Book excerpt: While the state has extensive powers and duties in relation to state-funded education, independent schools largely sit outside that regime on condition that they meet prescribed standards. 'A Practical Guide to the Independent School Standards' introduces the standards from a rights-based perspective and explains their role in connection with registration and inspection of independent schools. Busy practitioners are signposted to the key guidance and regulations incorporated into the deceptively short standards. The parts of education law which do and do not apply to the independent sector are clearly identified. After outlining the standards and linking to relevant legislation and recent case law which helps with interpretation, this book shows how the standards can be applied to common issues affecting pupils such as SEND, mental health, peer-on-peer abuse, admissions and exclusions. The closing chapters consider the role of the standards when things go wrong whether it is a parent wishing to complain about a school, a school questioning the findings of a compliance inspection and/or responding to action by the regulator. Intended primarily for education lawyers, 'A Practical Guide to the Independent School Standards' will also be an invaluable accessible resource for independent schools, bursars, governors and trustees, and parents. ABOUT THE AUTHOR Sarah McKimm is a solicitor who, after a first career in commercial litigation, has been specialising in education law for over 20 years. In 2008 she became Principal Solicitor and later Deputy General Secretary for the Independent Schools Council. She was also until recently Head of Legal & Policy at the Independent Schools Inspectorate (ISI). This practical and accessible book introduces methods for the delivery of engaging Art and Design lessons that safely and meaningfully address the current key issues in the subject. Each chapter includes tasks to support trainee and early career teachers in implementing, reviewing and adapting their teaching. Book excerpt: A comprehensive, detailed and updated account of UK national security law in all its aspects, National Security Law, Procedure and Practice is the only book to collate and explain all the elements of law, both substantive and procedural, and the practical issues which may arise in national security litigation. The specialised nature of the subject makes this book a vital text, not only for those seeking an overview of national security law, but also for experienced practitioners instructed to act in proceedings in which national security issues may arise. The intense media and public scrutiny which accompanies many national security cases makes this book of interest to a wider audience seeking to understand the legal context of such cases. This new edition draws on the professional experience of a team of expert contributors and covers all recent legislation, case law and guidance. It provides a detailed explanation of the National Security Act 2023, which repeals and replaces the existing law relating to state threats. The new Act introduces significant new offences and executive powers, including the power to impose state threat prevention and investigation measures ('STPIMs'), and creates a new scheme for the registration of foreign political influence activities. The second edition also includes analysis of the landmark Supreme Court decision in Shamima Begum, which re-evaluates the respective roles of the government and the courts in national security matters and has ramifications throughout the work; a comprehensive explanation of the National Security and Investment Act 2021; a fully revised chapter on sanctions law; and an updated explanation of the continued impact of EU law on UK national security law. This second edition of National Security Law, Procedure and Practice will be an invaluable resource for judges, policymakers, legislators, oversight bodies, academic experts and students in a variety of legal fields.

Available in PDF, EPUB and Kindle. Book excerpt: A school exclusion is a sanction of last resort that can adversely impact a pupil's life outcomes for many years after the event. The law relating to school exclusions is a complex tangle of public and regulatory law, anti-discrimination and human rights, statutory guidance, and (in relation to independent schools) principles of commercial contract and tort. It can be very difficult to know where to start, whether challenging a decision to exclude or defending one. This book offers a practical guide to the law, and will serve as a useful source of reference for pupils and their parents, head teachers, governing boards of schools, local authorities and practitioners in this surprisingly complex and multidisciplinary area. ABOUT THE AUTHORS Charlotte Hadfield is the head of 3PB Barristers' (3 Paper Buildings) Education Team. She is a specialist in all areas of law related to education, including health, social care and employment law, and has a particular interest in exclusion and discrimination. She is listed in the Legal 500 and Chambers & Partners as a leading junior in education law. Charlotte's first introduction to education law was as a clerk for independent appeal (now review) panels. She represents excluded pupils, their parents, governing boards and local authorities before independent review panels, in the First-tier Tribunal and the County Court in claims for discrimination and breach of contract, and in the Administrative Court in judicial review proceedings. Charlotte has also appeared in education-related appeals before the Upper Tribunal and the Court of Appeal. Her clients appreciate her approachability, pragmatism and user-friendly advice in conference, and her knowledge, experience and attention to detail in hearings. Charlotte has delivered training on all aspects of education law to a variety of audiences, including parents, schools, local authorities, expert witnesses and lawyers. Alice de Coverley is a specialist education, equality, inquiries and public law barrister with 3PB Barristers (3 Paper Buildings). She regularly acts on behalf of children and young people, vulnerable adults, parents and carers, schools, local authorities, charities and NGOs, government departments including Ofsted, students, and universities. Alice has been challenging unlawful exclusion practices since she was at law school, when she was the Chief Director of the award-winning pro bono unit, the "School Exclusion Project". In 2012 the School Exclusion Project won the 'Bar Pro Bono Award'. In 2014 the School Exclusion Project was runner up in the Attorney General LawWorks Pro Bono Awards for 'Best Contribution by a Team of Students'. Alice has also helped to create a number of BBC Radio 4 programmes about school exclusions. She is also newly listed this year in both the Legal 500 and Chambers & Partners.
