Book excerpt: The U.S. Department of Energy, Richland Operations Office (RL) is responsible for 30 hazard category 2 and 3 nuclear facilities that are operated by its prime contractors, Fluor Hanford Incorporated (FHI), Bechtel Hanford, Incorporated (BHI) and Pacific Northwest National Laboratory (PNNL). The publication of Title 10, Code of Federal Regulations, Part 830, Subpart B, Safety Basis Requirements (the Rule) in January 2001 imposed the requirement that the Documented Safety Analyses (DSA) for these facilities be reviewed against the requirements of the Rule. Those DSA that do not meet the requirements must either be upgraded to satisfy the Rule, or an exemption must be obtained. RL and its prime contractors have developed a Nuclear Safety Strategy that provides a comprehensive approach for supporting RL's efforts to meet its long term objectives for hazard category 2 and 3 facilities while also meeting the requirements of the Rule. This approach will result in a reduction of the total number of safety basis documents that must be developed and maintained to support the remaining mission and closure of the Hanford Site and ensure that the documentation that must be developed will support: compliance with the Rule; a ''Just-In-Time'' approach to development of Rule-compliant safety bases supported by temporary exemptions; and consolidation of safety basis documents that support multiple facilities with a common mission (e.g. decontamination, decommissioning and demolition [DD & D], waste management, surveillance and maintenance). This strategy provides a clear path to transition the safety bases for the various Hanford facilities from support of operation and stabilization missions through DD & D to accelerate closure. This ''Just-In-Time'' Strategy can also be tailored for other DOE Sites, creating the potential for large cost savings and schedule reductions throughout the DOE complex.

The DNFSB an independent oversight organization within the executive branch, was created by Congress in 1988 to provide advice and recommendations to the secretary of energy regarding public health and safety at the defense nuclear facilities managed by the Department of Energy. This study captures how the Board met the competing national security, health and safety, environmental, government, and public demands placed upon DOE's defense nuclear facilities, explicating the principles and techniques the Board employed to efficiently function as a federal agency and effectively fulfill the Board's unique mandate under the Atomic Energy Act of 1954, as amended. While it chronicles events, the study also serves as the tutorial for those charged with the future administration of the Board's enabling legislation, making available to the current and future leadership the philosophical and jurisprudential underpinnings of the form of governance captured in the Board's enabling legislation and the resolution of changing and sometimes opposing national requirements. The first chapter discusses the handling of safety issues in the defense nuclear complex prior to the creation of the Board. The chapter also examines historical circumstances that produced pressures to move toward more external regulation, including major accidents involving nuclear technology (especially Chernobyl), the waning of the nuclear arms race, and the lifting of the secrecy about the safety risks and environmental damage. The second chapter reviews the debates in Congress that led up to the legislative compromise that created the Board as an expert body that would act as an independent adviser to the secretary of energy, rather than as a regulator. The third chapter describes the development of the Board's manner of proceeding when it conducted oversight, in particular, how it interacted with the Department of Energy, congressional oversight committees, and the public, and how it wielded the tools that Congress granted it to exert authority that was effectively action-forcing. The fourth chapter examines important recommendations on nuclear safety, both site-specific and complex-wide, that the Board issued to the secretary of energy, and how their follow-up was handled. The fifth chapter discusses the shift of emphasis in the Board's activities that occurred with the end of the nuclear arms race and weapons production in 1992, mainly, the shift to greater emphasis on the stabilization and safe storage of surplus nuclear materials, as well as the safe execution of weapons dismantlement. The sixth chapter focuses on the Board's advocacy of Integrated Safety Management to support longer-term, more comprehensive safety planning in the weapons complex, and the reexamination by policymakers and the Board of whether current oversight arrangements sufficed to ensure safety. In addition, the chapter examines the Board's increased technical oversight activities of design and construction projects throughout the DOE defense nuclear complex. The proposed action would place the Hanford Site's non-defense production reactor SNF in a radiologically- and industrially-safe, and passive storage condition pending final disposition. The proposed action would also reduce operational costs associated with storage of the non-defense production reactor SNF through consolidation of the SNF and through use of passive rather than active storage systems. Environmental, safety and health vulnerabilities associated with existing non-defense production reactor SNF storage facilities have been identified. DOE has determined that additional activities are required to consolidate non-defense production reactor SNF management activities at the Hanford Site, including cost-effective and safe interim storage, prior to final disposition, to enable deactivation of facilities where the SNF is now stored. Cost-effectiveness would be realized: through reduced operational costs associated with passive rather than active storage systems; removal of SNF from areas undergoing deactivation as part of the Hanford Site remediation effort; and eliminating the need to duplicate future transloading facilities at the 200 and 400 Areas. Radiologically- and industrially-safe storage would be enhanced through: (1) removal from aging facilities requiring substantial upgrades to continue safe storage; (2) utilization of passive rather than active storage systems for SNF; and (3) removal of SNF from some storage containers which have a limited remaining design life. No substantial increase in Hanford Site environmental impacts would be expected from the proposed action. Environmental impacts from postulated accident scenarios also were evaluated, and indicated that the risks associated with the proposed action would be small.

Book excerpt: A NATO workshop was held in September 2007 under the Security through Science framework to consider the current challenges in regulation of the nuclear legacy. The overall objective was to share East-West competence and experience in radiation protection and nuclear safety supervision of installations built during the cold war, particularly in relation to regulatory strategies for safe decommissioning of unique or unusual nuclear facilities and remediation activities. There were over 60 participants from 8 countries as well as representatives from the International Commission on Radiological Protection, the International Atomic Energy Agency and NATO. The organisations involved included regulatory authorities, operators and technical support organizations. The new Russian Federation Unified State Programme for Handling Spent Fuel and Radioactive Waste was introduced and the steps necessary to set this up as a comprehensive programme of activities were described. Some waste management sites are in a poor state. Legacy management experience was provided from the UK, France and the USA. Information was provided on methods for site characterisation and separation of wastes into exempt, low-level and intermediate level waste, and the complication of dealing at the same time with chemical hazards, such as beryllium. Strategies for contaminated site management were also explained and the associated risk assessment methods outlined. The Russian Federation has responsibility to manage its own nuclear legacy. But it is also one of several countries in the global network of nuclear activities. Harmonisation of approaches is valuable in building future cooperation, but local conditions may influence the best local solution. Accordingly, future exchanges, such as those provided for by this workshop, should be encouraged. There are many complex issues to be addressed and they cannot all be solved at once. Clear recognition of the major threats, as well as weakness in regulatory processes, can be useful in directing future resources. However, at this stage it is clear that there are specific regulatory issues to address as well as a need to maintain development of an enhanced overall safety culture. Such guidance needs to be thoroughly based on the best use of scientific and technical information. At the same time, part of the solution relates to policy issues and value judgements, and so broader interaction among regulators, operators and other stakeholders is to be encouraged.
