Las autoras y autores comparan cuatro países (Brasil, Chile, México y Uruguay) con sistemas relativamente similares de tratamiento de adolescentes infractores, muestran los desafíos que enfrentan para implementarlo, así como el enorme lastre del pasado punitivo penalista reflejado en las leyes, las instituciones y el comportamiento de las autoridades judiciales y policiales. El panorama general presenta una imagen de un sistema de justicia para adolescentes inacabado y débil que no atiende plenamente los problemas de fondo. Las políticas públicas hacia este sector de la población siguen siendo marginales. En estas condiciones, la posibilidad de las adolescencias de acceder a la justicia seguirá siendo un magnífico reto en América Latina. Book excerpt: La garantía de acceso a la justicia para niños en materia penal no se cumple plenamente, ello se debe -entre otras causas-, a la actual a estructura procesal de administración de justicia: diseñada como una copia del esquema vigente en los adultos.Si el sistema retributivo no responde al principio de interés superior del niño -y quizá plenamente a ninguno de sus derechos-, se hace necesaria una nueva forma de abordar la respuesta penal vigente mediante un diseño de gestión procesal que privilegie la justicia juvenil restaurativa, antes que al castigo puro y simple.Sin abandonar la descripción del sistema procesal penal juvenil, esta investigación se centra en explicar los procedimientos que actualmente existen en la administración de justicia denominada "especializada", pero no solo para desenmascararlos como herramientas de sanción sino para que desde su propia estructura se generen nuevos modos que abran espacios de concertación, diálogo entre partes, y posibiliten el cambio procedimental hacia un sistema juvenil restaurador.Particularmente, se estudian las etapas investigativas, las de juzgamiento, sanción y ejecución de la pena, a las cuales son sometidos los menores de dieciocho años de edad. Todo ello a la luz de la Convención Internacional de Derechos del Niño (en especial los Arts. 12, 37 y 40), describir sí, criticar también, pero planteando caminos de transformación a diseños sencillos de des judicialización y reparación, para que sean las partes y no solo un tercero quienes acuerden esas salidas no violentas de sus situaciones problemáticas, deconstruyendo el binomio delito-pena.Estas ideas permiten reconocer la deslegitimación del poder punitivo y su incapacidad para resolver conflictos, mediante el reemplazo o sustitución por modelos de solución de controversias diferentes. No quisiera llamarlos métodos alternativos de solución de conflictos (MASC), pues lo normal, lo obviamente lógico es que un conflicto se solucione por el diálogo y no por la represión. Lo alternativo, lo anormal realmente es el castigo, no la solución pacífica.El texto aborda desde la práctica un problema básico en materia de Justicia Penal Juvenil, y es la ausencia de cumplimiento entre lo declarativo y la ejecución legal. Y es que si bien la mayoría de países en el mundo han suscrito la Convención de Derechos del Niño, la práctica devela una realidad procedimental carente de eficacia y hasta violatoria del corpus iuris internacional de Derechos Humanos.La pena ha resultado en provocadora de mayor daño del que se quiso evitar, el fin penal logra convertirse en generador de violencia y no en rehabilitación -de ser ese su ideal-. No evita reincidencias, pues por un lado, causa sufrimientos innecesarios que socialmente se reparten en forma injusta; por otro, no tiene efectos positivos sobre las personas involucradas en los conflictos; y -finalmente- su contralor es difícil.Resulta entonces esperanzador el camino restaurativo en tiempos de populismo punitivo. Los procedimientos deben entonces ajustarse y calibrarse para que esos preceptos normativos favorables a los niños y adolescentes, sean en algún momento posibles, advirtiendo que la juventud es una construcción social.Si el interés superior del niño recogido en la Convención de Derechos del Niño, supera la simple legalidad para orientar las acciones de los Estados hacia políticas públicas restaurativas, se impulsa con ello el desarrollo de la cultura, se aspira igualdad y acato de los derechos de humanos en la práctica y no en la mera formalidad.

Rather, they stem from structural conditions that vary from country to country and from era to era. In The Politics of Drug Violence, Angelica Durán-Martínez shows how variation in drug violence results from the complex relationship between state power and criminal competition. Drawing on remarkably extensive fieldwork, this book compares five cities that have been home to major trafficking organizations for the past four decades: Cali and Medellín in Colombia, and Ciudad Juárez, Culiacán, and Tijuana in Mexico. She shows that violence escalates when trafficking organizations compete and the state security apparatus is fragmented. However, when the criminal market is monopolized and the state security apparatus cohesive, violence tends to be more hidden and less frequent. The size of drug profits does not determine violence levels, and neither does the degree of state weakness. Rather, the forms and scale of violent crime derive primarily from the interplay between marketplace competition and state cohesiveness. An unprecedentedly rich empirical account of one of the worst problems of our era, the book will reshape our understanding of the forces driving organized criminal violence in Latin America and elsewhere.

For early modern people on both sides of the Atlantic, writing was also the province of notaries, men trained to cast other people’s words in official forms and make them legally true. Thus the first thing Columbus did on American shores in October 1492 was have a notary record his claim of territorial possession. It was the written, notarial word—backed by all the power of Castilian enforcement—that first constituted Spanish American empire. Even so, the Spaniards who invaded America in 1492 were not fond of their notaries, who had a dismal reputation for falsehood and greed. Yet Spaniards could not do without these men. Contemporary scholars also rely on the vast paper trail left by notaries to make sense of the Latin American past. How then to approach the question of notarial truth? Kathryn Burns argues that the archive itself must be historicized. Using the case of colonial Cuzco, she examines the practices that shaped document-making. Notaries were businessmen, selling clients a product that conformed to local “custom” as well as Spanish templates. Clients, for their part, were knowledgeable consumers, with strategies of their own for getting what they wanted. In this inside story of the early modern archive, Burns offers a wealth of possibilities for seeing sources in fresh perspective.
