Book Synopsis Why Not Preempt? by : Rachel Bzostek
Download or read book Why Not Preempt? written by Rachel Bzostek and published by Routledge. This book was released on 2016-02-11 with total page 267 pages. Available in PDF, EPUB and Kindle. Book excerpt: Anticipatory military activities, which include both preemptive and preventive military actions, are at the centre of American strategic doctrine - however, states rarely use these activities. Rachel Bzostek puts forward an integrated analysis to help understand why states have or have not undertaken such activities in the past. By exploring what kinds of strategic or structural elements compel states or leaders to take anticipatory military action, as well as how these concepts are viewed in both international law and the just war tradition, this book uses case studies to examine those elements that have played an influential role in the decision-making process. Ideal as a course reader for upper division undergraduate and graduates in security studies, international law, US foreign policy and those involved in the teaching and training of the military.
Book Synopsis Federal Preemption of State and Local Law by : James T. O'Reilly
Download or read book Federal Preemption of State and Local Law written by James T. O'Reilly and published by American Bar Association. This book was released on 2006 with total page 252 pages. Available in PDF, EPUB and Kindle. Book excerpt: Preemption is a doctrine of American constitutional law, under which states and local governments are deprived of their power to act in a given area, whether or not the state or local law, rule or action is in direct conflict with federal law. This book covers not only the basics of preemption but also focuses on such topics as federal mechanisms for agency preemption, implied forms of preemption, and defensive use of federal preemption in civil litigation.
Book Synopsis Preemption Choice by : William W. Buzbee
Download or read book Preemption Choice written by William W. Buzbee and published by Cambridge University Press. This book was released on 2008-12-15 with total page 337 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines the theory, law, and reality of preemption choice. The Constitution's federalist structures protect states' sovereignty but also create a powerful federal government that can preempt and thereby displace the authority of state and local governments and courts to respond to a social challenge. Despite this preemptive power, Congress and agencies have seldom preempted state power. Instead, they typically have embraced concurrent, overlapping power. Recent legislative, agency, and court actions, however, reveal an aggressive use of federal preemption, sometimes even preempting more protective state law. Preemption choice fundamentally involves issues of institutional choice and regulatory design: should federal actors displace or work in conjunction with other legal institutions? This book moves logically through each preemption choice step, ranging from underlying theory to constitutional history, to preemption doctrine, to assessment of when preemptive regimes make sense and when state regulation and common law should retain latitude for dynamism and innovation.
Book Synopsis The Implications of Preemptive and Preventive War Doctrines: A Reconsideration by : Colin S. Gray
Download or read book The Implications of Preemptive and Preventive War Doctrines: A Reconsideration written by Colin S. Gray and published by Lulu.com. This book was released on 2014-06-22 with total page 72 pages. Available in PDF, EPUB and Kindle. Book excerpt: If RMA (revolution in military affairs) was the acronym and concept of choice in the U.S. defense community in the 1990s, so preemption has threatened to supercede it in the 2000s. The trouble is that officials and many analysts have confused preemption, which is not controversial, with prevention, which is. In this monograph, Dr. Colin S. Gray draws a sharp distinction between preemption and prevention, and explains that the political, military, moral, and strategic arguments have really all been about the latter, not the former. Dr. Gray provides definitions, reviews the history of the preventive war option, and considers the merit, or lack thereof, in the principal charges laid against the concept when it is proclaimed to be policy. Dr. Gray concludes that there is a place for preventive war in U.S. strategy, but that it is an option that should be exercised only very occasionally. However, there are times when only force seems likely to resolve a maturing danger.

Book excerpt: A dark, shocking, bestselling thriller debut about a mother and daughter—and the lengths to which a daughter will go to find independence. “Nobody wants to hear the truth from a liar.” For the first eighteen years of her life, Rose Gold Watts believed she was seriously ill. She was allergic to everything, used a wheelchair, and practically lived at the hospital. Neighbors did all they could, holding fundraisers and offering shoulders to cry on, but no matter how many doctors, tests, or surgeries, no one could figure out what was wrong with her. Turns out her mom, Patty Watts, was just a really good liar. After serving five years in prison, Patty gets out with nowhere to go and begs her daughter to take her in. The entire community is shocked when Rose Gold says yes. Patty insists all she wants is to reconcile their differences. She says she’s forgiven Rose Gold for turning her in and testifying against her. But Rose Gold knows her mother. Patty Watts always settles a score. Unfortunately for Patty, Rose Gold is no longer her weak little darling… And she’s waited such a long time for her mother to come home.

Book Synopsis The Reformer by : Stephen F. Williams
Download or read book The Reformer written by Stephen F. Williams and published by Encounter Books. This book was released on 2017-11-07 with total page 361 pages. Available in PDF, EPUB and Kindle. Book excerpt: Besides absolutists of the right (the tsar and his adherents) and left (Lenin and his fellow Bolsheviks), the Russian political landscape in 1917 featured moderates seeking liberal reform and a rapid evolution towards a constitutional monarchy. Vasily Maklakov, a lawyer, legislator and public intellectual, was among the most prominent of these, and the most articulate and sophisticated advocate of the rule of law, the linchpin of liberalism. This book tells the story of his efforts and his analysis of the reasons for their ultimate failure. It is thus, in part, an example for movements seeking to liberalize authoritarian countries today—both as a warning and a guide. Although never a cabinet member or the head of his political party—the Constitutional Democrats or “Kadets”—Maklakov was deeply involved in most of the political events of the period. He was defense counsel for individuals resisting the regime (or charged simply for being of the wrong ethnicity, such as Menahem Beilis, sometimes considered the Russian Dreyfus). He was continuously a member of the Kadets’ central committee and their most compelling orator. As a somewhat maverick (and moderate) Kadet, he stood not only between the country’s absolute extremes (the reactionary monarchists and the revolutionaries), but also between the two more or less liberal centrist parties, the Kadets on the center left, and the Octobrists on the center right. As a member of the Second, Third and Fourth Dumas (1907-1917), he advocated a wide range of reforms, especially in the realms of religious freedom, national minorities, judicial independence, citizens’ judicial remedies, and peasant rights.
