This book was released on 2012-12 with total page 884 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Manual for Courts-Martial (MCM), United States (2012 Edition) updates the MCM (2008 Edition). It is a complete reprinting and incorporates the MCM (2008 Edition), including all amendments to the Rules for Courts-Martial, Military Rules of Evidence (Mil. R. Evid.), and Punitive Articles made by the President in Executive Orders (EO) from 1984 to present, and specifically including EO 13468 (24 July 2008); EO 13552 (31 August 2010); and EO 13593 (13 December 2011). See Appendix 25. This edition also contains amendments to the Uniform Code of Military Justice (UCMJ) made by the National Defense Authorization Acts for Fiscal Years 2009 through 2012. Some of the significant changes are summarized and listed below. This summary is for quick reference only and should not be relied upon or cited by practitioners in lieu of the actual provisions of the MCM that have been amended. The MCM (2012 Edition) includes unique changes warranting attention. Discussion has been added or amended to address changes in practice resulting from United States v. Campbell, 71 M.J. 19 (C.A.A.F. 2012); United States v. Fosler, 70 M.J. 225 (C.A.A.F. 2011); and United States v. Jones, 68 M.J. 465 (C.A.A.F. 2010). See R.C.M. 307(c)(3); R.C.M. 307(c)(4); R.C.M. 906(b)(12); R.C.M. 907(b)(3)(B); R.C.M. 910(a)(1); R.C.M. 918(a)(1); R.C.M. 1003(c)(1)(C); and in Part IV of this Manual, paragraph 3b, paragraph 60c(6)(a), and the discussion at page IV-1. The Discussion added in 2012 was a short-term solution intended to address recent, broad changes in the law. Although it may describe legal requirements derived from other sources, the Discussion does not have the force of law. It is in the nature of a treatise, and may be used as secondary authority. The Discussion will be revised from time to time as warranted by changes in applicable law. See Composition of the Manual for Courts-Martial in Appendix 21 of this Manual. Practitioners are advised that the Mil. R. Evid. will be amended after the publication of this Manual and will take effect only after the President signs the relevant EO. Once approved, the revised Mil. R. Evid. will exist outside of this Manual until its next complete reprinting. Practitioners are also advised that Article 120 has been amended by the National Defense Authorization Act for Fiscal Year 2012, Public Law 112-81, 31 December 2011. The amended version of Article 120 creates three separate sexual offense statutes: Article 120 for adult offenses; Article 120b for child offenses; and Article 120c for other sexual offenses. Article 120a remains unchanged. As of 2012, there are now three versions of Article 120, and each version is located in a different part of this Manual. For offenses committed prior to 1 October 2007, the relevant sexual offense provisions are contained in Appendix 27. For offenses committed during the period 1 October 2007 through 27 June 2012, the relevant sexual offense provisions are contained in Appendix 28. For offenses committed on or after 28 June 2012, the relevant sexual offense provisions are contained in Part IV of this Manual (Articles 120, 120b, and 120c).

Book excerpt: "Addresses fascinating aspects of obtaining justice in Florida: both historical court systems before Florida became a state and alternative courts operating within Florida now. Anyone with an interest in the diversity of Florida's legal past and present will find this book invaluable."--Mary E. Adkins, author of Making Modern Florida: How the Spirit of Reform Shaped a New State Constitution Pushing past the standard federal-state narrative, the essays in Florida's Other Courts examine eight little-known Florida courts. In doing so, they fill a longstanding gap in the state's legal literature. In part one, the contributors profile Florida's courts under the Spanish and British empires and during its existence as a U.S. territory and a member of the Confederate States of America. In part two, they describe four modern-era courts: those governing military personnel stationed in Florida; adherents of specific religious faiths in Florida; residents of Miami's black neighborhoods during the waning days of Jim Crow segregation; and members of the Miccosukee and Seminole Indian tribes. Including extensive notes, a detailed index, and a complete table of cases, this volume offers a new and compelling look at the development of justice in Florida.

Available in PDF, EPUB and Kindle. Book excerpt: This book provides an in-depth analysis of sexual assault in the military from historical and contemporary perspectives, offering suggestions that could change the existing culture and approaches that will reduce or eliminate sexual assault in the armed forces. Sexual assault has been an aspect of the U.S. military historically and is today widely recognized as a significant problem with far-reaching repercussions. How does sexual assault negatively impact not only the victims themselves but also the U.S. military's strength, readiness, and morale? This book answers these questions and documents the problems with reporting and prosecuting sexual assault complaints within our armed forces, examines the current policy and laws to identify what changes are needed, and analyzes recent efforts to prevent sexual assault. Author Rosemarie Skaine introduces the subject with a historical perspective that covers women, men, gays and lesbians, and non-military personnel as the subjects of sexual assault and provides readers with clear definitions of sexual harassment and sexual assault. The chapters explain how sexual assault negatively affects the military's performance as a whole, thereby serving to undermine national security; and covers preventative approaches and legislation intended to change the current military culture. The book also includes a bibliography, tables of key figures, and footnotes and endnotes that fully document the data presented.

The text covers the jurisdiction of courts-martial; sources of military law; military offenses and defenses; pre-trial, trial, and appellate procedures; the role of judge advocates; non-judicial punishment and other alternatives to courts-martial; special forums such as boards of inquiry and military commissions for trying enemy belligerents; the relationship of courts-martial to state and federal courts; and much more. All chapters include policy questions about currently controversial issues. The text is appropriate for all students, whether or not they have had prior military experience. The Second Edition includes five new cases and addresses new legislation concerning special victims counsel; preliminary hearings; the role of commanders in referring and reviewing charges; mandatory minimum sentences for conviction of certain sex offenses; the offense of sodomy; and the good soldier defense.

Marshall, that "American military officers, of whatever service, should share common ground ethically and morally." In this new edition, the authors methodically explore that common ground, reflecting on the basics of the Profession of Arms, and the officer's special place and distinctive obligations within that profession and especially to the Constitution.

Available in PDF, EPUB and Kindle. Book excerpt: Military justice systems across the world are in a state of transition. These changes are due to a combination of both domestic and international legal pressures. The domestic influences include constitutional principles, bills of rights and the presence of increasingly strong oversight bodies such as parliamentary committees. Military justice has also come under pressure from international law, particularly when applied on operations. The common theme in these many different influences is the growing role of external legal principles and institutions on military justice. This book provides insights from both scholars and practitioners on reforms to military justice in individual countries (including the UK, Canada, the Netherlands and Australia) and in wider regions (for example, South Asia and Latin America). It also analyses the impact of 'civilianisation', the changing nature of operations and the decisions of domestic and international courts on efforts to reform military justice.
