Book excerpt: La présente thèse analyse les solutions apportées par la Communauté internationale, certaines communautés régionales et certains États aux problèmes des minorités. Elle porte une attention plus particulière à celle qui vise à accorder aux minorités un "droit de participation" à la "vie de l'État", qu'elle soit culturelle, sociale, économique ou publique. Elle tente de démontrer que la reconnaissance et la mise en oeuvre de cette solution, par une organisation étatique et des mécanismes institutionnels adaptés aux différentes situations minoritaires, sont seules susceptibles d'assurer la survie des minorités, le maintien de la diversité culturelle et la justice au sein des États. La première partie dresse un portrait des différentes situations minoritaires possibles et relève leur grande complexité. Elle précise les deux droits parallèles qui ont été élaborés, au niveau international et régional, pour répondre aux problèmes découlant de ces situations, à savoir le "droit des minorités" et le "droit des peuples autochtones". Elle souligne que ceux-ci ont principalement mis l'accent sur la "protection" des groupes ou de leurs membres, mais que cette protection ne permet pas toujours d'assurer la survie des minorités ni de répondre à tous leurs besoins, notamment en ce qui concerne leur "participation". Elle tente toutefois de démontrer que le libelle de certains instruments internationaux confirme le désir grandissant de la Communauté internationale d'envisager l'évolution de l'actuel régime de "protection" des minorités vers la reconnaissance d'un véritable droit collectif de "participation". La deuxième partie analyse les réponses données par les États, dans leur ordre juridique interne, à la problématique des situations minoritaires existantes sur leur territoire. Elle constate que la majorité des États a choisi de mettre en place des politiques qui assurent la seule "protection" des minorités, mais qu'un nombre significatif d'États a accepté d'adopter des politiques supplémentaires visant à garantir aux minorités une certaine "participation" à la "vie de l'État". À l'aide d'exemples de mécanismes institutionnels, non exhaustifs mais significatifs, elle tente de démontrer l'existence d'une certaine pratique des États qui confirme l'émergence d'un "droit de participation" des minorités en droit international et qui atteste, du même coup, de la variété des solutions "intégratives" et "autonomistes" envisageables pour le mettre en oeuvre. Cette étude suggere, en définitive, une réflexion sur la nécéssité de revoir la conception traditionnelle de l'État et l'aménagement des pouvoirs.

The editors, both members of the International Academy of Language Law / Acad‚mie internationale de droit linguistique, brought together presentations that deal with language legislation and practices in Europe, Asia, Africa and North America. The contributions show that the post-communist trend in language policy has been vastly represented by attempts to eliminate the language, and even the cultural legacy, of the formerly hegemonic nation/s in countries emerging after the collapse of the system. In doing so officials in these countries tend to link the harmonisation of a diverse society with the idea of homogenising its population, and prioritising the cultural legacy of the titular nation. In contrast, some post-colonial countries are more tolerant of the language of their colonisers but consequently do not sufficiently promote the institutionalisation of their indigenous languages.ÿ Furthermore, the absence of visible efforts to follow any legal pattern in this regard often result in a communication gap between government and the various communities. In pursuit of societal harmony therefore challenges from different perspectives the populist notion of ?one nation-one language?, revealing the inherent shortcomings of attempting to establish unity through something as abstract as language without constructively addressing the actual, and mostly gross, inequalities and resulting divisions in many societies. The contributions to this Proceedings suggest that by pursuing social harmony through an alleged common language many countries unwittingly emphasise social inequalities and division and even cultivate the basis for resistance. Scholars that work in the field of language legislation and the sociology of language and readers interested in comparative studies will find the collection of papers presented in this Proceedings an interesting read.ÿ

Book excerpt: This book offers a comprehensive, highly informative and interdisciplinary study on territorial integrity and the challenges globalization, self-determination and external interventions present. This study aims at not only to fill an epistemological gap in this regard, but also answer the question of whether International Law is adequately equipped to help states address these challenges. The author argues that the biggest threat that many states are confronted with today is their disintegration rather than their obsolescence, and that International Law has not often been able to prevent that eventuality. In fact, states, when they were not destroyed by war, managed to survive, thanks to the flexibility of territoriality, i.e. their ability to adjust to difficult situations as they arose. It is this understanding of adaptation that urges an increasing number of states today to revive territorial autonomy and restore an original understanding of self-determination in which democracy is a pivotal factor in establishing congruence between the states and their nations. While this move is endorsed by International Law, it is not the case for globalization; for their own sake, proponents of globalization should recognize that the states are irreplaceable as long as they remain the sole providers of protection for their peoples.
