However, few books have a pronouncedly comparative approach. This book discusses how much was regional and universal in medieval marriage law and practices in Europe. The sources used range from secular and canon law to court practice and from images to private correspondence. Articles discuss medieval and Reformation Belgium, England, France, Germany, Italy, Lithuania, and Sweden. Both marriage formation and marital property, two intertwined aspects, are considered in the articles. The book offers fresh evidence on the scope of regional variation tolerated by the Church, regional practices, and European trends. Contributors are James A. Brundage, Cecilia Cristellon, Trevor Dean, Charles Donahue, Jr., Caroline Dunn, Mia Korpiola, Jurgita Kunsmanaitė, Anu Lahtinen, Anthony Musson, Philip L. An introduction presents the necessary background information about the framework and sources of the criminal justice system, and then proceeds to a detailed examination of the grounds for criminal liability, the justification of criminal offences, the defences that diminish or excuse criminal liability, the classification of criminal offences, and the sanctions system. Coverage of criminal procedure focuses on the organization of investigations, pre-trial proceedings, trial stage, and legal remedies. A final part describes the execution of sentences and orders, the prison system, and the extinction of custodial sanctions or sentences. Its succinct yet scholarly nature, as well as the practical quality of the information it provides, make this book a valuable resource for criminal lawyers, prosecutors, law enforcement officers, and criminal court judges handling cases connected with Lithuania. Academics and researchers, as well as the various international organizations in the field, will welcome this very useful guide, and will appreciate its value in the study of comparative criminal law.

Book excerpt: Intestate Succession is the second volume in the Comparative Succession Law series which examines the principles of succession law from a comparative and historical perspective. This volume discusses the rules which apply where a person dies either without leaving a valid will, or leaving a will which fails to dispose of all of the person's assets. Among the questions considered are the following: What is the nature of the rules for the disposal of the deceased's assets? Are they mechanical or is there an element of discretion? Are particular types of property dealt with in particular ways? Is there entitlement to individual assets (as opposed to money)? Do the rules operate in a parentelic system or a system of some other kind? Are spouses treated more favourably than children? What provision is made for extra-marital children, for adopted children, for step-children? Does cohabitation give rise to entitlement? How are same-sex couples treated? Broader questions also arise of a historical and comparative nature. Where, for example, do the rules in intestate succession come from in particular legal systems? Have they been influenced by the rules in other countries? How are the rules explained and how are they justified? To what extent have they changed over time? What are the long-term trends? And finally, are the rules satisfactory, and is there pressure for their reform? As in the first volume, this book will focus on Europe and on countries which have been influenced by the European experience such as Australia, New Zealand, South Africa, the United States of America, Quebec, and the countries of Latin America. Further chapters are devoted to Islamic Law and Nordic law. Opening with a discussion on Roman law and concluding with an assessment of the overall development of the law in the countries surveyed, this book will provide a wider reflection on the nature and purpose of the law of intestate succession.

Book excerpt: Belarus, a middle-sized nation with more than a thousand years of history, is not well known beyond periodic media headlines. Modern scholarly and popular literature covers only fragments from Belarus’s long history and current geopolitical, social, and cultural issues. Belarusian history in this book differs in many aspects from history and myths created by Russian scholars and propagated worldwide. The author argues for the existence of a Western-Ruthenian (Belarusian-Ukrainian) civilization as a sub-civilization of Western civilization and thus different from Eurasian civilization. With original, detailed. and critical views on Belarusian history from the ninth century to the present, it explores the latest information about Belarusian society regarding mentality, identity, religion, current elites, the Revolution of Hope 2020. It then analyzes the future prospects of Belarus based on an assessment of modern trends in human societal and political development. It provides detailed analysis of current activities of Belarusian national and ruling elites and their ideologies vis-à-vis the building of a nation-state.

Available in PDF, EPUB and Kindle. Book excerpt: This book investigates the concept of the heroic, questions what it is that makes the national hero an indispensable appendage to any possible interpretation of national identity, and asks why scholars stop short before coming to terms with this elusive phenomenon. It finds answers by following heroic traditions in Scotland, Norway and Lithuania from the early modern period to the twentieth century. The book argues that heroic traditions - prevailing trends in situating heroes in national history - owe much to the early modern state. Both national heroes and the nation state had been conceived with a similar moral political mindset that looked for new ways to identify sources for commonality. The confluence of political theory and Realpolitik attested to three classical types of polities, i.e. civitas popularis (democracy), regnum (kingship), and optimatium (aristocracy), as found at that time in Scotland, Norway and Lithuania respectively. The author shows the varied impact these patterns had on heroic traditions. The long record of national heroes in Scotland is explained as a vestige of the legacy of civic humanism, the continuing traditions of the heroic king-lines in Norway are seen as a result of long-standing absolutism, while the belated arrival of national heroes in Lithuania is excused by the country's aristocratic if at times oligarchic past.

Available in PDF, EPUB and Kindle. Book excerpt: The focus of this book is the unique socio-political and socio-cultural community of the Grand Duchy of Lithuania in the golden age of the late fifteenth to early seventeenth century. This study analyses the cultural and political impact of the values disseminated in the newly created state, such as the concept of the state itself, its governance, representation, laws, and other elements of the socio-political system. Through theoretical and factographic arguments, this book demonstrates that the Grand Duchy of Lithuania was a social, political, and cultural link between geopolitical and geo-cultural spaces of the Roman West and the Byzantine East. Located at the cultural crossroads of Europe, Lithuania was an ethnically diverse, multilingual, multi-faith, multicultural national space. Nurtured by international contacts, its political system developed rapidly, influencing the formation of geopolitical and geo-cultural mentality of the whole Central Eastern European region.
