Available in PDF, EPUB and Kindle. Book excerpt: Woodstock launched this project on lobbying in 1998 for three reasons. First, lobbying has grown exponentially during the past twenty years to exercise enormous influence on American politics. It has almost become a new profession in that time, and therefore deserves a new review and evaluation. Second, lobbying has simultaneously fallen under suspicion and engendered critical resentment in some quarters. Its critics would say it supports "special" (i.e. narrow and well-funded) interests and is oblivious to the general well-being of our democratic life and process. Third, reputable lobbyists have called, therefore, for a clarification of standards and principles for use within their own ranks and as an explanation to the general public of the goals, objectives, and methods of lobbying to forestall misunderstanding and misjudgment. This clarification would provide the lobbying profession with a normative statement parallel to the codes of conduct and ethical practice of the American Medical Association and the American Bar Association.

Book excerpt: Lobbyists and others who seek to participate in public policy activities through the formation of coalitions and associations whose members may not be identifiable, and the use of grassroots campaigns that attempt to mobilize citizens to advance the message of a lobbyist's client have raised concerns. Some lobbying activities have also been linked to campaign finance practices, congressional procedures regarding the acceptance of gifts from lobbyists, and the inclusion of earmarks advocated by lobbyists in appropriations legislation. Legislative proposals related to lobbying focus on six broad areas, including (1) enhanced requirements for electronic filing of lobbying reports and semiannual reports required under LDA; (2) redefinition of the term "client" under the stature; (3) more detailed disclosure by lobbyists of which groups and entities are funding coalitions and associations they represent; (4) more detailed disclosure by lobbyists of the individuals in Congress and the executive branch they contact; (5) congressional rules regarding the interactions of members and staff with lobbyists; (6) the Federal Election Campaing Act of 1971, as amended, as it relates to lobbying activities.

Available in PDF, EPUB and Kindle. Book excerpt: Money, Politics, and Campaign Finance Reform Law in the States presents an exciting examination of campaign finance reform and the role of money in state politics through the 2000 elections. Written by leading scholars on state politics and campaign finance reform, this book is the first to provide in-depth case studies that describe the reality of the impact money has on state politics; what efforts have been undertaken to regulate this money; and how successful the law has been in ensuring fair elections. Americans are deeply concerned about the role and impact of money upon politics and government. While numerous publications have documented Congressional efforts to enact campaign finance reform, this book puts the spotlight on state efforts to address the impact of money on politics. Money, Politics, and Campaign Finance Reform Law in the States offers the most comprehensive and up-to-date analysis of money and campaign finance reform at the state level on the market. Its findings will be invaluable to scholars, lawyers, legislators, and activists involved with campaign finance reform. "This book is a must-read for anyone who wants to understand the direction of politics in Illinois and in other states." -- Illinois Issues, November 2002 "Schultz does an excellent job in the introductory chapter of explaining the four preeminent Supreme Court decisions that frame the current debate on campaign finance reform at the federal and state level... This book will be of interest to students not just of money and campaign finance reform, but also to those interested in state politics, interest groups, and political parties." -- Election Law Journal, 2003 "[T]his book makes an important -- perhaps even unique -- contribution to an area of study that has received much less attention than the federal system." -- Guardian (COGEL), Spring 2004

Available in PDF, EPUB and Kindle. Book excerpt: Corporate Political Activities Deskbook provides a thorough grounding in the current state of the law on federal and state campaign finance, pay-to-play, lobbying, and gift compliance. It serves as a practical manual for in-house attorneys who advise corporations about involvement in the political process. After describing the impact of the U.S. Supreme Court decisions in Citizens United--that began the expansion of permitted corporate speech in the political realm--and McCutcheon v. FEC--that expanded the exemption further, the book examines thoroughly the Federal Election Campaign Act (FECA) requirements, federal lobbying and gift rules, the Foreign Agents Registration Act, and practice and appearances before the FEC. The Deskbook includes an overview of state lobbying, gift, placement agent rules and pay-to-play rules as well as the federal pay-to-play rules (MSRB Rule G-37, SEC Rule 206(4)-5 and FINRA's proposed pay-to-play rule).Appendices include model documents, such as sample PAC bylaws, a PAC contribution card, a resolution for establishing a PAC, as well as a summary chart of the corporate, PAC and individual contribution limits in each of the 50 states.Corporate Political Activities Deskbook provides practical examples of best practices and "dos and don'ts." In many cases, the suggestions go beyond the black letter requirements to incorporate advice that can help corporations utilize the available avenues of interacting with the government while avoiding negative press, and public as well as legal regulatory attention.
