Book excerpt: Excerpt from Cases on Equity Pleading and Practice The cases contained in this volume have been selected with a view of assisting both the student and the instructor, with illustrations of the practical application of the general principles and rules of equity pleading and practice. Only so much of the statement of fact and of the opinion of the court have been retained in each case as is sufficient to make the decision upon the question of pleading before the Court intelligible and clear. As far as possible all padding has been excluded. In the selection of these cases and in the preparation of this volume, we are greatly indebted to the valuable assistance of John W. Dwyer, LL.M., Instructor of Law in the University of Michigan. Littleton has said: "And know, my son, that it is one of the most honorable, laudable, and profitable things in our law to have the science of well pleading; and, therefore, I counsel thee especially to employ thy courage and care to learn this." We hope that this collection of cases will be of some practical assistance to the teacher in giving instruction in this very difficult branch of the law and that it will stimulate the courage of the student to master the "science of well pleading." Book excerpt: Excerpt from A Manual of Equity Pleading and Practice: State and Federal For man's intellectual use and guidance, however, it is necessary that some authoritative agency, like the courts, through their decisions, formulate rights in lan guage as accurately as possible from time to time, ao cording to the light of reason, which means according to just and true grounds, so far as the race is able to perceive them. These decisions are law if the reason ing is sound. Thus, in American and English law, nu like the foreign Napoleonic statutory code law, the basic rights of man, 'among which are life, liberty, and the pursuit of happiness, phrases which include numberless rights, are not intended to be created or limited by statutory words, but are discoverable by sound reason alone; and justice is established not upon the words of this or that legislature, or king, or mob, not even upon unreasonable or degraded custom, but upon sound reason alone. Reason is the highest law, said Cicero. What is not reason is not law, says Blackstone. He knows not the law who knows not the reason thereof, says Coke. Her seat is the bosom of God, says Hooker. It is because our system of law rests upon such foundations that the American or English lawyer becomes a zealous stud ent, an enthusiastic devotee of the law. Book excerpt: Excerpt from Federal Equity Practice, Vol. 1 of 3: A Treatise on the Pleadings Used and Practice Followed in Courts of the United States in the Exercise of Their Equity Jurisdiction An examination of the illustrative cases used in this treatise will show pretty clearly, we think, that the author has endeavored to follow the plan of exposition thus recommended. The decisions of the English Chancery have been cited in this work when needed to elucidate points unsettled or left Obscure by the American cases, but no effort has been made to crowd the footnotes with English citations. The English works of Smith (2d ed.) and Daniell (lst ed.) have of course been carefully studied and freely utilized but when it has been found desirable to incorporate passages of any length from these writers, such matter has usually been quoted and printed in subordinate type. While this treatise was in course of preparation, the second edition of Gibson's Suits in Chancery appeared. This admirable work has been of much assistance, and by the kindness of Judge Gibson the present writer has been permitted to use it with the same freedom as he has used Smith or Daniell. For the generous extension of this privilege the author here expresses his sincere thanks. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Excerpt from Federal Equity Practice, Vol. 2 of 3: A Treatise on the Pleadings Used and Practice Followed in Courts of the United States in the Exercise of Their Equity Jurisdiction In large and complicated litigation the desirability of determining the details of the controversy in all its aspects in one suit is rightly given much weight. Here the court will allow issues to be brought in by cross bill which in a narrow view might be considered not ger mane to the original bill, and which, under other conditions, would be held to supply matter for an original suit only. This is particularly true in railroad foreclosures. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Excerpt from Concise Treatise: The Principles Equity Pleading: Precedents Since the great alterations introduced, by modern reforms, into the system of Equity Pleading, the want has been much felt, especially among the younger members of the profession and students, of a concise exposition of the principles and general rules of Equity Pleading. This want I have en deavoured to supply. I do not profess to go into the more minute and intricate questions which arise under special circumstances: questions on which, I apprehend, that any text book, however carefully compiled, would, after all, be but a superior sort of index to the authorities: the books must in actual practice be referred to, when any case special in its character arises. Book excerpt: Excerpt from Manual of Equity Pleading and Practice, as Modified by the New Federal Equity Rules: With Forms Professor Boke in his careful selection of illustrative cases on equity jurisprudence observes the marked influence that the right of discovery (that "great engine for the discovery of truth by the examination of the parties on oath") has had upon modern legislation; and cites as examples the inquisitorial powers conferred by the acts creating the Interstate Commerce Commission, the various Public Utilities Commissions, etc. The writer shares his views and ventures to supplement them by pointing to the same influence in matters relating to procedure, e. g., the provisions for the examination of parties for the discovery of assets under the Bankruptcy laws, the examinations in Supplementary Proceedings, and the provisions of the various Procedure Acts requiring affidavits of the parties in support of their pleadings. There is ample authority for the assertion that the administration of this right was the foundation of the broad jurisdiction acquired by the English Court of Chancery, and but little reflection compels the belief that the entire body of the rules governing the pleadings in equity are based upon it. The fact that so many cases in the old reports involve the consideration of demurrers and pleas to the discovery alone, invites belief that they were first introduced as a defense only to discovery, and that their use as a defense to the relief was, comparatively speaking, an innovation. The influence of discovery in shaping the forms of the pleadings is further shown by analysis of the decisions wherein a plea was required to be supported by an answer; wherein the benefit of the plea was ordered saved to the defendant at the hearing; wherein a plea was ordered to stand for an answer with liberty to the plaintiff to except to it as such.
