In this respect, the various efforts that have been made in the past to come to harmonization of this area of law and the reasons that they were only partially successful are reviewed. In addition, the International and European regulations that refer to unfair competition, like, e.g., the Paris Convention, the TRIPs and the recent 2004 Unfair Commercial Practices Directive are discussed. Also an overview is given of the unfair competition laws in the United Kingdom, Germany and the Netherlands with respect to the 'problem-areas' of slavish imitation, misleading advertising, denigrating one's competitor, trade secrets and finally, misappropriation of valuable trade assets. Unfair competition law is traditionally considered part of intellectual property law. Not only the relation of unfair competition law to intellectual property laws are therefore part of the discussion but also the areas of consumer protection law (since unfair competition law is partly orientated towards consumer protection) and competition (as an economic concept) is the topic of thorough review.

Climate change appears more frequently than ever on the top of global and national policy agendas. In the current situation traditional environmental concern and environmental policy may not suffice in the face of the global challenge as manifested by climate change and the depletion of fossil energy resources. But as new data comes to light, new energy policies and changes in economic structures are crucial for putting into action global climate policy. Crucial tasks in environmental policy are the sustainable utilisation of natural resources and the conservation of natural and human-made habitats. One of the areas of the world where this comes into play the most is in the Nordic countries. Northern societies are predominantly high tech, high consumption and high energy supply societies. And with the transition from older energy sources (wood for heating and stream water for power production) to newer ones (oil and nuclear energy) discussions on the environmental impact have led to public and corporate action. The Northern countries have been at the forefront in finding sustainable alternatives to solve conflicts arising from the rise in energy needs. However, these countries have taken different pathways with different policies in attempting to achieve this. As the needs and concerns from climate change arise, a Northern dimension, involving policies that contrast to European and global trends, emerges. The author maintains that the contentious debates surrounding contemporary monumnets to the Nazi past testify to the ambiguity of German memory and the continued link of Nazism with contemporary German national identity. The book discusses how certain monuments, and the ways Germans have viewed them, contribute to the different ways Germans have dealt with the past, and how they continue to deal with it as one country. Kattago concludes that West Germans have internalized their Nazi past as a normative orientation for the democratic culture of West Germany, while East Germans have universalized Nazism and the Holocaust, transforming it into an abstraction in which the Jewish question is down played. In order to form a new collective memory, the author argues that unified Germany must contend with these conflicting views of the past, incorporating certain aspects of both views. Providing a topography of East, West, and unified German memory during the 1980s and the 1990s, this work contributes to a better understanding of contemporary national identity and society. The author shows how public debate over such issues at Ronald Reagan's visit to Bitburg, the renarration of Buchenwald as Nazi and Soviet internment camp, the Goldhagen controversy, and the Holocaust Memorial debate in Berlin contribute to the complexities surrounding the way Germans see themselves, their relationship to the past, and their future identity as a nation. In a careful analysis, the author shows how the past was used and abused by both the East and the West in the 1980s, and how these approaches merged in the 1990s. This interesting new work takes a sociological approach to the role of memory in forging a new, integrative national identity.

Book excerpt: Two general questions stood at the beginning of this PhD-thesis, namely: • What are the mechanisms which lead to the emergence and establishment of new technologies? • How can this process of technological change be influenced politically? In this sense, conceptual and theoretical interests were the early driving forces of the research work. This is also reflected in the considerable attention paid to the nature of technological change and political control. The result is an holistic per spective which builds on inputs from different disciplines and aims at dynamic interpretation. This, however, created a severe methodological problem: How could such a comprehensive perspective be used constructively? To develop this link between theory and forward-looking, policy-oriented analysis, and to devise a methodology which showed explicitly how this approach could be used in a con structive way were in fact the major challenges of this research project. The appli cation to the example of combined heat and power generation, and the comparison of the developments in the UK and in Germany serve the purpose to demonstrate how this approach and methodology can be implemented in practice. These as pects were also of particular interest to the Institute for Prospective Technological Studies (IPTS), one ofthe institutes of the European Commission's Joint Research Centre, where most of the research work reported in this PhD-thesis was carried out.

Book excerpt: If we can speak of the European Community's 'economic constitution', we can assert that competition rules, together with free movement rules, form its core. Notably, implementation of the competition rules enshrined in Articles 81 and 82 EC changed radically with the enactment of Regulation 1/2003, which in effect dispensed with mandatory prior notifications and allowed national authorities to apply Article 101(3) TFEU directly. Given that national legislations perceive certain types of unilateral conduct, even if adopted by a non-dominant undertaking, as a potential source of anticompetitive effects, an important question concerns the leeway enjoyed by national authorities under the exception to the convergence rule in Article 3(2) of Regulation 1/2003, and the consequent effect on both legal practice and policy issues. In this lucidly argued book, focusing on national competition provisions in Germany, France, Italy, and the United Kingdom that deal with such conduct, the author provides a detailed examination of how such considerations as the following are affected by Regulation 1/2003: - prohibition of abuse of economic dependence or superior bargaining power; - the particular susceptibility of long-term contracts; - prohibition of resale at a loss or below cost; - prohibition of boycott, unlawful pressures, threats, and other coercive tactics adopted by undertakings; and - the role of unfair competition law. The analysis follows a functional method of comparative legal analysis, reviewing the most relevant norms in the selected jurisdictions, particularly in what concerns their goals and function in the context of their respective legal systems. Special attention is paid to two specific sectors – the motor-vehicle and the retailing industries – which have most often triggered relevant legislation and case law in the jurisdictions covered. Legal scholarship in the field is also drawn upon. In its clarification of the meaning of Regulation 1/2003, this book allows practitioners to fully grasp its scope. The author's thorough, masterful analysis of the statutory framework of Article 3 of the regulation also reveals the variety of reasons why different Member States have different competition policies on the scope of the exception to the rule of convergence, and in this way provides lawyers, policymakers, and academics with welcome insights on how major EU jurisdictions apply European competition law.
