Finch, after long experience at the bar, in London, accepted in Cambridge the duties of an academical teacher of law. Wishing to adopt the methods of the Harvard Law School, which he had visited, he prepared and published a collection of judicial decisions on the law of Contract. After his death, a second' edition of this work, enhanced in value by the care and learning of Mr R. T. Wright and Professor W. W. Buckland, was issued in 1896. It has long been out of print, and even second-hand copies of it can seldom be obtained. The desirability of its reproduction has thus been obvious. But, under present commercial conditions, a volume of dimensions so large could not be published except at a prohibitive cost. Under these circumstances, the Cambridge University Press, as proprietors of the copyright, decided that the book should again be made accessible; but in a form so abridged that its price should not place it beyond the reach of the ordinary student. The Syndics, with the kind and ready consent of Mr Wright and Professor Buckland, entrusted to me the preparation of the proposed work. I have omitted only those very few decisions that seem to have lost their authority or their interest. By the generous permission of the Incorporated Council of Law Reporting, I have been 'enabled to insert various cases that have been decided since the edition of 1896 was published. Most of the cases contained in that edition I have abridged greatly; but without much detriment, I hope, to their educational value. To some of the judgments I have added brief annotations; to explain or to develop the doctrines they establish. Book excerpt: Excerpt from Selected Cases on the Law of Contracts: With Annotations To present any subject of the law by means of cases, is only to follow out the idea of Lord Coke, that the reporting of particular cases is the most perspicuous course of teaching the right rule and reason of law; but in studying the law by such cases, the caution of Lord Mansfield is to be observed, that the law does not consist of particular cases, but of general principles, which are illustrated and explained by those cases. This book has been prepared for the purpose of presenting the general principles of the Law of Contracts, by the study of selected cases, which illustrate and explain different parts of that subject. The cases selected, with one exception, have been taken from the decisions of the Supreme Court of North Carolina. This course has its disadvantage, no doubt, in that perhaps a greater variety of fact and discussion might have been obtained by taking other American or English cases, but it has its advantage, in that it gives a connected view of the whole subject in one jurisdiction. It is not intended to give the law of one jurisdiction exclusively, for. It will be found that the principles of the Law of Contract are the same in all the States which have adopted the common law, and even the statutory changes are similar in many respects. While the student is learning the general law of the subject, he is, at the same time, becoming thoroughly familiar with the decisions of his own State, or of a court which has always met with the highest consideration. This court has been in existence for a cent ury, and almost every important question in the Law of Contracts has come before it in some form for discussion. Book excerpt: Excerpt from Selected Cases on the Law of Quasi-Contracts In 1888, Professor Ames, in his History of Assumpsit, said: The equitable principle which lies at the foundation of the great bulk of quasi-contracts, namely, that one person shall not unjustly enrich himself at the expense of another, has established itself very gradu ally in the Common Law. Indeed one seeks in vain to - day in the treatises upon the Law of Contract for an adequate account of the nature, importance and numerous applications of this principle. Later in the same, and in the next following year, Professor Keener published his Cases on the Law of quasi-contracts, and in 1893, his Treatise on the Law of quasi-contracts. In those pioneer works he segregated the rules of this branch of the law, and in his Treatise, which is a penetrating, critical analysis of the subject, delimited the field for subsequent workers. But the literature Of the subject is still comparatively meager, and therefore this collection of cases will, it is hoped, prove useful to the practicing lawyer as well as to law students.
