In the present case it is not disputed that by the first paragraph of the will the widow took title to all the personal estate. If there were nothing as to the real estate except what is said in the second paragraph, a different question might be presented; but there was something more in the fourth paragraph, which it is agreed had to do only with the real estate. The testator was at pains to define in his own way "the true intent" of the devise to his wife, viz: that if she "terminate limitation as aforesaid, the estate shall go share and share alike among and between my children and wife," There is no dispute that by these words the testator meant to apportion the real property in the event that the prior estate given to the wife should be "terminated" by her own act of remarriage. True, that gift was coupled with no words of inheritance or of perpetuity necessary to pass title to lands at common law; but it is familiar knowledge that by the express terms of our statute none were nedeed. Act 8th April, 1833, P. L. 250, 9, reenacted by the wills act of 1917. "Unless it appear by a devise over, or by words of limitation, or otherwise, in the will, that the testator intended to devise a less estate," says the statute, all devises of real estate shall pass in its entirety whatever title testator had therein. Hence, the inference would seem to be unavoidable of an intent to pass the fee where, as in this case, the only limitation is one 'contingent on the voluntary act of the widow and which must take effect, if at all, in her lifetime.
