Book excerpt: A Treatise on Dharma, written in the fourth or fifth century, is the finest example of the genre of dharma__stra--texts on religious, civil, and criminal law and the duties of rulers--that informed Indian life for a thousand years. It illuminates major cultural innovations, such as the prominence of documents in commercial and legal proceedings, the use of ordeals in resolving disputes, and the growing importance of yoga in spiritual practices. Composed by an anonymous author during the reign of the imperial Guptas, the Treatise is ascribed to the Upanishadic philosopher Yajnavalkya, whose instruction of a group of sages serves as the frame narrative for the work. It became the most influential legal text in medieval India, and a twelfth-century interpretation came to be considered "the law of the land" under British rule. This translation of A Treatise on Dharma, based on a new critical edition and presented alongside the Sanskrit original in the Devanagari script, opens the classical age of ancient Indian law to modern readers.

Book excerpt: This is the first scholarly book devoted to the study of the term dharma with in the broad scope of Indian cultural and religious history. Most generalizations about Indian culture and religion upon close scrutiny turn out to be inaccurate. An exception undoubtedly is the term dharma. This term and the notions underlying it clearly constitute the most central feature of Indian civilization down the centuries, irrespective of linguistic, sectarian, or regional differences. The nineteen papers included in this collection deal with many significant historical manifestations of the term dharma. These studies by some of the leading scholars in the respective fields will both present a more nuanced picture of the semantic history of dharma by putting contours onto the flat landscape we have inherited and spur further studies of this concept so central for understanding the cultural history of the Indian subcontinent.

Book excerpt: Whether defined by family, lineage, caste, professional or religious association, village, or region, India's diverse groups did settle on a concept of law in classical times. How did they reach this consensus? Was it based on religious grounds or a transcendent source of knowledge? Did it depend on time and place? And what apparatus did communities develop to ensure justice was done, verdicts were fair, and the guilty were punished? Addressing these questions and more, A Dharma Reader traces the definition, epistemology, procedure, and process of Indian law from the third century B.C.E. to the middle ages. Its breadth captures the centuries-long struggle by Indian thinkers to theorize law in a multiethnic and pluralist society. The volume includes new and accessible translations of key texts, notes that explain the significance and chronology of selections, and a comprehensive introduction that summarizes the development of various disciplines in intellectual-historical terms. It reconstructs the principal disputes of a given discipline, which not only clarifies the arguments but also relays the dynamism of the fight. For those seeking a richer understanding of the political and intellectual origins of a major twenty-first-century power, along with unique insight into the legal interactions among its many groups, this book offers exceptional detail, historical precision, and expository illumination.

Book excerpt: This introductory work proposes a fresh take on the ancient Indian concept dharma. By unfolding how, even in its developments as "law" and custom, dharma participates in nuanced and multifarious understandings of the term that play out in India’s great spiritual traditions, the book offers insights into the innovative character of both Hindu and Buddhist usages of the concept. Alf Hiltebeitel, in an original approach to early Buddhist usages, explores how the Buddhist canon brought out different meanings of dharma. This is followed by an exposition of the hypothesis that most, if not all, of the Hindu law books flowered after the third-century BC emperor Asoka, a Buddhist, made dharma the guiding principle of an entire realm and culture. A discussion built around the author’s expertise on the Sanskrit epics shows how their narratives amplified the new Brahmanical norms and brought out the ethical dilemmas and spiritual teachings that arose from inquiry into dharma. A chapter on the tale of the Life of the Buddha considers the relation between dharma, moksa/nirvana (salvation), and bhakti (devotion). Here, Hiltebeitel ties together a thread that runs through the entire story, which is the Buddha’s tendency to present dharma as a kind of civil discourse. In this sense, dharma challenges people to think critically or at least more creatively about their ethical principles and the foundations of their own spiritual values. A closing chapter on dharma in the twenty-first century explores its new cachet in an era of globalization, its diasporic implications, its openings into American popular culture, some implications for women, and the questions it is still raising for modern India.

Available in PDF, EPUB and Kindle. Book excerpt: The Dharma Manifesto is a call to action for those who seek a form of social and political action that has a firm spiritual foundation, but which also challenges the prevailing social and religious order in the postmodern West. It does not merely offer criticism - it is also a blueprint for how a national community founded upon Dharmic principles could operate in the twenty-first century. Its author defines the term "Dharma," which in the ancient Sanskrit language means "Natural Law," in an unconventional way. For those who embrace Dharma Nationalism, Dharma is predicated upon the pressing need for the organic and munificent resacralization of culture and of all human endeavor, as well as the manifestation of the highest potentials attainable by every individual in society in accordance with transcendental principles. Thus, Dharma does not only refer to traditions with which it is usually associated such as Hinduism and Buddhism, but also to the Taoist, Confucian, Zoroastrian, Native American, and European pagan traditions, all of which, this book holds, share a common, basic worldview. This book is therefore a resource for those who want to carry out both an inward, contemplative revolution within themselves as well an outer, social revolution in the world around them, in harmony with one another. It is intended to serve as a systematic program signaling the beginning of a what will hopefully be a new era in humanity's eternal yearning for meaningful freedom and happiness.

Book excerpt: Between 300 BCE and 200 CE, concepts and practices of dharma attained literary prominence throughout India. Both Buddhist and Brahmanical authors sought to clarify and classify their central concerns, and dharma proved a means of thinking through and articulating those concerns. Alf Hiltebeitel shows the different ways in which dharma was interpreted during that formative period: from the grand cosmic chronometries of kalpas and yugas to narratives about divine plans, gendered nuances of genealogical time, royal biography (even autobiography, in the case of the emperor Asoka), and guidelines for daily life, including meditation. He reveals the vital role dharma has played across political, religious, legal, literary, ethical, and philosophical domains and discourses about what holds life together. Through dharma, these traditions have articulated their distinct visions of the good and well-rewarded life. This insightful study explores the diverse and changing significance of dharma in classical India in nine major dharma texts, as well some shorter ones. Dharma proves to be a term by which to make a fresh cut through these texts, and to reconsider their own chronology, their import, and their relation to each other.

Available in PDF, EPUB and Kindle. Book excerpt: MADHYAMIKA The hallmark of Miidhyamika philosophy is 'Emptiness', sunyata. This is not a view of reality. In fact it is emphatically denied that sunyata is a view of reality. If anybody falls into such an error as to construe emptiness as reality (or as a view, even the right view, of reality), he is only grasping the snake at the wrong end (Mk, 24.1 I)! Nftgfujuna in Mk, 24.18, has referred to at least four ways by which the same truth is conveyed: Whatever is dependent origination, we call it emptiness. That is (also) dependent conceptualization; that is, to be sure, the Middle Way. The two terms, pratitya samutpiida and upiidiiya prajnapti, which I have translated here- as 'dependent origination' and 'dependent conceptualization' need to be explained. The interdependence of everything (and under 'everything' we may include, following the Mftdhyamika, all items, ontological concepts, entities, theories, views, theses and even relative truths), i.e., the essential lack of independence of the origin (cf. utpiida) of everything proves or shows that everything is essentially devoid of its assumed essence or its independent 'own nature' or its 'self-existence' (cf. svabhiiva). Besides, our cognition of anything lacks independence in the same way. Our conception (cf. prajnapti) of something a essentially depends upon something b, and so on for everything ad infinitum.
