Book excerpt: This book, which can be used as a text for teaching purposes, gives a fascinating, and authoritative treatment both the rights protected by the Inter-American system and of the way in which its institutions work. An important part of the book is a thorough, article by article account of the guarantee in the American Declaration of the Rights and Duties of Man and in the American Convention on Human Rights of civil, political, economic, social and cultural rights in the light of the jurisprudence of the Inter-American Commission on Human Rights and the Inter-American Court of Human Rights, and of the Commission's many country reports on the human rights situation in particular states. There are also chapters on the rights of indigenous peoples, amnesty laws and states of emergencies. The evolution and current methods of work of the Commission and the Court are set out at length and their achievements are critically assessed. The role of non-governmental organisations is also examined in this context. The book will be invaluable to all those interested in the protection of human rights in the Americas and international human rights law generally.

This book was released on 2022-08-08 with total page 1191 pages. Available in PDF, EPUB and Kindle. Book excerpt: This edition of the Inter-American Yearbook on Human Rights, like the volumes that precede it, includes information concerning the activities of the Organization of American States in the promotion and protection of human rights. It begins with the composition of the Commission and Court, including the biographies of the members, 1988 activities of each body, reproductions of resolutions and reports by the Commission and historic correspondences and decisions by the Court. Also included is an update on the status of the American Convention on Human Rights, which reports the relation of each country to that instrument, followed by resolutions adopted in 1988 by the OAS General Assembly. The year 1988 distinguished itself particularly because the Inter-American Court of Human Rights made its first decision on a contentious case, the Velásquez Rodríguez case (Honduras). This historic decision is reproduced in Part Three of this volume. Another important 1988 development in the Inter-American system was the Protocol of San Salvador, or Additional Protocol to the American Convention on Human Rights for Economic, Social and Cultural Rights, reproduced in Part Four. Also included, in its entirety, is a report on the human rights situation in Haiti, a report requested by the Organization of American States Permanent Council in Resolution 502. The Inter-American Yearbook on Human Rights is completely bilingual (English and Spanish).

Available in PDF, EPUB and Kindle. Book excerpt: Human Rights of Indigenous Peoples approaches this complex subject from two directions: first, the existing framework of international law, both actual and potential, as embodied in the relevant provisions of international conventions and the case law of international tribunals; and second, specific issues that arise between indigenous peoples in the United States, Canada, Latin America, Scandinavia, India, and Australia and the states which exercise jurisdiction in their homelands. This book, by a leading authority on children's rights, is a major contribution to an area of international law that attracts more attention each year, and that many human rights advocates see as a critical testing ground for the genuineness of states' humanitarian rhetoric. Book excerpt: ‘Transnational Crimes in the Americas’ addresses contemporary issues with respect to public institutions that are stakeholders in the fight against globalization of crime. Regional public organizations, with a primary focus on the Americas, constitute a framework for understanding the need for an institutional response within the Western Hemisphere. While other authors have addressed the growth of organized crime, no one has explained institutional developments in the struggle against transnational crimes. 'Transnational Crimes in the Americas’ highlights existing organizations, emphasizing a regional response to transnational crimes, suggestions for a permanent criminal court in the Americas and an appraisal of the current state of institutional developments in the region.

Available in PDF, EPUB and Kindle. Book excerpt: Internet Governance: Origins, Current Issues, and Future Possibilities deals with Internet governance and includes computer history, Internet beginnings, institutions and stakeholders, proposed models of governance, and human rights. The concept of Internet governance covers an exceptionally complex and rapidly changing field of norms and rules. Its origins and conflicts engage many disciplines and give rise to technical standards with contributions from a wide range of stakeholders. At the same time, the Internet has increasingly become the dominant reality for all the information processing industries. The ultimate goal of the book is to establish a foundation for identifying a new model of governance for the Internet. In doing so, the book honors the efforts of previous scholars who have considered and proposed other models for the governance of the Internet. Among its aims, the book is intended as an introduction for the novice to the subject of internet governance. The first two chapters offer a historical foundation of the institutions and the debate. The next two chapters discuss the evolution of that debate over the last twenty years. The final two discuss the present and future ramifications of the debate and include the author’s attempts to sketch a practical plan for a new concept of Internet governance. This book provides an introductory, multidisciplinary account of the forces at work in the evolving concept of internet governance for scholars in the information studies fields, including computer, information and library science. It should also be useful for scholars in the fields of international law, international relations, diplomacy studies and political science.

Book excerpt: With unique scholarly analysis and practical discussion, this book provides a comprehensive introduction to the relationship between environmental protection and human rights being formalized into law in many legal systems. This book instructs on environmental techniques and procedures that assist in the protection of human rights. The text provides cogent guidance on a growing international jurisprudence on the promotion and protection of human rights in relation to the environment that has been developed by international and regional human rights bodies and tribunals. It explores a rich body of case law that continues to develop within states on the environmental dimension of the rights to life, to health, and to public participation and access to information. Five compelling contemporary case studies are included that implicate human rights and the environment, ranging from large dam projects to the creation of a new human right to a clean environment.
