Book excerpt: This book aims at contributing to address some of the challenge that developing countries, especially the least-developing countries, face in the design of trade in service policies and to provide governments with tools to better incorporate services in their export strategies, including negotiations and cooperation with trading partners, and unilateral reforms. This book helps to identify key policy challenges faced by developing country trade negotiators, regulatory policy officials and/or service suppliers. Management of both policy reforms and trade agreements requires investments in sounder regulatory regimes and the establishment of enforcement mechanisms to help countries gradually opening and mitigate any potential downside risks. A successful strategy requires a proper sequencing that through an orderly and transparent process allows to prepare for greater competition. Developing countries face serious resource and administrative constraints to adequately negotiate multiple services agreements that serve their trade interest. For many developing countries, the administrative burden of handling and negotiating multiple trade agreements has become a serious concern and this can hamper their opportunities to obtain adequate market access for their services exports. The book develops in detail the methodological framework for the construction of a database and the core elements that will comprise it, to help countries to organize and manage their services commitments. Little attention has been devoted to the organization/preparation and the development, assessment and conclusion of the negotiation process. The book presents a simulation exercise designed for policymakers, trade negotiators, and trade practitioners working in the area of services. This exercise will help them to better understand the preparatory and negotiating stages of the process leading to liberalization of trade in services.

The introduction notes that judging by the experience of Cancun (2003) and the recent Hong Kong Ministerial (2005), developing countries are fast emerging as quick learners of the rules of the game, but need to sharpen those skills further: "It is quite prudent to understand that hidden from public glare, both the battle and the war will now continue in Geneva, which is less of a free trade bastion than Hong Kong. It is by now a time-honoured fact that the intensity of liberalisation undertaken at home makes handling the WTO-induced reforms easier, and the priorities for Indian policy makers are therefore, obvious. Notwithstanding the WTO objective, even eleven years after the inception of the multilateral body, the trade barriers, both in developed and developing countries are quite significant and unilateral liberalisation is not easily forthcoming. Although this lack of market access hurt the developing countries much more severely than their developed counterparts, the former group never systematically bargained at the negotiating table with the latter before the Doha Ministerial (2001). Looking at the negotiating strategies of India and several other WTO members over the years, the nine papers in this volume explore the current negotiating scenario and the concerns for India and other developing countries. Book excerpt: The scheduling approach constitutes a key element of services trade agreements as it is the means to pursue liberalization. This paper provides an overview of the scheduling approaches adopted in 187 trade agreements notified under GATS Article V as of 30 April 2022, analyses the differences between the positive and negative list approaches, and discusses their implications for negotiation strategies and trade policies. Theoretically, both positive and negative list approaches can achieve high level of liberalization as long as governments are willing to open market. We however note in this paper that the scheduling approach is not a stand-alone technique. Rather, it is associated with the design and legal structure of a services trade agreement as well as different core obligations. In addition, establishing a positive or a negative list usually entails different negotiation dynamics and internal consultation processes. With FTAs as important trade policy instruments fast evolving and deepening, governments are becoming more flexible and more "innovative" in their use of scheduling approaches, including creating different hybrid patterns to accommodate their sensitivities in certain sectors, supplementing the positive list with a standstill requirement, or allowing transition from the positive list to the negative list. Governments' practices in FTAs would be inspiring for future services trade negotiations, be it bilateral, plurilateral, or multilateral.

Even though trade negotiations for enhanced Mode 4 access started well before the launch of the DDA- prospects for success are thin. These negotiations followed a traditional mercantilist approach- with limited attention to the underlying difficulties countries face in letting people into their borders, either generally, or on the basis of a WTO GATS commitment. This Book argues that this approach alone will not succeed. It proposes a focus not on trading market access concessions only, but on discussions aimed at understanding each other's regulatory approaches. To date, in terms of the literature available, we know very little about how WTO Members are managing their Mode 4 commitments. We know even less about how the WTO could learn from clearly more advanced steps in regional liberalization processes.
