Book Synopsis International Perspectives on the Regulation of Lawyers and Legal Services by : Andrew Boon
Download or read book International Perspectives on the Regulation of Lawyers and Legal Services written by Andrew Boon and published by Bloomsbury Publishing. This book was released on 2017-11-30 with total page 309 pages. Available in PDF, EPUB and Kindle. Book excerpt: This collection explores developments in the regulation of legal services by examining the control of the markets in several key countries and in jurisdictions within countries. The contributions consider emerging adjustments in regulatory structures and methods; examine the continuing role, if any, of professionals and how this may be changing; and speculate on the future of legal services regulation in each jurisdiction. The introductory and concluding chapters draw together similarities, differences and conclusions regarding directions of change in the regulation of legal services. They consider the emergence of alternatives to professionalism as a means of regulating legal services and some implications for the rule of law.
Book Synopsis International Economic Law in the 21st Century by : Ernst-Ulrich Petersmann
Download or read book International Economic Law in the 21st Century written by Ernst-Ulrich Petersmann and published by Bloomsbury Publishing. This book was released on 2012-07-24 with total page 471 pages. Available in PDF, EPUB and Kindle. Book excerpt: The state-centred 'Westphalian model' of international law has failed to protect human rights and other international public goods effectively. Most international trade, financial and environmental agreements do not even refer to human rights, consumer welfare, democratic citizen participation and transnational rule of law for the benefit of citizens. This book argues that these 'multilevel governance failures' are largely due to inadequate regulation of the 'collective action problems' in the supply of international public goods, such as inadequate legal, judicial and democratic accountability of governments vis-a-vis citizens. Rather than treating citizens as mere objects of intergovernmental economic and environmental regulation and leaving multilevel governance of international public goods to discretionary 'foreign policy', human rights and constitutional democracy call for 'civilizing' and 'constitutionalizing' international economic and environmental cooperation by stronger legal and judicial protection of citizens and their constitutional rights in international economic law. Moreover intergovernmental regulation of transnational cooperation among citizens must be justified by 'principles of justice' and 'multilevel constitutional restraints' protecting rights of citizens and their 'public reason'. The reality of 'constitutional pluralism' requires respecting legitimately diverse conceptions of human rights and democratic constitutionalism. The obvious failures in the governance of interrelated trading, financial and environmental systems must be restrained by cosmopolitan, constitutional conceptions of international law protecting the transnational rule of law and participatory democracy for the benefit of citizens.

Book Synopsis A New Legal Framework for Managing the World's Shared Groundwaters by : Fadia Daibes-Murad
Download or read book A New Legal Framework for Managing the World's Shared Groundwaters written by Fadia Daibes-Murad and published by IWA Publishing. This book was released on 2005-11-01 with total page 370 pages. Available in PDF, EPUB and Kindle. Book excerpt: What are the rules of international water law that govern the use of the transboundary aquifers shared by Palestine and Israel? This book addresses this issue through an interdisciplinary approach, identifying first the special problems tied to the management of shared groundwater, and next critically analysing the applicable rules of international law. The innovative contribution of this work is its attempt to devise and suggest the means to implement a "progressive framework" for cooperation in the development and management of these shared waters. A solid review of hydro-politics, supported by current up to date information and rigorous examination of the evolution of the relevant rules of international law makes this book an important contribution to this very problematic area. Dr Fadia Diabes-Murad was awarded the Edberg Award 2005, presented at a special awards ceremony in Stockholm. The award recognised her contribution to peace in the Middle East through her work on water law, including using water as a catalyst for peace in the Middle East.
Book Synopsis Intellectual Property and Information Wealth by : Peter K. Yu
Download or read book Intellectual Property and Information Wealth written by Peter K. Yu and published by Bloomsbury Publishing USA. This book was released on 2006-12-30 with total page 1978 pages. Available in PDF, EPUB and Kindle. Book excerpt: Until recently, issues of intellectual property were relegated to the experts—attorneys, legal scholars, rightsholders, and technology developers who wrangled over interpretations and enforcement of copyright, patent, and trademark protections. But in today's knowledge-based economy, intellectual property protection has taken on fundamentally new proportions, as a subject of urgency for businesses (whose survival depends on protection of their intangible assets) and as a subject of cultural importance that grabs front-page headlines (as the controversy over Napster and high-profile revelations of plagiarism, for example, have illustrated). This landmark set of essays brings new clarity to the issues, as societies around the world grapple with the intricacies and complexities of intellectual property, and its impact on business, law, policy, and culture. Featuring insights from leading scholars and practitioners, Intellectual Property and Information Wealth provides rigorous analysis, historical context, and emerging practical applications from the public, private, and non-profit sectors. Volume 1 focuses on protections to novels, films, sound recordings, computer programs, and other creative products, and covers such issues as authorship, duration of copyright, fair use of copyrighted materials, and the implications of the Internet and peer-to-peer file sharing. Volume 2 explains the fundamental protections to inventors of devices, mechanical processes, chemical compounds, and other inventions, and examines such issues as the scope and limits of patent protection, research exemptions and infringement, IP in the software and biotech industries, and trade secrets. Volume 3 looks at the protections to distinctive symbols and signs, including brand names and unique product designs, and features chapters on consumer protection, trademark and the first amendment, brand licensing, publicity and cultural images, and domain names. Volume 4 takes the discussion to the global level, addressing a wide range of issues, including not only enforcement of IP protections across borders, but also their implications for international trade and investment, economic development, human rights, and public health.
