Book excerpt: This edited volume contains 22 papers organized into three sections under the following headings: part I is entitled On Promoting Victim Policies; Part II On Reforming Criminal Justice; and Part III On Restorative Justice. All three areas are ones to which Tony Peters, former Professor of Criminology in Leuven, has made a significant contribution and for which he is known as an international authority. During his long and productive academic career Tony Peters led many struggles for criminal justice reform. He was a leading figure in the movement to recognize crime victims' plight and to reaffirm their rights. In Belgium, he spearheaded the early initiatives in restorative justice and became one of its outspoken proponents nationally and internationally. There is no doubt that these three major topics and the various developments and reforms that are addressed in the papers will dominate the thinking about, and the practice of, criminal justice in the years to come. Thus, in addition to paying homage to a congenial friend and an illustrious colleague, it is hoped that this book will appeal and prove useful to all those who have an interest in victims issues, in criminal justice reform, and last but not least, in the promising paradigm of restorative justice.

Book excerpt: The shocking true story of a bizarre kidnapping and the victims' re-victimization by the justice system. In March 2015, Denise Huskins and her boyfriend Aaron Quinn awoke from a sound sleep into a nightmare. Armed men bound and drugged them, then abducted Denise. Warned not to call the police or Denise would be killed. Aaron agonized about what to do. Finally he put his trust in law enforcement and dialed 911. But instead of searching for Denise, the police accused Aaron of her murder. His story, they told him, was just unbelievable. When Denise was released alive, the police turned their fire on her, dubbing her the “real-life ‘Gone Girl’” who had faked her own kidnapping. In Victim F, Aaron and Denise recount the horrific ordeal that almost cost them everything. Like too many victims of sexual violence, they were dismissed, disbelieved, and dragged through the mud. With no one to rely on except each other, they took on the victim blaming, harassment, misogyny, and abuse of power running rife in the criminal justice system. Their story is, in the end, a love story, but one that sheds necessary light on sexual assault and the abuse by law enforcement that all too frequently compounds crime victims’ suffering.

Available in PDF, EPUB and Kindle. Book excerpt: Despite the wealth of historical literature on the Second World War, the subject of religion and churches in occupied Europe has been undervalued – until now. This critical European history is unique in delivering a rich and detailed analysis of churches and religion during the Second World War, looking at the Christian religions of occupied Europe: Catholicism, Lutheranism, Calvinism, and Orthodoxy. The authors engage with key themes such as relations between religious institutions and the occupying forces; religion as a key factor in national identity and resistance; theological answers to the Fascist and National Socialist ideologies, especially in terms of the persecution of the Jews; Christians as bystanders or protectors in the Holocaust; and religious life during the war. Churches and Religion in the Second World War will be of great value to students and scholars of European history, the Second World War and religion and theology.

* * * This Liber Amicorum, which pays tribute to Gilles de Kerchove, EU counter-terrorism coordinator from 2007 to 2021, takes stock of what has been achieved in this field in recent years and looks at the challenges ahead. After an introduction tracing the recipient’s background, the first part looks at different aspects of cooperation within the European Union, ranging from the European arrest warrant, to the protection of fundamental rights and the role of certain EU institutions or agencies. The second part deals with cooperation between the EU and the rest of the world, both with global organisations and with specific States, such as the United States. The third, cross-cutting part brings together various contributions relating to the Islamic State, the financing of terrorism, victims and new technologies. The book concludes with a fourth part on prevention, the fight against radicalisation, values, freedom of the press and literature. The authors come from various parts of the world and present a wide range of profiles, including prominent political figures, EU officials, academics, magistrates and journalists. The book was coordinated by Dr. Christiane Höhn, Principal Advisor to Gilles de Kerchove, Isabel Saavedra, his Personal Assistant and Prof. Anne Weyembergh, Professor at the Université libre de Bruxelles (ULB).

Available in PDF, EPUB and Kindle. Book excerpt: Reparation for victims of gross and systematic human rights violations is a contemporary issue gaining increased attention in both national and international politics. Post-conflict societies have to face the legacies of the dark past and dealing with a large group of victims is one of them. Transitional justice mechanisms trying to cope with the past should not overlook the issue of reparation. This research demonstrates how reparation for victims of gross and systematic human rights violations differs from reparation for isolated violations. The Rwandan case study unveils the role of victim organisations in and the competition and politicisation of the reparation debate. Although reparation for victims is a crucial element in transitional justice, it becomes clear that the way in which the reparation debate unfolds does not necessarily contribute to the peaceful future of a post-conflict society. This study argues that remedying the process and debate of the search for reparation will lead to an improved and more constructive reparation policy. Heidy Rombouts is a legal and social scientist (1997, Master of Laws; 1999, Master in Social and Political Sciences, Catholic University of Leuven). In 2004 she obtained a PhD degree in Social and Political Sciences at the University of Antwerp for her research on victim organisations and the politics of reparation. For several years she has been conducting research on transitional justice, human rights and post-conflict situations, including extensive field research in South Africa and Rwanda.

Book excerpt: The Annotated Digest of the International Criminal Court (2004-2006) is the first volume of an annual or biennial series, depending on the volume of decisions issued. It compiles a selection of the most significant legal findings contained in the public decisions rendered by the International Criminal Court since its first decisions in July 2004 until 31 December 2006. More than 230 decisions have been reviewed for the preparation of the present volume. The criteria for selection of the abstracts are: 1) abstracts which clarify a point of law, interpret a rule; 2) abstracts which show how a specific rule is applied by a Chamber; 3) abstracts which are otherwise meaningful with respect to international justice, human rights, international humanitarian law. The abstracts are quoted in their original language, namely English or French. An English translation of the French abstracts is given. The abstracts are inserted after the relevant articles of the Statute, Rules of Procedure and Evidence and Regulations of the Court, with a short description/summary of their precise topic. A quick reference system makes it easy to refer to other decisions quoted elsewhere in the Digest.

Written in a readily accessible style, this guide provides a firm grounding in relevant legal doctrine, essential advocacy techniques and valuable multidisciplinary perspectives. Drawing upon global expertise from legal practitioners, specialist advocacy trainers and multi-disciplinary writers, this book addresses both practical considerations and key challenges faced by ICC victim advocates. These include issues such as gender, child victims, victims of sexual violence, special need victims and victims who are themselves implicated in international crimes. Through its practical focus on advocacy techniques, hypothetical case studies, checklists, interviews from the field and lists of further resources, this manual equips readers with the knowledge and skills necessary to engage in sophisticated ICC victim advocacy. This book will also appeal to those interested in the workings of International Criminal Law and in victim advocacy and victimology more broadly.

Available in PDF, EPUB and Kindle. Book excerpt: This book is a guide to the law and practice of victims’ roles before the International Criminal Court, the Extraordinary Chambers in the Courts of Cambodia and the Special Tribunal for Lebanon. The various chapters focus on the provisions relevant to victim participation at these courts and the case law interpreting and applying those provisions. The book thus informs the reader on the principal ways in which the relevant practice is developing, the distinct avenues taken in the application of similar provisions as well as the ensuing advantages and challenges. Unlike other volumes focusing on relevant academic literature, this volume is written mainly by practitioners and is addressed to those lawyers, legal advisers and victimologists who work or wish to work in the field of victim participation in international criminal justice. Kinga Tibori-Szabó is legal officer for the Kosovo Specialist Chambers in The Hague and has previously worked for the Legal Representative of Victims at the Special Tribunal for Lebanon. Megan Hirst is a barrister at Doughty Street Chambers in London and has worked on victims' participation issues in the Registries of the International Criminal Court and the Special Tribunal for Lebanon, as well as in an LRV team in Prosecutor v. Dominic Ongwen.
