Book Synopsis Ill-Gotten Money and the Economy by : Stuart Yikona
Download or read book Ill-Gotten Money and the Economy written by Stuart Yikona and published by World Bank Publications. This book was released on 2011-10-11 with total page 104 pages. Available in PDF, EPUB and Kindle. Book excerpt: Many developing countries have introduced policies to tackle ill-gotten money over the past years. Perception remains that such moves were more a result of international pressure being exercised than genuine ownership of such an agenda. There is not enough analysis and literature of how an anti-financial crime framework does (or does not) contribute to the development path of developing countries or how best to use these tools in a developing country environment. This study was aimed at initially exploring the effects of ill-gotten money or proceeds of crime and anti-money laundering policies on economic development. The study focused on two developing countries: Malawi, (a low-income country) and Namibia (an upper-middle-income country). The starting point of this analysis is that anti-money laundering is essentially a tool to address criminal activities and that, as a result, understanding criminal activities and how proceeds of crime impact development. The purpose of this study was: (i) to provide an initial answer to the question if and how measures to address proceeds of crime contributes to economic development; and (ii) to develop a framework that enable governments in developing countries to analyze the main sources of ill-gotten money and its effects on the economy.

Download or read book Unfinished Business: Democracy in Namibia written by M. Sims and published by African Books Collective. This book was released on 2012-04-24 with total page 174 pages. Available in PDF, EPUB and Kindle. Book excerpt: Idasas Democracy Index initially developed for South Africa is being expanded into Southern Africa in an effort to broaden the capacity of individuals and organisations monitoring and supporting democratic governance efforts in the region. This inaugural Democracy Index for Namibia is intended to set a benchmark for democracy to be measured against. The tool assesses the countrys depth of democracy through five focus areas: participation, elections, accountability, political rights, and human dignity. The research relies on expert analysis to answer a set of questions that interrogate how closely, in practice, democracy meets the broad ideal of self-representative government. More specifically, to what extent can citizens control elected officials and government appointees who make decisions about public affairs? And how equal are citizens to one another in this accountability process? The purpose of the scores is to assist citizens in making their own judgements, based on the information made available, to stimulate national debate and to provide democracy promoters with a tool for identifying issues and needs that can be addressed by education, advocacy, training, institution building and policy revision.

Book Synopsis The Accountability of Armed Groups Under Human Rights Law by : Katharine Fortin
Download or read book The Accountability of Armed Groups Under Human Rights Law written by Katharine Fortin and published by Oxford University Press. This book was released on 2017 with total page 465 pages. Available in PDF, EPUB and Kindle. Book excerpt: Today the majority of the armed conflicts around the world are fought between States and armed groups, rather than between States. This changed conflict landscape creates an imperative to clarify the obligations of armed groups under international law. While it is generally accepted that armed groups are bound by international humanitarian law, the question of whether they are also bound by human rights law is controversial. This book brings significant new understanding to the question of whether and when armed groups might be bound by human rights law. Its conclusions will benefit international law academics, legal practitioners and political scientists and anthropologists working on issues related to rebel governance and civil wars. This book addresses the debate on this topic by employing a theoretical, historical, and comparative analysis that spans international humanitarian law, international criminal law, and international human rights law. Embedding these different perspectives in public international law, this book brings several key points of clarification to the legal framework. Firstly, the book draws upon social science literature on armed conflict to present a new viewpoint on the role that human rights law plays vis-a-vis international humanitarian law in non-international armed conflicts. Secondly, the book sheds light on the circumstances in which armed groups acquire obligations under human rights law. It brings illumination to these topics by combining historical and comparative research on belligerency, insurgency, and international humanitarian law with a theoretical analysis of legal personality under international law. In the final part of the book, the author tests the four most utilised theories of how armed groups are bound by human rights law, examining whether armed groups can be bound by virtue of (i) treaty law (ii) control of territory (iii) international criminal law and (iv) customary international law. In the book's conclusions, the author presents final remarks that are designed to provide concrete guidance on how the issue of armed groups and human rights law can be dealt with more thoroughly in practice.
