Book Synopsis The Politics of Executive Privilege by : Louis Fisher
Download or read book The Politics of Executive Privilege written by Louis Fisher and published by . This book was released on 2004 with total page 292 pages. Available in PDF, EPUB and Kindle. Book excerpt: For over 200 years, Congress and the President have locked horns on an issue that will not, and cannot go away: legislative access to executive branch information. Presidents and their advisers often claim that the sought-for information is covered by the doctrine of executive privilege and other principles that protect confidentiality among presidential advisers. For its part, Congress will articulate persuasive reasons why legislative access is crucial. In terms of constitutional principles, these battles are largely a standoff, and court decisions in this area are interesting but hardly dispositive. What usually breaks the deadlock is a political decision: the determination of lawmakers to use the coercive tools available to them, and political calculations by the executive branch whether a continued standoff risks heavy and intolerable losses for the President. Many useful and thoughtful standards have been developed to provide guidance for executive-legislative disputes over access to information. Those standards, constructive as they are, are set aside at times to achieve what both branches may decide has higher importance; settling differences and moving on. Legal and constitutional principles, finely-honed as they might be, are often overridden by the politics of the moment and practical considerations. Efforts to discover enduring and enforceable norms in this area invariably fall short. Efforts to resolve interbranch disputes on purely legal grounds may have to give ground in the face of superior political muscle by a Congress determined to exercise the many coercive tools available to it. By the same token, a Congress that is internally divided or uncertain about its institutional powers, or unwilling to grind it out until the documents are delivered, will lose out in a quest for information. Moreover, both branches are at the mercy of political developments that can come around the corner without warning and tilt the advantage decisively to one side. It is tempting to see the executive-legislative clashes only as a confrontation between two branches, yielding a winner and a loser. It is more than that. Congressional access represents part of the framers' belief in representative government. When lawmakers are unable (or unwilling) to obtain executive branch information needed for congressional deliberations, the loss extends to the public, democracy, and constitutional government. The system of checks and balances and separation of powers are essential to protect individual rights and liberties. This book is also available in paper binding. "[T]ightly reasoned, nuanced, and thoroughly researched." -- Athan Theoharis, Marquette University Political Science Quarterly

The 35 chapters of Guide to Congress, Seventh Edition, are divided into eight subject areas that cover all aspects of the U.S. Congress: Origins and Development of Congress, from the constitutional beginnings of the legislative branch to the histories of the House and Senate and their power shifts, eras of partisanship and unity, influential leaders, and working relationships with presidents. New coverage includes analysis of the tug-of-war between House Democrats and the George W. Bush administration on Iraq war withdrawal timetables, updates on criminal investigations of House members including William J. Jefferson of Louisiana and Charles Rangel of New York, and analysis of the Tea Party Movement and new Republican majority. Powers of Congress, including powers to tax, spend, and borrow; to conduct foreign policy and investigations; to confirm and impeach; to regulate commerce; to amend the Constitution; and to select the president. Bush administration’s use of immunity from questioning by congressional committees, analysis of the signing of the new START treaty with Russia—marking a cornerstone of U.S. relations with the country, coverage of the War on Terror—including the killing of bin Laden in a U.S. raid in Pakistan, and perspective on the negotiations to raise the federal debt ceiling in 2011. Congressional Procedures, detailing the party and leadership structures; rules and the legislative process; the committee system, assignment, and procedures; and congressional staff. Qualifications and conduct, detailing congressional ethics investigations and procedures for disciplining members. Updated coverage reviews ethics investigations, including the creation of the Office of Congressional Ethics. Specific investigations and outcomes are discussed, including the censure of Charles Rangel and disapproval of Joe Wilson’s outburst during a speech by President Obama. Volume 2 concludes with a selected bibliography and key reference materials: a list of all members of congress who have served since 1789; congressional election results; floor leaders and committee chairs; dates for sessions of congress; women, black, Asian, and Hispanic members; and many more. Download or read book Shadow written by Bob Woodward and published by Simon and Schuster. This book was released on 1999-06-16 with total page 607 pages. Available in PDF, EPUB and Kindle. Book excerpt: Twenty-five years ago, after Richard Nixon resigned the presidency, Gerald Ford promised a return to normalcy. "My fellow Americans, our long national nightmare is over," President Ford declared. But it was not. The Watergate scandal, and the remedies against future abuses of power, would have an enduring impact on presidents and the country. In Shadow, Bob Woodward takes us deep into the administrations of Ford, Carter, Reagan, Bush and Clinton to describe how each discovered that the presidency was forever altered. With special emphasis on the human toll, Woodward shows the consequences of the new ethics laws, and the emboldened Congress and media. Powerful investigations increasingly stripped away the privacy and protections once expected by the nation's chief executive. Using presidential documents, diaries, prosecutorial records and hundreds of interviews with firsthand witnesses, Woodward chronicles how all five men failed first to understand and then to manage the inquisitorial environment. "The mood was mean," Gerald Ford says. Woodward explains how Ford believed he had been offered a deal to pardon Nixon, then clumsily rejected it and later withheld all the details from Congress and the public, leaving lasting suspicions that compromised his years in the White House. Jimmy Carter used Watergate to win an election, and then watched in bewilderment as the rules of strict accountability engulfed his budget director, Bert Lance, and challenged his own credibility. From his public pronouncements to the Iranian hostage crisis, Carter never found the decisive, healing style of leadership the first elected post-Watergate president had promised. Woodward also provides the first behind-the-scenes account of how President Reagan and a special team of more than 60 attorneys and archivists beat Iran-contra. They turned the Reagan White House and United States intelligence agencies upside down investigating the president with orders to disclose any incriminating information they found. A fresh portrait of an engaged Reagan emerges as he realizes his presidency is in peril and attempts to prove his innocence. In Shadow, a bitter and disoriented President Bush routinely pours out his anger at the permanent scandal culture to his personal diary as a dozen investigations touch some of those closest to him. At one point, Bush pounds a plastic mallet on his Oval Office desk because of the continuing investigation of Iran-contra Independent Counsel Lawrence Walsh. "Take that, Walsh!" he shouts. "I'd like to get rid of this guy." Woodward also reveals why Bush avoided telling one of the remaining secrets of the Gulf War. The second half of Shadow focuses on President Clinton's scandals. Woodward shows how and why Independent Counsel Kenneth Starr's investigation became a state of permanent war with the Clintons. He reveals who Clinton really feared in the Paula Jones case, and the behind-the-scenes maneuvering and ruthless, cynical legal strategies to protect the Clintons. Shadow also describes how impeachment affected Clinton's war decisions and scarred his life, his marriage and his presidency. "How can I go on?" First Lady Hillary Clinton asked in 1996, when she was under scrutiny by Starr and the media, two years before the Lewinsky scandal broke. "How can I?" Shadow is an authoritative, unsettling narrative of the modern, beleaguered presidency.
Book Synopsis Historical Encyclopedia of U.S. Independent Counsel Investigations by : Gerald S. Greenberg
Download or read book Historical Encyclopedia of U.S. Independent Counsel Investigations written by Gerald S. Greenberg and published by Bloomsbury Publishing USA. This book was released on 2000-09-30 with total page 428 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume is a compilation of the U.S. federal special prosecutor/independent counsel investigations spanning the complete twenty-one year tenure from 1978-1999 of the independent counsel statute. The entries include individuals who have served as investigators; those who have been targets of investigations; all attorney generals who have called for appointment of special prosecutors; all presidents during whose terms of office such prosecutors served; and all legal cases that served to argue for or against the constitutionality of the independent counsel statute. These historical precedents are traced from Ulysses Grant's appointment of a special prosecutor to investigate the St. Louis Whiskey Scandal in 1875. More contemporary cases include Watergate, precipitated by Richard Nixon's Saturday Night Massacre dismissal of Special Prosecutor Archibald Cox in 1973; Independent Counsel Lawrence Walsh's Iran-Contra Investigation; and Special Prosecutor Ken Starr's Whitewater investigation of the Clintons and the ensuing permutations which brought individuals like Linda Tripp and Monica Lewinsky to prominence and also brought the statute calling for such investigations into constitutional debate. The book is fully cross-referenced and contains a comprehensive bibliography and index. It will be of interest to scholars and students of American History and Constitutional History.
