This discerning insight, which dates back more than 2000years to Aristotle, seems to have been ignored by most psycholo gists. For more than 40years theories of human action have assumed that cogni tion and action are merely two sides of the same coin. Approaches as different as S-O-R behaviorism,social learning theory, consistency theories,and expectancy value theories of motivation and decision making have one thing in common: they all assume that "thought (or any other type of cognition) can move any thing," that there is a direct path from cognition to behavior. In recent years, we have become more and more aware of the complexities in volved in the relationship between cognition and behavior. People do not always do what they intend to do. Aside from several nonpsychological factors capable of reducing cognition-behavior consistency, there seems to be a set of complex psychological mechanisms which intervene between action-related cognitions, such as beliefs, expectancies, values, and intentions,and the enactment of the be havior suggested by those cognitions. In our recent research we have focused on volitional mechanismus which presumably enhance cognition-behavior consistency by supporting the main tenance of activated intentions and prevent them from being pushed aside by competing action tendencies.

Truman, Elizabeth Anscombe's Intention laid the groundwork she thought necessary for a proper ethical evaluation of actions like the bombing of Hiroshima and Nagasaki. The devoutly Catholic Anscombe thought that these actions made Truman a murderer, and thus unworthy of the university's honor-but that this verdict depended on an understanding of intentional action that had been widely rejected in contemporary moral philosophy. Intention was her attempt to work out that understanding and argue for its superiority over a conception of intention as an inner mental state. Though recognized universally as one of the definitive works in analytic philosophy of action, Anscombe's book is often dismissed as unsystematic or obscure, and usually read through the lens of philosophical concerns very far from her own. By arguing for the indispensable relevance of intention in the moral evaluation of acts, the book moves against a mainstream, "objective" approach in normative ethics. It is commonly held that the intentions, knowledge, and volition of agents are irrelevant to the moral permissibility of their acts. This book stresses that the capacities of agency, rather than simply the label "agent," must be engaged during an act if its moral evaluation is to be coherent. The author begins with an ontological argument that an act is a motion or a causing of change in something else. He argues that the source of an act’s moral meaning is in the agent: specifically, what the agent, if aware of relevant facts around her, aims to accomplish. He then moves to a series of critical chapters that consider arguments for mainstream approaches to act evaluation, including Thomson’s dismissal of the agent knowledge and volition requirements, Scanlon’s arguments for a derivative relevance of intentions to permissibility, Frowe’s "causal roles" of agents in the moral evaluation of acts, and Bennett’s explicit defense of the objective approach. The book concludes by offering the author’s preferred replacement for the objective approach, an Aristotelian-Thomist view of acts. The question matters because the interpretation of statutes is often thought to centre on the intention of the legislature and because the way in which the legislature acts is relevant to the authority it does or should enjoy. Many scholars argue that legislative intent is a fiction: the legislative assembly is a large, diverse group rather than a single person and it seems a mystery how the intentions of the individual legislators might somehow add up to a coherent group intention. This book argues that in enacting a statute the well-formed legislature forms and acts on a detailed intention, which is the legislative intent. The foundation of the argument is an analysis of how the members of purposive groups act together by way of common plans, sometimes forming complex group agents. The book extends this analysis to the legislature, considering what it is to legislate and how members of the assembly cooperate to legislate. The book argues that to legislate is to choose to change the law for some reason: the well-formed legislature has the capacity to consider what should be done and to act to that end. This argument is supported by reflection on the centrality of intention to the nature of language use. The book then explains in detail how members of the assembly form and act on joint intentions, which do not reduce to the intentions of each member, before outlining some implications of this account for the practice of statutory interpretation. Developing a robust account of the nature and importance of legislative intention, the book represents a significant contribution to the literature on deliberative democracy that will be of interest to all those thinking about legal interpretation and constitutional theory.

Book excerpt: The nature and function of language as Man's chief vehicle of communi cation occupies a focal position in the human sciences, particularly in philosophy. The concept of 'communication' is problematic because it suggests both 'meaning' (the nature of language) and the activity of speaking (the function of language). The philosophic theory of 'speech acts' is one attempt to clarify the ambiguities of 'speech' as both the use of language to describe states of affair and the process in which that description is generated as 'communication'. The present study, Speech Act Phenomenology, is in part an exam ination of speech act theory. The theory offers an explanation for speech performance, that is, the structure of speech acts as 'relationships' and the content of speech acts as 'meaning'. The primary statement of the speech act theory that is examined is that presented by Austin. A seconda ry concern is the formulation of the theory as presented by Searle and Grice. The limitations of the speech act theory are specified by applying the theory as an explanation of 'human communication'. This conceptual examination of 'communication' suggests that the philosophic method of 'analysis' does not resolve the antinomy of language 'nature' and 'function'. Basically, the conceptual distinctions of the speech act theory (i. e. locutions, illocutions, and perlocutions) are found to be empty as a comprehensive explanation of the concept 'communication'.
