But such a vacancy occurring or existing otherwise than by expiration of term, while the Senate is not in session, shall be filled by the Governor for a term which shall expire at the end of twenty days from the commencement of the next meeting of the Senate. (Public Officers' Law, ch. 681, Laws 1892, 28, as amended by Laws 1893, ch. 318, and Laws 1898, ch. 655, in effect January 1,1899.) Prior to the amendment of 1898, the Governor could fill any vacancy which occurred or existed when the Senate was not in session, the term to expire at the end of twenty days after the Senate convened. After the 1st day of January, 1899, the Governor has power, during a recess of the Senate, to fill only vacancies which occur or exist otherwise than by expiration of term. All vacancies, therefore, in the office of Notary Public which exist or occur on and after January 1, 1899, by reason of the expiration of the term for which the Notary was appointed, cannot be filled by the Governor while the Senate is not in session, as this power seems to be taken away by implication by Laws 1898, ch. 655. Only vacancies occasioned by death, resignation, removal, or disability, it would seem, can be filled by the Governor while the Senate is not in session. The statute covers not only the office of Notary Public, but any office of an officer appointed by the Governor by and with the advice and consent of the Senate. 10. The first statute creating the Office was in 1823. Up to 1859, the duties of a notary -consisted of drawing and copying protests on promissory notes or bills of exchange drawing and copying of affidavits. In 1859, their powers were broadened by allowing them to administer oaths and affirmations and to take proof and acknowledgmentof deeds, mortgages and other papers. Their term was for two years from the date of appointment. In 1869, a rule was adopted whereby the term of all notaries commenced on March 3lst, and ended March 30th, two years thereafter.
