Book excerpt: Latin America has the cleanest energy matrix in the world and is expected to have 70% of its electricity consumption generated from renewable energies by 2030. Colombia is an energy-rich country with an abundance of oil and gas reserves, although these are declining. Colombia also has a large installed hydropower capacity, accounting for up to 70% of the country's electricity production. Despite this, there is a growing impetus to develop offshore wind projects to diversify Colombia's energy mix. More generally, Colombia has spearheaded the energy transition in Latin America in recent times and it aims to use this opportunity to foster an industrial policy shift. Offshore wind development forms part of Colombia's proposed energy transition and, more broadly, the region's energy transition. While there are no wind turbines in Colombian territorial waters or Exclusive Economic Zone, Colombia has some of the best wind resources in the world, with Net Capacity Factors (NCFs) up to 70% in the waters located near the Guajira Peninsula, in the Caribbean Sea, northwest of the country.The Colombian case is pioneering in the Caribbean and worthy of an in-depth study. Colombia has taken the development of its regulatory framework seriously, engaging in consultations and collaboration with different institutions and energy agencies to prepare its legislation. This makes the Colombian legal regime for unconventional renewables a front-runner in 'offshore wind legal technology'. Given that permit rounds are to be allocated later in 2023, Colombia will become the first country in the Caribbean to start projects in earnest. Its legal framework is likely to receive attention and be replicated in several Latin American jurisdictions that share language and legislative and regulatory legal cultures or legal traditions. Colombia and Brazil are the first Latin American countries to firmly set in motion offshore wind projects and aspirations, and Colombia's legal offshore wind regime appears to be the most advanced in Latin America, and is comparable (or better) to that used in Spain.

In the month of October 2019, the government has auctioned 8 NCRE projects for a total installed capacity of 1,398MW . Six of the eight projects that were auctioned and have to be fully operational for the year 2022 are Eolic projects. Many risks are associated with the development of these projects, some of them are associated with the investments, but mainly the NCRE projects have a big variability given the weather conditions and the location they are developed. Given that the revenue generated by the company depends solely in the quantities of energy generated and the price of energy at the moment it is sold, financial derivatives can help hedge the risk associated therefore by changing the coverage ratio of the amount of the energy that is produced with financial instruments the project may generate a more certain NPV that creates value for the project, always depending on the value of the price of the energy hedged.

Based on intensive fieldwork with local groups in Oaxaca, Mexico, this book provides an in-depth study, demonstrating the complications and problems that emerge with the current regime of ‘sustainable development’ and wind energy projects in Mexico, which has wider lessons to be drawn for other regions and countries. Put simply, the book reveals a tragic reality that calls into question the marketed hopes of the green economy and the current method of climate change mitigation. It shows the variegated impacts and issues associated with building wind energy parks, which extends to recognizing the destructive effects on Indigenous cultures and practices in the region. The book, however, highlights what to consider or, more importantly, what to avoid if one is working with industrial-scale wind energy systems.

Nevertheless, climate change, not being seen as a priority amongst other issues, has not yet been strongly incorporated into the environmental or economic policy agendas of developing countries. Nevertheless, evidence shows that some of the most adverse effects of climate change will be experienced by developing countries whose populations are the most vulnerable and least likely to be able to adapt to climate change. For instance, although Latín America countries represent only 9 percent of global carbon dioxide emissions, the social and economic impact of those emissions is significantly greater than in developed and emergent countries.
