Available in PDF, EPUB and Kindle. Book excerpt: The passage of the Oil Pollution Act of 1990 (OPA 90) by Congress and subsequent modifications of international maritime regulations resulted in a far-reaching change in the design of tank vessels. Double-hull rather than single-hull tankers are now the industry standard, and nearly all ships in the world maritime oil transportation fleet are expected to have double hulls by about 2020. This book assesses the impact of the double hull and related provisions of OPA 90 on ship safety, protection of the marine environment, and the economic viability and operational makeup of the maritime oil transportation industry. The influence of international conventions on tank vessel design and operation is addressed. Owners and operators of domestic and international tank vessel fleets, shipyard operators, marine architects, classification societies, environmentalists, and state and federal regulators will find this book useful.

Book excerpt: One of the key goals of this legal treatise is to undertake a painstaking textual anatomy of the Oil Pollution Act of 1990 to help academics, lawyers, judges, and students navigate its recondite provisions with relative ease. This treatise consists of eighteen chapters. Chapter one discusses the scope of the Oil Pollution Act 1990. Chapter two analyzes the defenses to liability. Chapter three examines the procedures for asserting claims against a responsible party. Chapter four explores removal costs under OPA. Chapters five, six and seven dwell on issues relating to damages, recovery of interest, and limitation of liability respectively. Chapters eight and nine of this treatise focus on the effect of the Oil Pollution Act of 1990 on the insurance structure for oil pollution in US and international waters. The two chapters briefly discuss the financial responsibility requirements and the international oil pollution regimes as they relate to marine insurance. Chapter ten discusses contribution, indemnity and third part liability. Chapters eleven, twelve and thirteen examine the National Pollution Funds Center's Oil spill liability Trust funds, recovery by foreign claimants, as well as jurisdictional and procedural issues respectively. Chapters fourteen, fifteen, and sixteen comprehensively analyze the non-preemption clause, as well as the interaction between OPA and its predecessor statutes dealing with oil and other pollutants, as well as time limitations respectively. The overall analysis undertaken in this treatise would be helpful to governments at all levels (domestic & foreign), and also to the maritime & transportation, environmental, oil & gas, energy, insurance, banking & financial services, real estate, and hospitality industries. This treatise attempts an extensive textual analysis of the compensation and liability sub-chapter of the Oil Pollution Act of 1990 (OPA).This treatise also includes an extensive analysis of OPA jurisprudence and non-OPA jurisprudence construing pre-OPA statutes regulating oil and hazardous substance pollution. Its comprehensive analysis of non-OPA jurisprudence would provide guidance to academics, lawyers, judges, students and several business industries in their bid to construe the intricate provisions of the Oil Pollution Act of 1990.

This book was released on 2023-11-22 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: After the Exxon Valdez oil spill in 1989, advancing oil pollution research and technology to limit the environmental impacts of oil spills became a national and international priority. Congress responded by enacting the Oil Pollution Act of 1990 and forming the Interagency Coordinating Committee on Oil Pollution Research (ICCOPR) to coordinate research for preventing, planning for, responding to, and mitigating the effects of oil pollution on the environment. To achieve this end, ICCOPR published the oil pollution research and technology plan to guide research and funding priorities in 1992, with updates released over the years, most recently, the 2022-2027 Research and Technology Plan. This new report provides advice and guidance on the approach, structure, adequacy, and implementation of ICCOPR 2022-2027 Research and Technology Plan. Coordinated research efforts are necessary so knowledge and capacity related to oil spill prevention, preparedness, response, mitigation, and restoration can be advanced. Future updates of the plan should utilize a more streamlined, transparent, and community-driven development process including development of an oil pollution research dashboard and inclusion of metrics to assess and communicate progress on oil pollution research priorities. ICCOPR should also initiate processes to allow for open-water field trials when appropriate. The report recommendations were developed to assist ICCOPR with developing a Research and Technology Plan that can be widely used to promote progress, coordination, and collaboration on priority oil pollution research needs within the United States and globally - research needs that are important for improving knowledge, capacity, and regulations to safeguard the environment.

Book excerpt: The Subcommittee to Review Analyses of the Exxon Valdez Oil Spill (of the MMS OCS Policy Committee) wrote a report (approved May 23, 1990 by the Policy Committee) which included 24 recommendations to assist in developing a credible national oil spill prevention and response program for spills in the marine environment. The Committee then charged a new subcommittee, Oil Spill Recommendations Implementation Subcommittee, to present a report on implementing the recommendations of that earlier report. The Subcommittee details the Oil Pollution Act of 1990, for which the Exxon Valdez oil spill was the catalyst. The OCS Policy Committee approved this report on March 28, 1991.

Book Synopsis Spills of Diluted Bitumen from Pipelines by : National Academies of Sciences, Engineering, and Medicine
Download or read book Spills of Diluted Bitumen from Pipelines written by National Academies of Sciences, Engineering, and Medicine and published by National Academies Press. This book was released on 2016-03-22 with total page 167 pages. Available in PDF, EPUB and Kindle. Book excerpt: Diluted bitumen has been transported by pipeline in the United States for more than 40 years, with the amount increasing recently as a result of improved extraction technologies and resulting increases in production and exportation of Canadian diluted bitumen. The increased importation of Canadian diluted bitumen to the United States has strained the existing pipeline capacity and contributed to the expansion of pipeline mileage over the past 5 years. Although rising North American crude oil production has resulted in greater transport of crude oil by rail or tanker, oil pipelines continue to deliver the vast majority of crude oil supplies to U.S. refineries. Spills of Diluted Bitumen from Pipelines examines the current state of knowledge and identifies the relevant properties and characteristics of the transport, fate, and effects of diluted bitumen and commonly transported crude oils when spilled in the environment. This report assesses whether the differences between properties of diluted bitumen and those of other commonly transported crude oils warrant modifications to the regulations governing spill response plans and cleanup. Given the nature of pipeline operations, response planning, and the oil industry, the recommendations outlined in this study are broadly applicable to other modes of transportation as well.
