The book also highlights how tribal communities and programs are responding to the changing environments. Fifty authors from tribal communities, academia, government agencies and NGOs contributed to the book. Previously published in Climatic Change, Volume 120, Issue 3, 2013.
Book Synopsis A Promise Kept by : Robert J. Miller
Download or read book A Promise Kept written by Robert J. Miller and published by University of Oklahoma Press. This book was released on 2023-01-26 with total page 305 pages. Available in PDF, EPUB and Kindle. Book excerpt: “At the end of the Trail of Tears there was a promise,” U.S. Supreme Court Justice Neil Gorsuch wrote in the decision issued on July 9, 2020, in the case of McGirt v. Oklahoma. And that promise, made in treaties between the United States and the Muscogee (Creek) Nation more than 150 years earlier, would finally be kept. With the Court’s ruling, the full extent of the Muscogee (Creek) Reservation was reaffirmed—meaning that 3.25 million acres of land in Oklahoma, including part of the city of Tulsa, were recognized once again as “Indian Country” as defined by federal law. A Promise Kept explores the circumstances and implications of McGirt v. Oklahoma, likely the most significant Indian law case in well over 100 years. Combining legal analysis and historical context, this book gives an in-depth, accessible account of how the case unfolded and what it might mean for Oklahomans, the Muscogee (Creek) Nation, and other tribes throughout the United States. For context, Robbie Ethridge traces the long history of the Muscogee (Creek) Nation from its inception in present-day Georgia and Alabama in the seventeenth century; through the tribe’s rise to regional prominence in the colonial era, the tumultuous years of Indian Removal, and the Civil War and allotment; and into its resurgence in Oklahoma in the twentieth and twenty-first centuries. Against this historical background, Robert J. Miller considers McGirt v. Oklahoma, examining important related cases, precedents that informed the Court’s decision, and future ramifications—legal, civil, regulatory, and practical—for the Muscogee (Creek) Nation, federal Indian law, the United States, the state of Oklahoma, and Indian nations in Oklahoma and elsewhere. Their work clarifies the stakes of a decision that, while long overdue, raises numerous complex issues profoundly affecting federal, state, and tribal relations and law—and will continue to do so for the foreseeable future.

Download or read book Fostering State-Tribal Collaboration written by Andrea Wilkins and published by Rowman & Littlefield. This book was released on 2015-12-03 with total page 125 pages. Available in PDF, EPUB and Kindle. Book excerpt: Fostering State-Tribal Collaboration: An Indian Law Primer surveys federal Indian law in order to facilitate collaborative policy development between the states and Native American tribes. Wilkins addresses civil and criminal jurisdiction, taxation, the Indian Child Welfare Act and other human services issues, environmental regulation, Indian gaming and revenue sharing, intergovernmental agreements and limited waivers of sovereign immunity, encouraging a move away from conflict and litigation and towards communication and collaboration. She provides a historical context for the existing law and foundational knowledge to foster programs and policies that meet the needs of all citizens and engage in successful cross-jurisdictional policy development. Unlike most other authors of texts on Indian law, who write for academics or lawyers, Wilkens explains current issues using practical, jargon-free language, making her book of immediate practical value to policymakers and students.

Book Synopsis Wildlife Stewardship on Tribal Lands by : Serra J. Hoagland
Download or read book Wildlife Stewardship on Tribal Lands written by Serra J. Hoagland and published by JHU Press. This book was released on 2023-05-23 with total page 432 pages. Available in PDF, EPUB and Kindle. Book excerpt: This groundbreaking book brings together Native American and Indigenous scholars, wildlife managers, legal experts, and conservationists from dozens of tribes to share their wildlife stewardship philosophies, histories, principles, and practices. Tribes have jurisdiction over some of the healthiest wild areas in North America, collectively managing over 56 million acres of land. This is no accident: in addition to a deep reverence for the land and a strong history of environmental stewardship, Native peoples implement some of the best fish and wildlife preservation and management practices on the continent. Wildlife Stewardship on Tribal Lands is the first comprehensive resource dedicated to the voices and expertise of Native scholars and wildlife professionals. In its pages, nearly one hundred Native and non-native wildlife conservationists, managers, and their collaborators share lessons to guide wildlife professionals in how best to incorporate native methods and how to work effectively with tribal stakeholders. The authors cover topics that include: • Guidelines for conducting research on tribal lands • Traditional ecological knowledge-based management models • The cultural and ecological importance of key species • Legal battles for treaty rights, management authority, and funding • First foods and food sovereignty • Fisheries and migratory bird management • Tribal perspectives on the Endangered Species Act • A history of modern fish and wildlife management on tribal lands The content of this book is not limited to the invaluable reports of research findings, explications of methodologies, and case studies. Capturing oral histories and spiritual knowledge through interviews with tribal leaders and the work of Native artists and writers honors the holistic awareness of the land offered to readers of this unique volume. Ultimately, the contributors to Wildlife Stewardship on Tribal Lands demonstrate how tribal practices are pivotal guideposts for those seeking to protect and harness our natural resources in ways that can help reverse grievous biodiversity losses and ensure the health of our environment for future generations.
