Available in PDF, EPUB and Kindle. Book excerpt: This book provides a thorough introduction to Roman property law by means of "cases," consisting of brief excerpts from Roman juristic sources in the original Latin with accompanying English translations. The cases are selected and grouped so as to provide an overview of each topic and an orderly exposition of its parts. To each case is attached a set of questions that invite the reader to, e.g., clarify ambiguities in the jurist's argument, reconcile one holding with another, supply missing but necessary facts to account for the holding, and/or engage in other analytical activities. The casebook also illustrates the survival and adaptation of elements of Roman property law in the modern European civil codes, especially the three most influential of those codes: the General Civil Code of Austria (Allgemeines Bürgerliches Gesetzbuch), the German Civil Code (Bürgerliches Gesetzbuch), and the Civil Code of Switzerland (Zivilgesetzbuch). All code excerpts are accompanied by English translations. By comparing and contrasting how the codes have adopted, adapted, or rejected an underlying Roman rule or concept, it is possible for the reader to observe the dynamic character and continuing life of the Roman legal tradition. To facilitate comparison with corresponding rules and concepts in the English common law tradition, additional texts and questions prepared by the translator will be mounted on an accompanying website, www.oup.com/us/romanpropertylaw.

Book excerpt: Excerpt from Roman Water Law: Translated From the Pandects of Justinian 1. The Common Law and the Civil Law. The United States inherited from Europe two great systems of jurisprudence - one the Common Law and the other the Civil Law. The eastern part of the territory of the United States began with the Common Law. The territory west of the Mississippi inherited the Civil Law through the prior sovereignty of either Spain or France or both. The Common Law has invaded most of the area of the Western states, formerly subject to the Civil Law, yet there are many great questions of both title and right still dependent there for settlement upon the rules of the Civil Law. Among the great questions thus dependent is the law of water. The history of the Civil Law, as applicable to such questions, is derived from - First, The Roman Law. Second, The Spanish Law as derived from the Roman Law. Third, The French Law as derived from the Roman Law. Fourth, The Mexican Law as derived from the Spanish Law. Available in PDF, EPUB and Kindle. Book excerpt: Roman contract law has profoundly influenced subsequent legal systems throughout the world, but is inarguably an important subject in its own right. This casebook introduces students to the rich body of Roman law concerning contracts between private individuals. In order to bring out the intricacy of Roman contract law, the casebook employs the case-law method--actual Roman texts, drawn from Justinian's Digest and other sources, are presented both in Latin and English, along with introductions and discussions that fill out the background of the cases and explore related legal issues. This method reflects the casuistic practices of the jurists themselves: concentrating on the fact-rich environment in which contracts are made and enforced, while never losing sight of the broader principles upon which the jurists constructed the law. The casebook concentrates especially on stipulation and sale, which are particularly well represented in surviving sources. Beyond these and other standard contracts, the book also has chapters on the capacity to contract, the creation of third-party rights and duties, and the main forms of unjustified enrichment. What students can hope to learn from this casebook is not only the general outlines and details of Roman contract law, but also how the jurists developed such law out of rudimentary civil procedures. An online teacher's manual is available for instructors; to access it, see page xxi of the Casebook.

Available in PDF, EPUB and Kindle. Book excerpt: "Gardens and Neighbors will provide an important building block in the growing body of literature on the ways that Roman law, Roman society, and the economic concerns of the Romans jointly functioned in the real world." ---Michael Peachin, New York University As is increasingly true today, fresh water in ancient Italy was a limited resource, made all the more precious by the Roman world's reliance on agriculture as its primary source of wealth. From estate to estate, the availability of water varied, in many cases forcing farmers in need of access to resort to the law. In Gardens and Neighbors: Private Water Rights in Roman Italy, Cynthia Bannon explores the uses of the law in controlling local water supplies. She investigates numerous issues critical to rural communities and the Roman economy. Her examination of the relationship between farmers and the land helps draw out an understanding of Roman attitudes toward the exploitation and conservation of natural resources and builds an understanding of law in daily Roman life. An editor of the series Law and Society in the Ancient World, Cynthia Jordan Bannon is also Associate Professor of Classical Studies at Indiana University, Bloomington. Her previous book was The Brothers of Romulus: Fraternal Pietas in Roman Law, Literature, and Society (1997). Visit the author's website: http://www.iub.edu/~classics/faculty/bannon.shtml. Available in PDF, EPUB and Kindle. Book excerpt: Roman law as a field of study is rapidly evolving to reflect new perspectives and approaches in research. Scholars who work on the subject are increasingly being asked to conduct research in an interdisciplinary manner whereby Roman law is not merely seen as a set of abstract concepts devoid of any background, but as a body of law which operated in a specific social, economic and cultural context. This context-based, 'law and society' approach to the study of Roman law is an exciting new field which legal historians must address. This interdisciplinary collection focuses on three larger themes which have emerged from these studies: Roman legal thought the interaction between legal theory and legal practice and the relationship between law and economics.
