Book excerpt: To deal with crimes and criminals in any society deserves more of scientific approach than mere military, fire brigade approach. Criminals are products of the society; they were not naturally criminals for God never made any one as such. Many factors are contributories for which crime becomes certainly an important area of study that any government must take with all seriousness to ensure a crime free society. This work is therefore an attempt to evaluate the Nigerian criminal justice system with the view to identifying some of the reasons for the failure of the system. This work grew out of my undergraduate research project at the Usmanu Danfodiyo University, Sokoto, Nigeria where I studied and obtained Bachelor of Law Degree.

This book was released on 2019-12-18 with total page 95 pages. Available in PDF, EPUB and Kindle. Book excerpt: The book examined the concept of plea bargaining under the Nigeria criminal justice system. Plea begins as practiced today in Nigeria was not known or provided for in any Nigeria statues before the Economic and Financial crimes commission was established through the provision of section 1 of the Economic and Financial crimes commission (Establishment) Acts, 2004. Plea bargain was only seen for the first time after the establishment of the commission in 2004 under the administration of Chief Olusegun Obasenjo as the president of Nigeria. The application of plea bargain by the Economic and Financial Crime commission is usually based on the provision of section 14(2) of the enabling law that gives the Commission power to compound any offence punishable under the act of accepting the sum of money.

The author uses a comparative approach in analyzing the legal regime and practice of child justice administration in Africa by recommending South Africa as inspiration for Nigeria since the justice sector in South Africa is significantly more developed. It further investigates various problems and challenges associated with children in the criminal justice system in Africa, thereby contributing to the cross-fertilization and collaboration among African nations that contributes to the development of the continent as a whole. The monograph shows that children are not only neglected by academics and practitioners but also that there is no access to scholarly materials in this area of law in Africa. This work contributes to knowledge in the area of law and methodology on the issue of child justice administration, development studies, political science, and African studies.

This book was released on 2011-07 with total page 204 pages. Available in PDF, EPUB and Kindle. Book excerpt: This research considered the constraints in the administration of criminal justice in Nigeria. Itevaluated the factors responsible for the slow pace of criminal justice, like the phenomenon ofholding charge, the inherent inability to utilize information and communication technology andinadequate resources, especially communication, electricity, transportation, recording andrecord-keeping facilities, surveillance cameras, sensors and tracking devices in Nigeria. Theresearch advocated for a thorough and comprehensive analysis and evaluation of novel policiesin the form of alternatives to imprisonment that would explore the use of plea bargain, parole, suspended and community sentencing that would act as veritable tool in decongesting theprisons and the provision of a witness protection programme before, during and after trials. Itequally advocated the need for tracking devices, cameras and sensors to be placed atdesignated paces in Nigeria to aid crime prevention and detection. In carrying out this research, books, articles in learned journals, conference papers, unpublished legal materials and relevantinternet materials have been utilized

Download or read book The International Criminal Court and Nigeria written by Muyiwa Adigun and published by Routledge. This book was released on 2017-12-14 with total page 249 pages. Available in PDF, EPUB and Kindle. Book excerpt: If Nigeria fails to prosecute the crimes recognised under the Rome Statute, then the International Criminal Court (ICC) will intervene. The ICC is only expected to complement the criminal justice system in Nigeria and is not a court of first instance, but one of last resort. This is what is known as the principle of complementarity. Before the ICC can step in, it must make a finding of ‘unwillingness’ or ‘inability’ on the part of Nigeria. It is only after this finding is made that the ICC can take over the prosecution of the crimes recognised under the Statute from Nigeria. This book examines the criminal justice process in Nigeria and discovers that the justice system is latent with the requirements of ‘unwillingness’ and ‘inability.’ The requirements, which serve as tests for assessment, are as they are laid down by the Rome Statute and interpreted by the ICC. This book offers recommendations as to what Nigeria must do in order to avoid the ICC intervention by reversing those parameters that give rise to ‘unwillingness’ and ‘inability.’ The International Criminal Court and Nigeria: Implementing the Complementarity Principle of the Rome Statute offers a contribution to the advancement of international law and will be of practical use to African countries. It aims to sensitise policy makers in different African countries in respect of policy options open to them to close impunity gap in their respective countries. This volume addresses the topics with regard to international criminal law and comparative public law and will be of interest to researchers, academics, organizations, and students in the fields of international law, governance, and comparative criminal justice.

Available in PDF, EPUB and Kindle. Book excerpt: A pioneering book on prisons in West Africa, Colonial Systems of Control: Criminal Justice in Nigeria is the first comprehensive presentation of life inside a West African prison. Chapters by prisoners inside Kirikiri maximum security prison in Lagos, Nigeria are published alongside chapters by scholars and activists. While prisoners document the daily realities and struggles of life inside a Nigerian prison, scholar and human rights activist Viviane Saleh-Hanna provides historical, political, and academic contexts and analyses of the penal system in Nigeria. The European penal models and institutions imported to Nigeria during colonialism are exposed as intrinsically incoherent with the community-based conflict-resolution principles of most African social structures and justice models. This book presents the realities of imprisonment in Nigeria while contextualizing the colonial legacies that have resulted in the inhumane brutalities that are endured on a daily basis. Keywords: Nigeria, West Africa, penal system, maximum-security prison. Published in English.
