Book excerpt: The renegotiation and possible termination of the North American Free Trade Agreement (NAFTA) sparked a lot of interest and concern in light of the United States’ declared objective to “rebalance the benefits” of the agreement. This edited book provides an overview of the changes brought to the NAFTA by the United States-Mexico-Canada Agreement (USMCA) or NAFTA 2.0. Grouping leading academics and experts from the three countries, the book covers the major topics in the transition from the NAFTA to the USMCA. The book also sheds light on the evolution of North American economic integration within the past three decades and reflects on the significance of the regional integration model represented by the NAFTA and now the USMCA. The book is aimed at scholars, students, officials, professionals and interested citizens concerned by the big issues surrounding North American integration and economic globalization.

Available in PDF, EPUB and Kindle. Book excerpt: This book provides a comprehensive and updated legal analysis of the equality principle in EU law. To this end, it argues for a broad definition of the principle, which includes not only its inter-individual dimension, but also the equality of the Member States before the EU Treaties. The book presents a collection of high-quality academic and expert contributions, which, in light of the most recent developments in implementing the post-Lisbon legal framework, reflect the current interpretation of the equality principle, examining its performance in practice with a view to suggesting possible solutions in order to overcome recurring problems. To this end the volume is divided into three Parts, the first of which addresses a peculiar aspect of the EU equality that is mostly overlooked in the investigations devoted to this topic, namely, equality among States. Part II shifts to the inter-individual dimension of equality and explores some major developments contributing to (re)shaping the global framework of EU anti-discrimination law, while Part III undertakes a more practical investigation devoted to the substantive strands of that area of EU law.

Available in PDF, EPUB and Kindle. Book excerpt: This interdisciplinary book explores the concept of convergence of the EU with the global legal order. It captures the actions, law-making and practice of the EU as a cutting-edge actor in the world promoting convergence 'against the grain'. In a dynamic 'twist' the book uses methodology to reflect upon some of the most dramatically changing dimensions of current global affairs. Questions explored include: who and what are the subjects and objects of convergence as to the EU and the world? How do 'court-centric' and less 'court-centric' approaches differ? Can we use political science and international relations as 'service tools'? Four key themes are probed: - framing EU convergence; - global trade against convergence; - the EU as the exceptional internationalist; and - positioning convergence through methodology.

Book excerpt: This book explores the extent to which EU Free Trade Agreements (FTAs) pursue sustainable agriculture in third country parties. It contends that this should be part of a duty for the EU enshrined in the Treaties to promote its fundamental values in its external action. It suggests that the extent to which this occurs in practice, may be reviewed judicially by the Court of Justice of the European Union. Against this background, selected agreements concluded by the EU with developed and developing countries (Canada, South Korea, Ukraine, Chile, SADC countries and Vietnam) are taken as case studies. The author concludes that, in spite of the remarkable progress made hitherto, EU trade policy is still far from being in line with the increasingly strong commitment of the EU to take the lead in the international arena for environmental and climate matters. This work adopts primarily a legal methodology, but it broaches the subject in interdisciplinary terms. It is addressed not only to (EU) policy-makers, but also to scholars of different fields and to the wider public interested in topics that have become of common concern for the future of our planet. With a foreword by Daniel Calleja Crespo, Director General of the European Commission - DG Environment

Available in PDF, EPUB and Kindle. Book excerpt: This book discusses the treatment of cultural products within international trade law, focusing on preferential trade agreements. Trade and culture intersect when cultural products are involved. These mainly encompass cinema, broadcasting, music, videos, and publishing, either in traditional or digital formats. As such products reflect the cultural identities of states, they have led to a debate as to whether, or the extent to which, they should be exempted from trade obligations. With multilateral negotiations in gridlock, states have increasingly turned to preferential trade agreements. Concurrently, digital technologies have revolutionized how cultural contents are created and distributed. The book analyzes the provisions relating to cultural products within trade agreements, as well as their relationship with the provisions and guidelines on cultural goods and services under the UNESCO Convention on Cultural Diversity. Drawing comparisons between states as to the treatment of cultural products in preferential trade agreements and considering the norms and provisions relating to cultural products under different regimes, the book offers a truly comprehensive overview of the evolution of the trade and culture debate. The book will be of interest to researchers in the fields of cultural products, trade agreements, digital technology, trade law, and cultural diversity.

This book was released on 2001-07-01 with total page 1154 pages. Available in PDF, EPUB and Kindle. Book excerpt: The year 2000's most significant international event was, almost certainly, neither political nor military, but scientific - the announcement, in June, that the human genome had been almost totally decoded. Future generations may well see this as a major turning point, opening the way to radical changes in diagnosis, prognosis, and medical treatment. Often compared with the space programme, this vast enterprise still generates misgivings: this new power, which human beings now have, to modify the genetic heritage of living creatures raises fundamentally new ethical questions - and society as a whole will have to find the answers. In fact, the accelerating pace of scientific and technical progress seems to be reviving atavistic anxieties, some rational, others less so. Recent public-health crises, including the mad cow disease' scare, which lasted into 2000, have fuelled these fears. The public's rejection of GMOs (Genetically Modified Organisms) - verging on a crusade in some countries - tells its own story. As regards conflict, 2000 saw the Middle East peace process grind to a halt, and the Intifada resume. In Europe, the situation in Kosovo and Chechnya, both the scenes of fighting in 1999, stayed precarious. Peace and democracy did score some successes, however, particularly in Europe: the centre-left's victory in Croatia, sweeping former President Tudjman's party off the scene, the democratic party's triumph in Bosnia, and the fall of the Milosevic regime in Serbia.

Book excerpt: This volume fills a gap in the literature regarding questions around the interactive dynamics between law and diplomacy on international trade and investment. It brings together lawyers and political scientists from Europe and Asia in an interdisciplinary effort at tracing the respective roles of law and diplomacy in the relations of the European Union (EU) with its trade and investment partners in Asia. Focusing on trade and investment relations with Asia, the EU presents a particularly interesting case as it has been a strong proponent of a rules-based international economic order for years and a frequent user of the formal procedures established in international treaties in case of disputes. At the same time, it has kept diplomatically active to adjust dispute management and international agreements to the needs and demands of the partners involved. Furthermore, not only is this region of crucial importance due to the presence of both vigorous emerging economies, like China, India and Vietnam, and more established partners, like Japan, EU-Asia relations also present a broad set of economic disputes and recent negotiation efforts analyzed in the contributions to this volume. This book will be of key interest to scholars and students of international trade/economic law, EU politics, EU external relations (law), international relations, diplomacy and more broadly to international relations and Asian studies.

Book excerpt: Bill Gates and other wealthy individuals around the world do pay taxes--but usually at rates far below what most taxpayers pay. As Warren Buffet says, his secretary pays a higher tax rate than he does on his multi-million dollar income. And most big corporations have mastered the art of paying next to nothing in taxes. Many experts and financial journalists dismiss the idea that higher taxes for rich people and large corporations would make a difference to government revenues. Even Bill Gates's personal fortune wouldn't make a dent in the huge US government deficit. But Harvard-trained economist and tax expert Brigitte Alepin has a different point of view. Relying on her in-depth knowledge of tax systems in Canada, the US, France, and elsewhere, Alepin provides a behind-the-scenes explanation of what has happened to create a massive gap in government revenues. Over the last twenty years, large corporations, the super-rich, and private foundations have found many ways and means to avoid being taxed. This black hole in government revenues-found in virtually every country-accounts for trillions of dollars in lost revenue every year. As Alepin demonstrates using data drawn from leading international organizations, those missing trillions would go a long way towards allowing the world's governments to balance their books. Collecting taxes from big corporations and the super-rich cannot be done by any one country alone. But with governments of all political stripes facing this common problem, there are concrete steps they can take together to address it. Ensuring that wealthy individuals and corporations pay their fair share in taxes would not result in ruinously high rates. Instead, it would mean that the super-rich and corporations would pay their fair share of taxes at rates that would reflect their true ability to pay. Brigitte Alepin shows how a fair tax system for Bill Gates and for the world's richest individuals and corporations can be the answer to the financial crisis the world faces today.
