirements that connect agents normatively to other persons in a nexus of moral relations. According to this relational interpretation, moral demands are directed to other individuals, who have claims that the agent comply with these demands. Interpersonal morality, so conceived, is the domain of what we owe to each other, insofar as we are each persons with equal moral standing. The book offers an interpretative argument for the relational approach. Specifically, it highlights neglected advantages of this way of understanding the moral domain; explores important theoretical and practical presuppositions of relational moral duties; and considers the normative implications of understanding morality in relational terms. The book features a novel defense of the relational approach to morality, which emphasizes the special significance that moral requirements have, both for agents who are deliberating about what to do and for those who stand to be affected by their actions. The book argues that relational moral requirements can be understood to link us to all individuals whose interests render them vulnerable to our agency, regardless of whether they stand in any prior relationship to us. It also offers fresh accounts of some of the moral phenomena that have seemed to resist treatment in relational terms, showing that the relational interpretation is a viable framework for understanding our specific moral obligations to other people.

Philosophical theorizing about this question has recently taken a social turn, marking a shift in focus from traditional metaphysical concerns about free will and determinism. Recent theories have attended to the interpersonal dynamics at the heart of moral responsibility practices and the role of the moral environment in scaffolding agency. Yet, the implications of social inequality and the role of social power for our moral responsibility practices remains a surprisingly neglected topic. The conception of agency involved in current approaches to moral responsibility is overly idealized, assuming that our practices involve interactions between equally empowered and situated agents. In twelve new essays and a substantial introduction, this volume systematically challenges this assumption, exploring the impact of social factors such as power relationships and hierarchies, paternalism, socially constructed identities, race, gender and class on moral responsibility. Social factors have bearing on the circumstances in which agents act as well as on the person or people in the position to hold that agent accountable for his or her action. Additionally, social factors bear on the parties who pass judgment on the agent. Leading theorists of moral responsibility, including Michael McKenna, Marina Oshana, and Manuel Vargas, consider the implications of oppression and structural inequality for their respective theories. Neil Levy urges the need to refocus our analyses of the epistemic and control conditions for moral responsibility from individual to socially extended agents. Book excerpt: Fair Opportunity and Responsibility lies at the intersection of moral psychology and criminal jurisprudence and analyzes responsibility and its relations to desert, culpability, excuse, blame, and punishment. It links responsibility with the reactive attitudes but makes the justification of the reactive attitudes depend on a prior and independent conception of responsibility. Responsibility and excuse are inversely related; an agent is responsible for misconduct if and only if it is not excused. As a result, we can study responsibility by understanding excuses. We excuse misconduct when an agent's capacities or opportunities are significantly impaired, because these capacities and opportunities are essential if agents are to have a fair opportunity to avoid wrongdoing. This conception of excuse tells us that responsibility itself consists in agents having suitable cognitive and volitional capacities - normative competence - and a fair opportunity to exercise these capacities free from undue interference - situational control. Because our reactive attitudes and practices presuppose the fair opportunity conception of responsibility, this supports a predominantly retributive conception of blame and punishment that treats culpable wrongdoing as the desert basis of blame and punishment. We can then apply the fair opportunity framework to assessing responsibility and excuse in circumstances of structural injustice, situational influences in ordinary circumstances and in wartime, insanity and psychopathy, immaturity, addiction, and crimes of passion. Though fair opportunity has important implications for each issue, treating them together allows us to explore common themes and appreciate the need to take partial responsibility and excuse seriously in our practices of blame and punishment.

Book excerpt: This book challenges a basic assumption held by many responsibility theorists: that agents must be morally responsible in the retrospective sense for anything in virtue of which they deserve praise or blame (the primacy assumption). Anton sets out to defeat this assumption by showing that accepting it as well as the much more intuitive causality assumption renders us incapable of making sense of cases whereby agents seem to deserve praise and blame. She argues that retrospective moral responsibility is a species of causal responsibility (the causality assumption). Then, she illustrates several examples in which agents are not causally responsible for any morally relevant consequences, but they seem to be deserving of praise or blame nonetheless. Anton concludes that such cases are counterexamples to the primacy assumption, and turns her attention towards discerning what grounds desert of praise and blame if not retrospective moral responsibility. Anton advances the moral attitude account, whereby agents deserve praise and blame in virtue of moral attitudes they have in response to moral reasons. These moral attitudes must be sufficiently sincere, which means they reach a threshold that distinguishes such attitudes as eligible for praise and blame. Anton adds that whether one deserves praise or blame and to what degree is sensitive to the agent’s personal moral progress as well as the status quo of her society. This addition brings with it the welcome consequence that morality may be objective, but we are still justified in judging one another charitably based on personal and societal limitations.

Our ambivalent responses suggest that such agents are responsible in some ways but not others. Shoemaker develops a theory to account for our ambivalence, via close examination of several categories of pan-cultural emotional responsibility responses (sentiments) and their appropriateness conditions. The result is three distinct types of responsibility, each with its own set of required capacities: attributability, answerability, and accountability. Attributability is about the having and expressing of various traits of character, and it is the target of a range of aretaic sentiments and emotional practices organized around disdain and admiration. Answerability is about one's capacity to govern one's actions and attitudes by one's evaluative judgments about the worth of various practical reasons, and it is the target of a range of sentiments and emotional practices organized around regret and pride. Accountability is about one's ability to regard others, both evaluatively and emotionally, and it is the target of a range of sentiments and emotional practices organized around anger and gratitude. In Part One of the book, this tripartite theory is developed and defended. In Part Two of the book, the tripartite theory's predictions about specific marginal cases are tested, once certain empirical details about the nature of those agents have been filled in and discussed.
