Book excerpt: It is estimated that at any one time 4,500 EU nationals are held in custody in countries other than their normal place of residence. As they are less likely to be granted bail (because of a greater perceived of absconsions) the Commission has proposed a European supervision order (ESO), which would mean that authorities in a person's home State would also be responsible for returning them for trial. This report examines the proposal in detail and makes some recommendations for improvement. The Committee welcome the proposal and think it deserves prompt attention by Member States.

Book excerpt: Government failure is affecting everyone. The single mum worried sick by a tax credit demand from HMRC to 'repay' thousands of pounds she never received; the family whose holiday was ruined because the Passport Office couldn't issue passports in time; the school that couldn't open at the start of term because CRB checks were being carried out by an organisation in meltdown; the farmers led to bankruptcy and even suicide by a Kafkaesque system for administering farm payments; and rail operators facing an uncertain future because the Department for Transport inadvertently landed the whole rail franchising system in chaos. Why is government getting it so wrong? Richard Bacon and Christopher Hope delve into the astonishing world of cock-ups and catastrophes and ponder why those at the top continue to fall short.

Book excerpt: The relationship between the European Union and Russia has been going through a difficult phase with disputes over energy supplies, foreign policy issues, and tension between Russia and individual Member States. The change of presidency in Russia provides an opportunity to take stock and to consider whether this deterioration can and should be reversed. Russian politicians emphasise the importance of the relationship. This report discusses how the relationship might be developed in practice. The report examines Russia as a European country, its recent history, and the current economic situation in Russia. It then considers the institutional framework for Russia-EU relations, including the Partnership and Co-operation Agreement. The Committee believes closer co-operation should be fostered in several areas of common interest: economic, freedom, security and justice, research and education and culture. Energy is an important subject: there are concerns about whether Russia can supply sufficient gas and oil to meet its current and foreseeable domestic demand and international commitments. The security of energy supply to the EU is vital. The Russian view of international security issues is also very different from that of the West, and developments in the near neighbourhood of Russia are a very sensitive geopolitical area. Russian support for Serbia is contrasted with their co-operation on Iran. The two sides work together usefully on the Middle East, terrorism, non-proliferation, and other issues. The EU should continue and strengthen its efforts to reach common ground with the Russians on such international issues, but should also speak out if the Russian government falls short of the standards it has formally accepted in a number of international agreements.

This book was released on 2008-03-06 with total page 92 pages. Available in PDF, EPUB and Kindle. Book excerpt: The 2003 reform of the Common Agricultural Policy marked the culmination of a gradual reorientation of EU farm subsidies from product support to direct income support. A mid-term "Health Check" of this reform is now underway, exploring what further adjustments may be required for the period 2009 to 2013. The Commission's proposals for short-term adjustments to the CAP merit broad support. The Committee is not convinced of the long-term justification for maintaining direct subsidy payments in their present form, and advocates a phased reduction in direct payments over the course of the next financial period beginning in 2014. A significant proportion of the funds released should remain earmarked for the CAP, but be spent on the rural development element of the policy rather than on farm subsidies. The report also addresses the challenges and opportunities that lie ahead for the EU agriculture industry. The sector is a significant contributor to climate change, but also vulnerable to its effects. Climate change may present a business opportunity for the industry, which is uniquely placed to deliver environmental services. Soaring global demand for many agricultural commodities has allowed some sectors of the European farming industry to prosper, while others are grappling with rising input prices and stagnant or falling output prices. Were supply shortages to ensue in future, the Committee expects that food scarcity would be a function of income rather than of production capacity. Those most at risk are consumers on low incomes in the developing world. Further trade liberalisation in the agriculture sector is supported, but if direct payments are withdrawn and import tariffs reduced-as the UK Government advocates-then the production standards that EU producers of agricultural goods are obliged to meet should be re-examined.

Book excerpt: This progress report presents evidence taken by the Committee during the summer recess on the draft EU Reform Treaty on which negotiations have been proceeding in the Inter Governmental Conference (IGC), as well as correspondence raising questions with the Minister for Europe. The Committee sets out its plan for further in depth analysis of the impact of the reform Treaty on the UK and discusses specific questions of the role of national parliaments. The report notes the tight mandate given to the IGC has had the effect that its work has been largely technical and asks the Government to report to the House on the impact of this procedure.

Available in PDF, EPUB and Kindle. Book excerpt: This book addresses how institutional and diplomatic rituals shaped the European Union’s sanction of Hamas after the latter’s success in the 2006 Palestinian legislative elections. Through a lens of performance and performativity it explains how socialisation and the duress of performative rituals shapes agency and prevents the possibility of being creative with policy initiatives when confronted with difficult decisions. Interviews with senior Hamas representatives, EU bureaucrats, members of the European External Action Service, and electoral observers from Palestine and Europe, in addition to ethnographic research in Gaza and in Brussels, recreate the details of the failed diplomacy between Hamas and the EU. The book explores the social and visual cultures and discourses that shape the recognition of contemporary subjects, and it presents Hamas’s response to being treated as a terrorist movement. It advances queer and postcolonial understandings of European-Palestinian political encounter by interrogating the bureaucratic and professional pressures that shape the political agency of EU civil servants and the recognition of Palestinian politics. This is a performative and interdisciplinary text; it juxtaposes empirical investigation, with critical theory, performance art and everyday experiences. It will appeal to students of International Relations, Interdisciplinary Studies, Middle-East Area Studies, Foreign Policy and Diplomacy Analysis and Gender Studies.

This book was released on 2011-04-11 with total page 339 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Human Right to Water and Its Application in the Occupied Palestinian Territories provides an overview and examination of the human right to water as determined under international human rights law. This is a highly topical issue, with the UN General Assembly having passed a resolution which declares access to clean water and sanitation a human right (New York, Jul 28 2010), the recent appointment of the UN Independent Expert on the issue of human rights obligations related to access to safe drinking water and sanitation, and movement within the NGO community for an international water treaty. Amanda Cahill Ripley analyses the current legal status, substantive content, and obligations correlative to the right, and examines the relationship between other economic, social and cultural rights related to the right to water. The book goes on to look more specifically at the application of the human right to water in the Occupied Palestinian Territories. Using innovative methodology, Cahill Ripley combines legal analysis with a qualitative social science empirical case study to explore the enjoyment of the right ‘on the ground’. The wider implications of the case study findings are then considered, looking at what can be done to strengthen the right legally in terms of its status and codification, and what remedy can be found for violations of the right, both specifically in the Occupied Palestinian Territories and in a more general context. The book will be of interest to students, academics and practitioners within the fields of international human rights law and international humanitarian law, as well as those concerned with international relations and conflict resolution within Israel/Palestine and the wider Middle East region.

Book excerpt: Timeshare is popular, especially amongst UK consumers, but the sector has often caused problems. The European Communities removed many of the worst excesses with its 1994 Directive, which introduced a right of withdrawal, a cooling-off period, and a ban on advance payments during the cooling-off period. However there are loopholes that have been exploited by the unscrupulous and complaints about long term holiday clubs have grown dramatically. The Commission is seeking to address these problems with proposals for a broader directive. This report considers that directive's strengths and weaknesses.

Available in PDF, EPUB and Kindle. Book excerpt: Criminal law can no longer be neatly categorised as the product and responsibility of domestic law. That this is true is emphasised by the ever-increasing amount of legislation stemming from the European Union (EU) which impacts, both directly and indirectly, on the criminal law. The involvement of the EU institutions in the substantive criminal laws of its Member States is of considerable legal and political significance. This book deals with the emerging EU framework for creating, harmonising and ensuring the application of EU criminal law. This book aims to highlight some of the consequences of EU involvement in the criminal law by examining the provisions which have been adopted in the field of information and communications technology. It provides an overview of the criminal law competence of the EU and evaluates the impact of these developments on the criminal laws of the Member States. It then goes on to consider the EU legislation which requires Member States to regulate matters such as data protection, e-security, intellectual property and various types of illegal content through the criminal law is analysed. In the course of this evaluation, particular consideration is given to issues such as the basis on which the EU institutions establish the need for criminal sanctions, the liability of service providers and the extent to which the Member States have adhered to, or departed from, the legislation in the course of implementation.
