The 2016 referendum vote to leave the EU marked a turning point in the UK’s political system. Book excerpt: The history of reform of the House of Lords has a long history since the Parliament Act 1911, and since the House of Lords Act 1999 removed the right of all but 92 hereditary peers to sit in the Lords, there has been a number of initiatives to further the debate on reform. The latest proposals are contained in the draft Bill (Cm. 8077, ISBN 9780101807722) published in May 2011, which was referred to the Joint Committee. In this report the Joint Committee acknowledges the controversial aspects of certain of the proposals and the members of the Committee reflect wider differences of opinion, many of the report's recommendations being decided by a majority. The majority supports the need for an electoral mandate, provided the House has commensurate powers. The current functions and role would continue, but the House would probably seek to be more assertive, to an extent that cannot be predicted. The Committee recommends a House of 450 members, 80% elected on a system of Single Transferable Voting (preferably that used in New South Wales, not the one proposed in the Bill) for a 15 year term.The main sections of the report cover: functions, role, primacy of the Commons and conventions; electoral system, size, voting system and constituencies; appointments, bishops and ministers; transition, salaries, IPSA, disqualification. The Committee recommends that, in view of the significance of the constitutional change, the Government should submit the decision to a referendum.

Book excerpt: In this report the Public Administration Select Committee (PASC) argues that the Government appoints too many ministers and should reduce their number by the middle of the Parliament, As it devolves real power and responsibility to local communities. And following the decision to cut the number of MPs in the House of Commons from 650 to 600, The Committee finds further scope for reductions. 141 MPs are currently on the 'payroll vote' as ministers or their Parliamentary aides. If this number remains static at the same time as MPs are cut, it will effectively increase the payroll vote - further strengthening the Executive at the expense of Parliament. PASC urges three steps on the Government to reduce this power of patronage: The current legal cap on the number of paid ministers should set the absolute limit; the legal limit on the number of ministers in the Commons should be cut by eight; the number of PPSs should be limited to one per department - a reduction of 26. The report recommends a review of ministerial numbers to reflect the smaller government. Ministers' time is not always well spent and the report identifies a number of ways in which the Government could therefore refocus ministers' work and make them more effective. The Committee believes it should ultimately be possible to cut the number of ministers to a total of 80, shared between the Commons and the Lords.

Book excerpt: This report from the Public Administration Select Committee (PASC) concludes that the practice of appointing ministers from outside Parliament via the House of Lords should be exceptional and subject to more checks and balances. Introducing a wider range of experience into ministerial teams can sometimes make government more effective, but government could also achieve this by making greater use of the range of talent on their own backbenches. The Committee argues for more scrutiny of outside appointments when they are made. The Prime Minister would be required to explain to the House of Commons why an appointment had been made, under what terms and what was expected of the minister during their time in government. The prospective appointee could be required to attend a pre-appointment select committee hearing. PASC identifies a strong argument of principle that ministers in an unelected House of Lords should be accountable to all Members of the House of Commons. People who have been appointed to the Lords to be ministers should not automatically receive a title and place in the legislature for life. It may be preferable to have a limited number of ministers who are members of neither House but accountable to both. The Committee also examined the role of so-called 'tsars'. There should be much more transparency about such appointments, with greater clarity about their roles and responsibilities and a public statement of what they have achieved in their posts.

The report compares the current situation with previous examples of Cabinet ministers being in the House of Lords. The Committee notes that the current situation differs from the past in that a significant proportion of the ministerial support team is based in the Lords or shared with other departments. It is unfortunate that the department for business is so thinly represented in the Commons. One solution would be to amend Standing Orders to allow Lord Mandelson to appear at the Despatch Box to answer questions in the Commons. There are precedents for this approach. Such a change might, though, encourage governments to appoint more members of the House of Lords as department heads, and the Committee feels that would be an unwelcome and significant constitutional change. The Procedure Committee should investigate a mechanism for parliamentary questions to the Secretary of State for Business, Enterprise and Regulatory Reform.
