Book excerpt: The World Justice Project (WJP) joins efforts to produce reliable data on rule of law through the WJP Rule of Law Index 2016, the sixth report in an annual series, which measures rule of law based on the experiences and perceptions of the general public and in-country experts worldwide. We hope this annual publication, anchored in actual experiences, will help identify strengths and weaknesses in each country under review and encourage policy choices that strengthen the rule of law. The WJP Rule of Law Index 2016 presents a portrait of the rule of law in each country by providing scores and rankings organized around eights factors: constraints on government powers, absence of corruption, open government, fundamental rights, order and security, regulatory enforcement, civil justice, and criminal justice. A ninth factor, informal justice, is measured but not included in aggregated scores and rankings. These factors are intended to reflect how people experience rule of law in everyday life. The country scores and rankings for the WJP Rule of Law Index 2016 are derived from more than 110,000 households and 2,700 expert surveys in 113 countries and jurisdictions. The Index is the world%s most comprehensive data set of its kind and the only to rely solely on primary data, measuring a nation%s adherence to the rule of law from the perspective of how ordinary people experience it. These features make the Index a powerful tool that can help identify strengths and weaknesses in each country, and help to inform policy debates, both within and across countries, that advance the rule of law.

Book excerpt: This paper describes the methodology used to build the WJP Rule of Law Index - a new quantitative assessment tool designed to offer a comprehensive picture of the extent to which countries adhere to the rule of law in practice. The WJP Rule of Law Index provides new data on nine dimensions of the rule of law - limited government powers; absence of corruption; order and security; fundamental rights; open government; regulatory enforcement; access to civil justice; effective criminal justice; and informal justice - and is compiled from original surveys of the general public and local legal experts. The paper also presents estimates for an initial group of 66 countries.

Book excerpt: "The WJP Rule of Law Index 2014 is the fourth report in an annual series. It builds on years of development, intensive consultation, and vetting with academics, practitioners, and community leaders from over 100 countries and 17 professional disciplines. The Index is the world's most comprehensive data set of its kind and the only to rely solely on primary data, measuring a nation's adherence to the rule of law from the perspective of how ordinary people experience it. This year's country scores and rankings include the latest data collected and processed by the WJP, based on more than 100,000 household and expert surveys in 99 countries and jurisdictions. This year's report also includes, for the first time, an analysis of changes over time. The Index is intended for a broad audience of policy makers, civil society, practitioners, academics, and others. The rule of law is not the rule of lawyers and judges; all elements of society are stakeholders. It is our hope that, over time, this diagnostic tool will help identify strengths and weaknesses in each country under review and encourage policy choices that strengthen the rule of law."--Pref., p. 1.

The index scores and rankings are constructed from over 400 variables drawn from two original sources of data collected from independent sources by the World Justice Project in each country: a General population poll (GPP) and a series of Qualified respondents' questionnaires (QRQ). To date over 97,000 people and 2,500 experts from around the world have participated in this project. The index is for a broad audience of policy-makers, civil society, practitioners, academics, and other constituencies"--Page 1.

Available in PDF, EPUB and Kindle. Book excerpt: In The Rule of Law in the Real World, Paul Gowder defends a new conception of the rule of law as the coordinated control of power and demonstrates that the rule of law, thus understood, creates and preserves social equality in a state. In a highly engaging, interdisciplinary text that moves seamlessly from theory to reality, using examples ranging from Ancient Greece through the present, Gowder sheds light on how societies have achieved the rule of law, how they have sustained it in the face of political upheaval, and how it may be measured and developed in the future. The Rule of Law in the Real World is an essential work for scholars, students, policymakers, and anyone else who believes the rule of law is critical to the proper functioning of society.

Available in PDF, EPUB and Kindle. Book excerpt: Women, Business and the Law 2021 is the seventh in a series of annual studies measuring the laws and regulations that affect women’s economic opportunity in 190 economies. The project presents eight indicators structured around women’s interactions with the law as they move through their lives and careers: Mobility, Workplace, Pay, Marriage, Parenthood, Entrepreneurship, Assets, and Pension. This year’s report updates all indicators as of October 1, 2020 and builds evidence of the links between legal gender equality and women’s economic inclusion. By examining the economic decisions women make throughout their working lives, as well as the pace of reform over the past 50 years, Women, Business and the Law 2021 makes an important contribution to research and policy discussions about the state of women’s economic empowerment. Prepared during a global pandemic that threatens progress toward gender equality, this edition also includes important findings on government responses to COVID-19 and pilot research related to childcare and women’s access to justice.

Book excerpt: This collection explores developments in the regulation of legal services by examining the control of the markets in several key countries and in jurisdictions within countries. The contributions consider emerging adjustments in regulatory structures and methods; examine the continuing role, if any, of professionals and how this may be changing; and speculate on the future of legal services regulation in each jurisdiction. The introductory and concluding chapters draw together similarities, differences and conclusions regarding directions of change in the regulation of legal services. They consider the emergence of alternatives to professionalism as a means of regulating legal services and some implications for the rule of law.

Available in PDF, EPUB and Kindle. Book excerpt: We live in a world where seemingly everything can be measured. We rely on indicators to translate social phenomena into simple, quantified terms, which in turn can be used to guide individuals, organizations, and governments in establishing policy. Yet counting things requires finding a way to make them comparable. And in the process of translating the confusion of social life into neat categories, we inevitably strip it of context and meaning—and risk hiding or distorting as much as we reveal. With The Seductions of Quantification, leading legal anthropologist Sally Engle Merry investigates the techniques by which information is gathered and analyzed in the production of global indicators on human rights, gender violence, and sex trafficking. Although such numbers convey an aura of objective truth and scientific validity, Merry argues persuasively that measurement systems constitute a form of power by incorporating theories about social change in their design but rarely explicitly acknowledging them. For instance, the US State Department’s Trafficking in Persons Report, which ranks countries in terms of their compliance with antitrafficking activities, assumes that prosecuting traffickers as criminals is an effective corrective strategy—overlooking cultures where women and children are frequently sold by their own families. As Merry shows, indicators are indeed seductive in their promise of providing concrete knowledge about how the world works, but they are implemented most successfully when paired with context-rich qualitative accounts grounded in local knowledge.

Book excerpt: This collection of essays to focuses on the critical issue of corruption that lies at the heart of the crisis of constitutionalism in Africa. Most anti-corruption measures over the years have been inadequate, serving merely as symbolic gestures to give the impression something is being done. The African Union's declaration of 2018 as the 'African anti-corruption year', belated though it be, is an open recognition by African governments of the impact corruption will have on the continent unless urgent steps are taken. The key objective of this volume is to draw attention to the problem of corruption, the complexity of the situation, with all its multi-faceted social, political, economic and legal dimensions, and the need for remedial action.
