This book was released on 2016-04-20 with total page 234 pages. Available in PDF, EPUB and Kindle. Book excerpt: More and more the modern workplace faces challenges of diversity and employability. There is an increasingly insistent need to match workforce diversity, or workers' own characteristics and choices, with employers' organizational and business requirements. In this context, the notion of reasonable accommodation inevitably arises. Concepts such as 'adaptability' and 'employability' not only require workers to adapt to new labour market circumstances but are also directed towards employers' duties to accommodate work and the workplace to the worker's situation. This book is the first study to analyse, at a global scale, how employment discrimination law gives shape to an accommodated workplace in three main areas of interest: age, disability, and religion/belief. Sixteen prominent labour and employment law scholars offer in-depth perspectives from Belgium, the Netherlands, France, Sweden, Russia, Israel, Canada, the United States, South Africa, and Australia. Each report fully integrates relevant legislation, case law, and legal doctrine and follows the same structure to allow easy comparisons across jurisdictions. Attention is also given to the roles of European Union law and the UN Convention on the Rights of Persons with Disabilities. Issues and topics covered include the following: - the scope of 'accommodation'; - 'reasonable' defined; - recognized business requirements that may override the duty to accommodate; - when employers' neutrality policies to avoid accusations of discrimination may constitute indirect discrimination; - use of integration or re-integration strategies to accommodate disabled/incapable workers; - use of 'exit gateways' that enable employers to avoid liability in cases of disability discrimination; - when employers must take into account workers' family lives; and - when an obligation to reclassify a worker exists. These articles were originally presented as papers at the 2015 meeting of the International Association of Labour Law Journals hosted by the Institute for Labour Law of the University of Leuven. Ultimately the book makes clear that reasonable accommodation cannot be narrowed down to a formal anti-discrimination perspective but requires an integrative logic that can grow in a broader labour law context. As a compelling analysis of whether the idea of reasonable accommodation is winning ground in labour law in today's world, this book will prove of immeasurable value to labour and employment lawyers and judges, as well as to corporate counsel and academics in the field.

Book excerpt: Changes that parents and other family members make to their own behaviors to help a child avoid or alleviate anxiety are known as accommodations. Parental accommodation is a key aspect of child anxiety, and has a major impact on course, severity of symptoms and impairment, family distress, and treatment outcomes. As such the careful, gradual removal of accommodation by parents and loved ones is an important target of anxiety treatment for children. Addressing Parental Accommodation When Treating Anxiety in Children provides invaluable guidance to clinicians who wish to address accommodation within the context of a broader treatment strategy for anxious children, or as a stand-alone treatment. Clinicians will learn from this concise and easily accessible primer how to help parents identify and monitor accommodation, how to create treatment plans for reducing accommodation, and how to help parents communicate these plans to their children and implement them effectively. They will also learn how to help families cope with disruptive child responses to reduced accommodation, how to work with parents who struggle to cooperate, and what to do about a child's threats of self-harm. The book includes transcripts and rich clinical illustrations, as well as guidance on how to discuss accommodation with both parents and children-including a wealth of easily understood metaphors to aid in approaching the topic with empathy and without judgment. Addressing Parental Accommodation When Treating Anxiety in Children is an essential resource that will be of use to psychologists, counsellors, and clinical social workers who treat anxious children.

Book excerpt: Problems – of integration, failed political participation, and requests for various kinds of accommodation – seem to dominate the research on minority Muslims in Western nations. Beyond Accommodation offers a different perspective, showing how Muslim Canadians successfully navigate and negotiate their religiosity in the more mundane moments of their lives. Drawing on interviews with Muslims in Montreal and St. John’s, Selby, Barras, and Beaman examine moments in which religiosity is worked out. They critique the model of reasonable accommodation, which has been lauded internationally for acknowledging and accommodating religious and cultural differences. The authors suggest that it disempowers religious minorities by implicitly privileging Christianity and by placing the onus on minorities to make requests for accommodation. The interviewees show that informal negotiation occurs all the time; scholars, however, have not been paying attention. This book advances a new model for studying the navigation and negotiation of religion in the public sphere and presents an alternative picture of how religious difference is woven into the fabric of Canadian society.
