Book excerpt: The attacks of September 11, 2001, the US response and the international community's approval of the subsequent military action represent a new paradigm in the international law relating to the use of force. Previously, acts of terrorism were seen as criminal acts carried out by private, non-governmental entities. In contrast, the September 11 attacks were regarded as an act of war which marked a turning point in international relations and law. This exceptional and timely volume examines the use of force in the war against terror. The work is based on the central theme that the use of force is visibly enrolled in a process of change and it evaluates this within the framework of the uncertainty and indeterminacy of the UN Charter regime. The status of pre-emptive self-defence in international law and how it applies to US policy towards rogue states is examined along with the use of military force, including regime change, as an acceptable trend in the fight against state-sponsored terrorism.

Book excerpt: No aircraft disaster in history has produced the amount of legal wrangling as the bombing of Pan Am Flight 103 over Lockerbie, Scotland, on December 21, 1988, in which 259 passengers and crew members and 11 people on the ground were killed. The Lockerbie families wanted justice in the name of their relatives that died in the aircraft, but only in 1996 did the US Administration and Congress amend the Foreign Sovereign Immunities Act with the Anti-Terrorism and Effective Death Penalty Act that allowed civil actions against Libya. Libya was finally served, under the provisions of the Act, in 1997, and answered the complaints, asserting in its answers that the underlying statute was unconstitutional. One area of the Lockerbie litigation was the unusual use by Libya of an international treaty called The Montreal Convention of 1971 for the Suppression of Unlawful Acts against the Safety of Civil Aviation. The purpose of this treaty was to prevent attacks against civil aircraft and provide for cooperation between countries when there has been such an attack and to provide appropriate measures to punish offenders. It was not meant to give jurisdiction over criminal proceedings to the country of the alleged wrongdoer. This book contains legal materials related to the Lockerbie Trial and examines this landmark case in international criminal law. (Series: International Courts and Tribunals Cases - Vol. 4)

Available in PDF, EPUB and Kindle. Book excerpt: Of all the countries in North Africa and the Middle East, less has been known about Libya for decades. Only recently have we begun to appreciate the complexity of Libya’s turbulent past, including the revolution in 2011 in which demands for better living conditions and more job opportunities led to widespread protests. When the Muammar al-Qaddafi regime responded with force to these peaceful protests, killing scores of unarmed civilians, the protesters called for regime change. In what came to be known as the February 17 Revolution, the 42-year-old Qaddafi regime was overthrown, and Qaddafi was killed in October 2011. Over the next decade, Libya endured a series of interim, transitional governments in a prolonged struggle to draft a new constitution and to elect a democratic national government. Historical Dictionary of Libya, Sixth Edition contains a chronology, an introduction, and an extensive bibliography. The dictionary section has more than 500 cross-referenced entries on important personalities as well as aspects of the country’s politics, economy, foreign relations, religion, and culture. This book is an excellent resource for students, researchers, and anyone wanting to know more about Libya.

Book excerpt: President Bill Clinton called it "an attack against America," but after Libyan agents planted a bomb aboard Pan Am Flight 103, killing 259 people in the air and 11 on the ground, America did not strike back. Instead, the grieving relatives of the victims did the unthinkable—as mere civilians-and tried to force Libya to pay for its crime. Lawyers told the families that they could never sue Libya in American courts, and they were right. This would require changing a bedrock principle of international law—a change that every government in the world feared and fought, including the United States itself. Working virtually alone at first, Allan Gerson, a former diplomat and prosecutor of Nazi war criminals, took on the case and spent the next eight years on the families’ quest for justice. In this high-stakes game of international power politics and legal maneuvering, there were friendships, jobs, and reputations lost, but a precious principle—that of accountability under the law—was strengthened and preserved. Now Gerson and his co-author, Newsweek writer Jerry Adler, follow the threads of this extraordinary tale back to that deadly night over Lockerbie, Scotland—and forward into a new era of international justice, when terrorists will learn to fear the righteous retribution of their own victims.

Available in PDF, EPUB and Kindle. Book excerpt: The bombings of the Murrah Federal Building in Oklahoma City and of the World Trade Center in New York City have joined a long history of terrorists acts against the United States. In this newly updated edition of his book, Jeffrey Simon reaches back to the founding days of the Republic to tell a story that is both instructive and alarming. Simon uncovers the dynamics of a deadly conflict that affects all Americans. His in-depth interviews with terrorists and their victims, with reporters, government officials, and others bring to life a tale of presidents and terrorists, media and society, all entangled in a drama of international violence. The Terrorist Trap traces the government response to terrorism from the days of Thomas Jefferson and the Barbary Pirates to William Jefferson Clinton's confrontation with homegrown terrorism. It explores the terrorist trap: the psychological, political, and social elements that make terrorism unlike any other conflict. With the end of the Cold War and the defeat of Saddam Hussein's army in the Gulf War, many believed that the threat of terrorism had been significantly reduced. But Simon shows how terrorism grows out of political, economic, and social grievances that can never be fully resolved, as events in Israel and elsewhere continue to demonstrate. Living with terrorism will be an inescapable part of life in the twenty-first century. Simon calls on officials to move away from the useless rhetoric of defeating terrorism and to focus instead on achievable goals in combating this global problem.

Available in PDF, EPUB and Kindle. Book excerpt: Six years after publication of the first edition of the best-selling Encyclopedia of Terrorism, much has changed on the national security scene. Despite the dark promises of Osama bin Laden following the 9/11 attacks, the United States has not experienced any major domestic terror incidents. Al-Qaeda itself is believed to be a severely crippled organization. But while U.S. wars in Afghanistan and Iraq--not to mention the arrival of the Obama administration, a new balance of power within Congress, and an increasingly fragile economic picture--have significantly affected the national security picture, the threat of economic chaos and massive loss of life due to terror attacks has not abated. Indeed, in July 2008 analysts pointed out that even a relatively small terrorist organization could present a dire threat, with some experts arguing that a biological, chemical, or even nuclear attack on a major U.S. city is all but inevitable. In this highly charged, rapidly shifting environment, we are pleased to present the The SAGE Encyclopedia of Terrorism, Second Edition, a thoroughly updated and expanded edition of the original, highly regarded reference work. Nearly 100,000 words of new material will be added, along with fully updated original entries, and expanded coverage. New introductory essays will explore the impact of terrorism on economics, public health, religion, and even pop culture. Ethical issues such as the role of torture in interrogations, competing notions of security versus liberty, and the debates over FISA legislation and Guantanamo Bay will also be covered. Two dozen entries on significant recent events—such as the London bombings, Chechen attacks on Russian interests, and the rescue of Ingrid Bettancourt—and some 60 additional new entries will restore the work as an up-to-the-minute, natural first-stop for researchers.
