Book excerpt: Excerpt from A Treatise on Homestead and Exemption Laws The latest revisions of statutes on file in the St. Louis Law Library show that homestead laws exist in all the States of the Union. Except Connecticut, Rhode Island, New Jersey, Delaware, Pennsylvania, Maryland, West Virginia, * and Indiana. The earliest American homestead law of which the writer has knowledge was an act of the republic of Texas, passed January 26, 1839. This statute (1 Pasc. Dig. Texas Laws, art. 3798) exempted from execution, to every citizen or head of a family in this republic, fifty acres of land, or one town lot, including his or her homestead, and improvements not exceeding five hundred dollars in value, together with tain enumerated chattels. The founders of the infant republic wisely enacted that the passage of this act shall not interfere with contracts between parties heretofore made. See post, a 10 et seq. The Spanish law, which this system displaced, pro vided for many exemptions, such as implements of husbandry, bread of bakers. Tools of artificers, books of advocates and students, beds, wearing-apparel. And other things necessary for daily use. Cobbs v. Coleman, 14 Texas. 599. From the passage of the act first named, the protection of the homestead became a favorite object with the legislatures of Texas; and when that republic adopted a new constitution, on enter ing the American Union in 1845, that instrument, for the first time among American constitutions, guaranteed a family homestead, of given dimensions and value. From forced sale for the payment of debts, and from alienation by the husband without consent of the wife. Const. Texas 1845, art. 7, a 22; 1 Pasc. Dig. Laws Texas, 65. The earliest legislation of the other states on this subject, of which the writer has knowledge, was the Vermont act of 1849. From this period the subject was taken up by the legislatures of other states, and the protection of the family homestead of debtors from forced sale soon became a part of the general policy of the country. Book excerpt: Excerpt from The Law of Homestead and Exemptions It was deemed wise to set forth the facts of some particular cases, as well as the peculiarities of the statutes under which they arose, that the reader might determine how far the rules laid down therein would apply to other cases or localities, the aim being to make a work which should prove useful to the practitioner. Cases arising under the bankrupt law or concerning per sonal property have all been collected in the chapters upon those subjects, even though determining the same principles as those announced in the earlier chapters of the book. Book excerpt: Excerpt from A Treatise on the Law of Easements, in Continuation of the Author's Treatise on the Law of Real Property I have cited a great number of cases, about five thousand, and believe that they will generally be found to fully support the propo citions to which they are cited. It should, however, be kept in mind that the writer of a legal text-book often cites cases which are not decisions sustaining the statement in his text, but only contain dicta, or, perhaps, a discussion of the matter in hand, or a reference to it, without any expression of opinion by the court. A writer who undertakes to make a reasonably full citation of authorities would be considered much in fault if he merely cited those decisions which squarely meet and sustain his text. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Law of Easements, an Elementary Treatise Of the many rights and obligation attaching to the ownership of land, those which arise in connection with Easements are undoubtedly of very great importance. The fact that an easement does, or does not, exist, may greatly affect the value of a property. For this reason it is essential that those whose duty it is to value, sell, or report upon property should know what rights and obligations an easement entails. It is also an advantage for an owner or purchaser of land to understand what is the effect of an easement on his property. This book has been written with the object of giving information, on the Law of Easements, to students and other readers who are not members of the Legal Profession. The Authors have endeavoured to express themselves in plain and simple language, even at the risk of being too elementary, and have avoided as far as possible the use of terms which may not be readily understood by students. Where the use of such terms has been unavoidable, their meanings have been given. Comparatively few cases have been cited, the object being to embody in the text the principles upon which the decided cases have been based, rather than to give lengthy details in an elementary work. Those readers who desire a more extensive knowledge of the Law of Easements are referred to the works of the standard authors on the subject. Book excerpt: Excerpt from The Law of Eminent Domain, Vol. 1 of 2: A Treatise on the Principles Which Affect the Taking of Property for the Public Use Eight years ago the author of this work issued a volume of some four hundred and twenty - two pages devoted to a discussion of the constitutional limitations upon the power of eminent domain, and While he has had no cause to com plain of the manner in Which his work was received by the critics of the various law reviews, or of the consideration which has been given to his opinions and conclusions by the courts of last resort of many of the states, and while it is doubtless true that a large proportion of the cases arising out of the attempted exercise of the power of eminent domain Which reach the courts of last resort in volve questions of constitutional law, yet it must be con ceded that in the ordinary eminent domain case such as the average attorney encounters in his practice, Which involves merely questions as to the measure of compensation and the proper procedure to be employed, the volume in ques tion was of no service Whatever. The demand upon the author to extend the scope of his work so as to cover all phases of the law of eminent domain has been sufficiently insistent to induce him to attempt the task, and the present treatise is the result. Book excerpt: Excerpt from Practical Treatise on the Law of Replevin in the United States: With an Appendix of Forms, and a Digest of Statutes There is no part of the law, unblended with public jurisprudence or politics, which has been more obviously improved in the United States than Replevin. From the cumbrous weapon, useful only in a narrow field, to which Coke and Gilbert were accustomed, it has, in more than one half of the United States, been fashioned into the ready instrument for the adjustment of all disputes, in regard to the ownership of personal property. In some of the states, Pennsylvania for instance, this improvement has been the result of time, operating upon early colonial customs, occasionally assisted by judicial legislation. In other states, indeed in most of the northern and western states, the law has been codified, and the improvements which experience suggested, introduced; the frame work of the action remaining unchanged. The present work originated in the difficulty which the author experienced, on an occasion in which he was called upon to use the action of replevin.
