Book excerpt: Nepal's citizens engage in foreign employment at the highest per capita rate of any other country in Asia, and their remittances account for 25 percent of the country's GDP. The Middle East is now the most popular destination for Nepalis -- nearly 700,000 were working in the Middle East in 2011 on temporary labor contracts. For some Nepalis, working abroad provides much-needed household wealth. For others, their contributions to Nepal come at great personal cost. Migrant workers in the Gulf, for example, routinely report wage theft, lack of time off and unsafe and unhealthy working conditions. Some migrant workers report psychological and physical abuse, and other forms of labor exploitation that may rise to the level of forced labor, debt bondage or other forms of trafficking. Women engaged in domestic work are often isolated in the home, where they may also endure emotional, physical and sexual abuse. The story of labor migration begins and ends at home. The conditions that give rise to labor trafficking are often set pre-departure in the recruitment phase itself. Between 2012 and 2014, researchers from Nepal, Australia and the United States conducted a study on migrant workers' access to justice in Nepal, including for exploitation and trafficking. Justice was defined to comprise both compensation for losses, and the holding of perpetrators accountable, for example through fines, licensing sanctions, or even imprisonment. The study found that overall access to justice in Nepal was extremely low, especially for migrant workers who have been survivors of labor trafficking. However, clear routes exist to improvement. The full results of the study, and related recommendations, are contained in the report Migrant Workers Access to Justice at Home: Nepal. This is the second study in a series providing a comprehensive analysis of migrant workers' access to justice at home; the first study, Migrant Workers Access to Justice at Home: Indonesia, was published October 2013.

Countries of the Association of Southeast Asian Nations (ASEAN) are now the origin of 8 percent of the world's migrants. These countries host only 4 percent of the world's migrants but intra-regional migration has turned Malaysia, Singapore, and Thailand into regional migration hubs that are home to 6.5 million ASEAN migrants. However, significant international and domestic labor mobility costs limit the ability of workers to change firms, sectors, and geographies in ASEAN. This report takes an innovative approach to estimate the costs for workers to migrate internationally. Singapore and Malaysia have the lowest international labor mobility costs in ASEAN while workers migrating to Myanmar and Vietnam have the highest costs. Singapore and Malaysia's more developed migration systems are a key reason for their lower labor mobility costs. How easily workers can move to take advantage of new opportunities is important in determining how they fare under the increased economic integration planned for ASEAN. To study this question, the report simulates how worker welfare is affected by enhanced trade integration under different scenarios of labor mobility costs. Region-wide, worker welfare would be 14 percent higher if barriers to mobility were reduced for skilled workers, and an additional 29 percent if barriers to mobility were lowered for all workers. Weaknesses in migration systems increase international labor mobility costs, but policy reforms can help. Destination countries should work toward systems that are responsive to economic needs and consistent with domestic policies. Sending countries should balance protections for migrant workers with the needs of economic development.

Overseas markets are a critical source of employment for South Asian economies that may not be able to absorb workers sufficiently or quickly enough into the domestic labor market. Migrant workers typically experience wage gains of at least three times their earnings back home, in addition to acquiring new skills and accumulating savings that can be used to start up entrepreneurial activities upon returning home. Remittances sent by migrants while abroad also boost household consumption and support macroeconomic stability in countries of origin. However, multiple challenges exist that prevent migration from achieving its full development potential. These challenges include high monetary costs, information gaps on employment opportunities in destination countries, a lack of protection while abroad, and high concentrations of migrants in few sectors and destinations. These often prevent the poorest from migrating overseas and may place those who actually migrate in situations of considerable vulnerability. Building on rigorous analytics, this book highlights policy actions that can be taken at all stages of the migration life cycle, including after return, to minimize the risks and maximize the benefits of migration for migrants themselves, their families, and the home economy. The book examines commonalities and differences in the operation of various structures of power (gender, class, race/ethnicity, generation) and their interactions within the institutional domains of intra-national and especially inter-national migration that produce context-specific forms of social injustice. Additional contributions have been included so as to cover issues of legal liminality and how the social construction of not only femininity but also masculinity affects all migrants and all women.
