Book excerpt: Excerpt from A History of English Law, Vol. 2 This volume and the following have been considerably altered, partially rewritten, and where necessary expanded. The second volume contains ninety more pages, and the third volume one hundred and sixty-three more pages than they contained in the first edition. During the thirteen years which have elapsed since the publication of the first edition, my knowledge of different parts of the subject has naturally increased, and I have become conscious of the inadequacy of my treatment of parts of the subject. It is for this reason that I have added introductions to Books II. and III., that I have added a new first chapter to the First Part of Book III., and that I have rearranged Chapters II. and IV. of that part. It is partly for the same reason that I have made very considerable alterations in all the chapters of Part II. of Book III. which is contained in Volume III. But these additions and alterations are due more particularly to the following reasons: Firstly, a good deal of very important new matter has been published since 1909, which has necessitated the rewriting of many parts of Volumes II. and III. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A History of English Law, Vol. 6 This volume concludes Part I of Book IV of this History. The sixth chapter, with which this volume opens, deals with the public law of the seventeenth century, and shows how, as the result of the constitutional conflicts of that century, our modern constitution and constitutional law have emerged. It is necessarily a long chapter, partly because the subject is intimately bound up with the general history of England, and partly because the events of that century have never before been treated from a purely legal point of view. The continuity of English history has given to seventeenth century constitutional history a very permanent influence upon the politics of later centuries, with the result that its history has too often been written from the point of view of those politics, and has reflected the political prepossessions of the writer. But, if we would understand the strength and weakness of the claims made by King and Parliament, we must approach the problem from that legal point of view which was adopted by both the contending parties in the seventeenth century. It is only in this way that we can do justice to these rival claimants to sovereignty. The seventh chapter carries on the history of the enacted law from the point at which it was left in the second chapter of this Book, and describes the modifications and additions made by the legislature between 1660 and 1700. The eighth chapter deals with the professional development of the law. It also is a long chapter. This is partly due to the fact that no history of this period in our legal history has ever been written before; and partly to the fact that in the legal world, as on other sides of our national life, modern conditions then decisively emerged. Book excerpt: Excerpt from A History of English Law, Vol. 11 In the first and introductory volume, which contains Book I of this History, I have related the history of the Judicial System down to the passing of the Judicature Act in 1875. In the eight succeeding volumes, which contain Books II-IV, I have described the sources and influences which shaped the development of English law down to 1700, and I have related both the history of English public law during the same period, and also the history of the principal doctrines of English private law, in some cases to 1700 and in others down to the nineteenth century. These three succeeding volumes begin Book V, the last Book of this History, in which I propose to relate the history of English law from 1700 to 1875. They begin Part I of this Book, and they relate the history of public law, and of the sources and influences which shaped the development of English law, during the eighteenth century. If I continue to have sufficient health and leisure, I hope in a succeeding volume to complete Part I of this Book, and in Part II to complete the History in two more volumes by giving some account of the history of those doctrines of English law with which I have not fully dealt in the preceding volumes. It may be thought that I have dealt with the legal history of the eighteenth century at too great a length. But there are several reasons why I have found it necessary to fill three bulky volumes. In the first place, this is the first complete legal history of the eighteenth century which has ever been written. In the second place, to make that history intelligible it has been necessary to deal somewhat more fully than in the preceding periods with the political background. Book excerpt: Excerpt from A History of English Law, Vol. 1 The first volume was begun in 1901, and the second and third volumes were finished in 1909. From 1909 to 1921 I have been writing the history of the law from 1485 onwards. I have, therefore, been engaged upon this History of English Law for twenty years; and necessarily both the material available for the study of the subject and my own knowledge have, in the course of that time, increased considerably. For both these reasons it has become clear to me that the first volume in its original form is quite inadequate, and that the second and third volumes need revision to bring them up to date. It has also become clear to me, as the work on the later volumes progressed, that the earlier volumes need revision in order that the whole work may form a complete and co-ordinated whole. Therefore, simultaneously with my work on the later volumes, I have been en aged on the work of the revision and co-ordination of t e earlier volumes. The first volume is a new book; and the second and third have been considerably added to and altered. The result' is a continuous History of English Law as a whole down. To 1700, and, in respect to some parts of the subject, down to modern times. The mode of treatment appears from the Plan of the History which will be printed at the begin ning of each of the volumes. Book excerpt: Excerpt from Outlines of English Legal History A year ago it became my duty as one of the Readers to the Council of Legal Education, to deliver, at short notice, a course of lectures on Royal Justice in this country. The information which had to be gathered from many books, some out of print, others of great price, few to be found except in great libraries, I now place at the disposal of those who take, at the least, a passing interest in the subject. Inaccuracies and inelegancies I am sure that I have not entirely avoided. If on some points I have spoken without certainty, it should be remembered that our information is not yet, and may never be, complete. On some topics, such as the Justices of the Forest and of the Jews, I have chosen to be silent and await the promised records of the Selden Society. I desire here to acknowledge my great debt to the Rolls Series, the Acts of the Privy Council, and the invaluable volumes of the Selden Society. To none of the learned editors of that Series do I owe more than to Professor Maitland, to whom all scholars must wish complete restoration to health, and whose unwearied energy has illumined so many dark places of the law. Cantor, Inventing the Middle Ages 66. Originally published: Cambridge: Cambridge University Press, 1898. 2 vols. xxxviii, 688; xiv, 691 pp. Reprint of the second and best edition. The History of English Law was the first systematic history based on modern historical methods. It addresses the period before the Norman Conquest in 1066, but deals primarily with the creation and establishment of the common law, a process initiated in the reign of Henry II (1154-1189) and concluded in the reign of Edward I (1272-1307). The first volume traces this history. The second volume treats the doctrines of the common law, including tenure, the law of personal condition, status and estate, and the jurisdiction and communities of the land. Gracefully written and enriched with countless references this is an essential book. First published in 1895, it remains a primary text for students of legal history and the social history of medieval England.

Book excerpt: Excerpt from A Short History of English Law: From the Earliest Times to the End of the Year 1911 It seemed, therefore, to the author, that the time arrived, at which Messrs. Methuen 8: Co.'s original be realized; and he ventured to approach them with a sugges tion for a revival of the plan. It was, of course, obviously due to Dr. Holdsworth that his concurrence should also be obtained. In both quarters the response was prompt and cordial; and Dr. Holdsworth, with great generosity, further offered to read the proof sheets of the intended work, and give the author the benefit of his criticism. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A History of English Law, Vol. 9 In this last volume of my History the history of Status is carried on from the point at which it was left in the fourth chapter of the preceding Book; the early history of the law of Evidence is related; and the history of the law of Procedure and Pleading, both at common law and in equity, down to the statutory reforms of the last century, is completed. These nine volumes contain a history of the sources and general development of English law down to 1700; and a history of the judicial system, and of very many of the principles and rules of the English common law, down to modern times. It is, therefore, not quite a complete history. There still remains to be related the history of the sources and general development of English law during the eighteenth and nineteenth centuries; the history of substantive rules of equity, which became the definite system which we know to-day during those centuries; the history of some parts of the common law - notably mercantile law, maritime law, and the law of evidence - which then assumed their modern form; and the history of certain other branches of law - such as ecclesiastical law, prize law, and international law - which fall within the sphere of the civilian's practice. To complete the history as it ought to be completed will be a long task; but I hope to be able to accomplish at least some part of it in the next few years; and I am the more encouraged to begin this final portion of my task by the manner in which these volumes have been received.
