Available in PDF, EPUB and Kindle. Book excerpt: As a fundamental institution of human societies, law is a deeply influential factor in individual and social activity. Yet its normative status is controversial, particularly in pluralistic, secularized societies. Is law essentially the result of legislative creation and juridical interpretation, or can and should it reflect ethical values and imperatives? If it can what are the sources of those imperatives, and how do they achieve the necessary degree of social consensus in religiously diverse societies that are increasingly globalized and globalizing as a consequence of culture, commerce, communication and immigration? The Global Ethic and Law: Intersections and Interactions contributes to the consideration of these questions. Its contributors include academics from the U.S.A. and Europe, as well Hans Kueng, the author of the 1993 “Declaration Towards a Global Ethic” adopted by the Parliament of World Religions and Stephan Schlensog, General Secretary of the Global Ethic Foundation of Tuebingen, Germany.

Book excerpt: To the consternation of the haves, some humans continue to insist that they are entitled to live as humans. While it is perhaps a question of philosophy what constitutes a human right, it is more clear what constitutes an abuse of human rights. The world has never been short on abusers and is surely not now. Only the names and faces have changed over time. The powerful tend to be the abusers and the weak the abused. Being aware of the abuses can at least focus light on them and perhaps serve as a proactive response. This bibliography presents hundreds of citations of human right violations under the categories: Basic Human Rights; North America; Latin America; Europe; Asia; Middle East and Africa. Access is provided via Title, Author and Subject Indexes.

This volume explores the very topical issue of the lack of democratic legitimisation of national and international courts and the question of whether rendering the original process of defining human rights more democratic at the national and international level would improve the degree of protection they afford. The authors venture to raise the crucial question: When can a democratic society be considered to be mature enough so as to be trusted to provide its own definition of human rights obligations?

Book excerpt: In September 2018 the criminal law section of the 72nd Deutscher Juristentag (DJT, “German Assembly of Jurists”) debated the question “Sentencing Guidelines vs. Free Judicial Discretion – Is German Sentencing Law in Need of Reform?” Despite the expert opinion provided by Johannes Kaspar and the accompanying scholarly commentaries, ensuing proposals for fundamental reform met with rejection. The comparative perspective was limited to the US Federal sentencing guidelines. The intention of this volume is therefore, on the one hand, to draw a more nuanced picture of Anglo-American sentencing law focusing on three legal systems (England/Wales, USA and Canada) accompanied by commentaries from a German perspective; on the other hand, we want to make the German perspective (better) known within the Anglo-American legal world by reproducing important DJT documents in English language. To ensure the widest possible distribution we opted for a bilingual open access publication.

Available in PDF, EPUB and Kindle. Book excerpt: The United Nations General Assembly and the Human Rights Council recognised the human right to water in 2010. This formal recognition has put the issue high on the international agenda, but by itself leaves many questions unanswered. This book addresses this gap and clarifies the legal status and meaning of the right to water through a detailed analysis of its legal foundations, legal nature, normative content and corresponding State obligations. The human right to water has wide-ranging implications for the distribution of water. Examining these implications requires putting the right to water into the broader context of different water uses and analysing the linkages and competition with other human rights that depend on water for their realisation. Water allocation is a highly political issue reflecting societal power relations, with current priorities often benefitting the well-off and powerful. Human rights, in contrast, require prioritising the most basic needs of all people. The human right to water has the potential to address these underlying structural causes of the lack of access to water rooted in inequalities and poverty by empowering people to hold the State accountable to live up to its human rights obligations and to demand that their basic needs are met with priority.
