Available in PDF, EPUB and Kindle. Book excerpt: The idea of compiling a bibliography of legal Festschriften originated with Lilly Roberts, and represented the most important creative side of her life during the last ten years of her association with the Universi ty of Michigan Law Library. The project received advice and counsel from the Foreign Law Com mittee of the American Association of Law Libraries. The final publi cation was made possible by an allocation from the grant made to the University of Michigan Law School by the Ford Foundation for re search in International and Comparative Law. Beverley J. Pooley Professor of Law Director of the Law Library University of Michigan PREFACE The present bibliography is international in scope; it covers Fest schriften published in many countries. It includes Festschriften from 1868 (date of the earliest legal Festschrift found) through December, 1968. A bibliography of all legal Festschriften, to be complete, could only be achieved through the cooperative effort of an international group of experts. The present bibliography is based on notes gathered by the compiler over a period of years from material available at the University of Michigan Law Library. It is therefore, inevitably, incom plete and occasionally inaccurate and must be considered as a tentative list, subject to implementation and correction at other legal centers. It was felt, however, that its publication might be of some use, since not enough bibliographical information about this important and steadily growing type of legal literature exists.

Available in PDF, EPUB and Kindle. Book excerpt: This fully revised and updated second edition of The Oxford Handbook of Comparative Law provides a wide-ranging and diverse critical survey of comparative law at the beginning of the twenty-first century. It summarizes and evaluates a discipline that is time-honoured but not easily understood in all its dimensions. In the current era of globalization, this discipline is more relevant than ever, both on the academic and on the practical level. The Handbook is divided into three main sections. Section I surveys how comparative law has developed and where it stands today in various parts of the world. This includes not only traditional model jurisdictions, such as France, Germany, and the United States, but also other regions like Eastern Europe, East Asia, and Latin America. Section II then discusses the major approaches to comparative law - its methods, goals, and its relationship with other fields, such as legal history, economics, and linguistics. Finally, section III deals with the status of comparative studies in over a dozen subject matter areas, including the major categories of private, economic, public, and criminal law. The Handbook contains forty-eight chapters written by experts from around the world. The aim of each chapter is to provide an accessible, original, and critical account of the current state of comparative law in its respective area which will help to shape the agenda in the years to come. Each chapter also includes a short bibliography referencing the definitive works in the field.

This book was released on 2024-10-28 with total page 333 pages. Available in PDF, EPUB and Kindle. Book excerpt: The emphasis in this present volume of Professor Feenstra’s studies lies on the post-medieval development of legal scholarship. The opening two studies are concerned with the University of Orléans in the 13th-14th centuries, but from there the centre of interest shifts to the early modern Netherlands. Two important themes are the teaching of law, especially at the legal faculties of Leyden and Franeker, and the doctrines of private law (especially property, contract, and succession). The figure of Hugo Grotius, his sources and his influence, dominate these articles.

Book excerpt: To mark the occasion of David Daube's sixty-fifth birthday his friends and pupils have contributed to a special volume on the subject of Jewish legal history. These essays are intended as a tribute to a man whose historical and comparative approach to the study of Jewish and Roman law has provided revolutionary insights into the whole development and systematisation of the legal system. Only part of the scope of Daube's work is represented by the subjects of these studies, although they extend from Biblical law to a late mediaeval responsum, modern Hebrew literature and contemporary legal philosophy. All traditional areas of civil law, including marine insurance and what we now call labour law, are included. However, Jewish law cannot be pursued in isolation from the mainstream of Jewish studies and this volume includes papers on the Dead Sea Scrolls, the Palestinian Targumim, and capital jurisdiction in the Roman province of Judaea.

Available in PDF, EPUB and Kindle. Book excerpt: The International Law Commission's Guiding Principles for Unilateral Declarations and its Guide to Practice on Reservations to Treaties are among the recent developments in international law. These developments support a new assessment on how optional clauses (eg Article 62(1) of the American Convention on Human Rights) and especially the Optional Clause (Article 36(2) of the Statute of the International Court of Justice (ICJ)) can be characterised and treated. The question is in how far optional clauses and the respective declarations can be considered a multilateral treaty or a bundle of unilateral declarations and to what extent one of the corresponding regimes applies. Based, inter alia, on the jurisprudence of the Permanent Court of International Justice and the ICJ on the Optional Clause, but also on the relevant jurisprudence of the Inter-American Court of Human Rights and the European Court of Human Rights and the General Comments of the United Nations Human Rights Committee, this book provides a comprehensive assessment of all legal issues regarding the Optional Clause and also optional clauses in general. The book deals with the making of Optional Clause declarations, the interpretation of such declarations and reservations made to the declarations as well as the withdrawal or amendment of declarations.
