Although this conception has been challenged in recent years, it has not been completely dispelled. In Colour-Coded, Constance Backhouse illustrates the tenacious hold that white supremacy had on our legal system in the first half of this century, and underscores the damaging legacy of inequality that continues today. Backhouse presents detailed narratives of six court cases, each giving evidence of blatant racism created and enforced through law. The cases focus on Aboriginal, Inuit, Chinese-Canadian, and African-Canadian individuals, taking us from the criminal prosecution of traditional Aboriginal dance to the trial of members of the 'Ku Klux Klan of Kanada.' Book excerpt: Stranger Citizens examines how foreign migrants who resided in the United States gave shape to citizenship in the decades after American independence in 1783. During this formative time, lawmakers attempted to shape citizenship and the place of immigrants in the new nation, while granting the national government new powers such as deportation. John McNelis O'Keefe argues that despite the challenges of public and official hostility that they faced in the late 1700s and early 1800s, migrant groups worked through lobbying, engagement with government officials, and public protest to create forms of citizenship that worked for them. This push was made not only by white men immigrating from Europe; immigrants of color were able to secure footholds of rights and citizenship, while migrant women asserted legal independence, challenging traditional notions of women's subordination. Stranger Citizens emphasizes the making of citizenship from the perspectives of migrants themselves, and demonstrates the rich varieties and understandings of citizenship and personhood exercised by foreign migrants and refugees. O'Keefe boldly reverses the top-down model wherein citizenship was constructed only by political leaders and the courts. Indigenous law, however, has continuing relevance for both Aboriginal peoples and the Canadian state. In his in-depth examination of the continued existence and application of Indigenous legal values, John Borrows suggests how First Nations laws could be applied by Canadian courts, and tempers this by pointing out the many difficulties that would occur if the courts attempted to follow such an approach. By contrasting and comparing Aboriginal stories and Canadian case law, and interweaving political commentary, Borrows argues that there is a better way to constitute Aboriginal / Crown relations in Canada. He suggests that the application of Indigenous legal perspectives to a broad spectrum of issues that confront us as humans will help Canada recover from its colonial past, and help Indigenous people recover their country. Borrows concludes by demonstrating how Indigenous peoples' law could be more fully and consciously integrated with Canadian law to produce a society where two world views can co-exist and a different vision of the Canadian constitution and citizenship can be created.
