Book excerpt: Sustainable development is now widely accepted as a political objective in the UK and elsewhere but to what extent has the UK’s rhetoric on sustainable development become a reality? The aim of this book is to critically examine the UK’s approach to promoting and delivering sustainable development. It begins by providing a detailed account of UK law on sustainable development by reviewing the various policy, institutional and legal mechanisms used by the UK since the 1980s and by devolved administrations since devolution took effect in 1999. Progress has been slow, too slow and, according to the scientists, time is running out. To deal with this lack of progress, the book advocates increasing the status of ecological sustainability and sustainable development through the introduction of a wide range of legal mechanisms which would compel the change needed. The book calls for ecological sustainability, or respecting the Earth’s environmental limits, to be afforded the status of legal principle and argues that with ecological sustainability at its normative core, sustainable development could provide an effective framework for decision making and governance. It argues that to support this approach and ensure consistency, the time has come for sustainable development to receive explicit legal backing. Over and above its symbolic and educational value, legislation can impose mandatory rules on policymakers and decision makers, often with meaningful consequences both inside and outside the courtroom. To this end, the book contributes to the theory on sustainable development governance by suggesting three possible legislative approaches for such intervention. The volume concludes that while a lack of leadership on sustainable development may hinder the introduction of these innovations, once introduced, these innovations would equally provide much needed support for effective leadership towards a sustainable future. Andrea Ross is a Reader in the School of Law at the University of Dundee and has taught and researched in the areas of public and environmental law for over 18 years. The governance of marine fisheries has been a contested issue for decades with increasing anxieties about overfishing. In tandem, the rise of aquaculture, fish and shellfish farming, has driven another set of environmental concerns. In the food system, there have been scandals about safety failures and about fraud. At the same time, governments issue advice urging people to eat fish for its health benefits. In the context of these problems and contradictions, how have governments, the food industry and ordinary consumers responded? The author shows how different types of governance and regulation have been used to seek seafood sustainability and food safety and to communicate nutritional messages to the public and with what effects. The book also presents a new model for understanding food chains which combines governance and power approaches with an emphasis on understanding the interests served and the resulting balance of public and private benefits. This shows that the role of state regulation should have greater emphasis in governance and agri-food analysis and that theories about supply chain functioning, including the part played by major retailers and civil society, should be modified by a more nuanced understanding of the role of standards and certification systems. Although much of the focus is on the UK and Europe, this book provides key lessons internationally for the governance of seafood and other agri-food supply chains. It consider a range of issues including the role of the fishing industry and its growth over the last 50 years; the legal framework for the marine environment and fisheries, at the national, European and international levels; the impact of fishing and the legacy of overfishing; aquaculture fisheries; marine protected areas; improved fisheries management; and a system of marine spatial planning. The report concludes that, as a society, we give much lower priority to protecting our seas compared with the land, and over-fishing is a global problem which has led to the collapse of fisheries in many areas. This situation requires significant urgent change which recognises the need for sustainable fisheries management and avoids the degradation of our seas, placing it within the context of wider management of human activities in the marine environment. Recommendations made include: the introduction of a Marine Act to establish a statutory framework with strategic objectives for marine environmental protection; a move away from a presumption in favour of fishing rights to a precautionary approach which requires demonstration that fishing activity is environmentally sustainable; establishing a network of marine protected areas within the UK over the next five years, which would lead to 30 per cent of the UK's exclusive economic zone being closed to commercial fishing; and a change in the emphasis of research away from management of fish populations towards a wider focus on the marine environment.
