Elles n’informent pas sur l’État, mais le constituent. Non seulement elles fournissent la justification des décisions fondamentales concernant l’organisation de l’État, mais elles produisent les concepts sans lesquels les décisions fondamentales de l’État ne pourraient même pas être énoncées. Aussi ne peuvent-elles se comprendre que dans leur rapport au discours juridique et au droit. Les concepts de la « théorie de l’État » sont d’abord et avant tout des concepts juridiques, dont l’apparition et le développement résultent des transformations du droit, c’est-à-dire en définitive de l’État lui-même. C’est pourquoi la théorie générale de l’État ne peut être que la théorie de ces théories et non celle d’un objet empirique extérieur. Elle doit se construire comme métathéorie juridique. Une théorie juridique de l’État ainsi conçue doit être distinguée de quelques disciplines voisines. Il s’agit d’abord de la théorie générale de l’État, telle qu’on la concevait en Allemagne au xixe siècle, métaphysique et normative, confondue avec son objet, qui entendait prolonger la philosophie politique classique pour contribuer au perfectionnement et au progrès de l’État. Elle est aussi distincte d’une science politique descriptive, d’inspiration sociologique, dont l’objet n’est pas l’État, mais le pouvoir poli-tique, appréhendé indépendamment de la forme juridique dans laquelle il s’exerce. Mais elle ne saurait davantage se confondre avec une Histoire des idées, qui ne percevrait pas le rapport des théories aux pratiques juridiques. La tâche de la théorie juridique de l’État n’est pas de pénétrer une quelconque nature de l’État ni de produire des justifications, mais de rechercher la relation entre ce système de principes et de concepts et la structure générale du système juridique. Il s’agit pour la théorie juridique de l’État, au lieu d’analyser l’État au moyen des théories de l’État, de comprendre les théories de l’État, c’est-à-dire l’État, par le droit. Les études réunies dans ce volume portent à la fois sur la méthodologie de la science du droit et sur quelques-unes de ces « théories » de l’État, parmi les plus importantes : définition de l’État, séparation des pouvoirs, sources du droit, constitutionnalisme, fonctions de l’État, théorie de l’interprétation.

Despite the decisive steps forward made since the Second World War, the process of European unification has come to a standstill at a political and institutional level. Issues and problems which were already the subject of debate among the pioneers of Europeanism between the two wars have still to be addressed. Although at the time their proposal as a whole went unheeded, with destructive consequences for peace and for Europe, this valuable legacy of ideals has nevertheless guaranteed a continuity and a subsequent blossoming. The purpose of this book is to examine a series of ideas, initiatives and programmes which, between the two World Wars, aimed to promote the maintenance of a pacified international order, starting from the crucial European context. What emerges is a significant and transversal humus, that countered the inexorably prevailing tendencies in politics and institutions, and even in society. Its exponents operated in international organisations, in parties, and in movements and associations not necessarily of a political stamp, as well as in historiography, literature, theatre, cinema and sport, laying the foundations for a rebirth of peaceful co-existence at European and international level.

It is however possible to provide an overview of the main debates among states, other international actors or among legal scholars relating to the interpretation of the main rules of international law. In the book, these debates are illustrated by references to popular culture, in particular, music and films. The ambition of this book is to enable the reader, on the basis of these elements, firstly to position himself or herself by selecting and defending the arguments that seem most convincing and secondly, and more fundamentally, to understand the legal and political terms of the controversies in international law. This revised second edition includes updates in case law and practice, from the war in Ukraine to the war in Gaza, as well as legal developments related to climate change.
