Book Synopsis Rights, Race, and Reform by : Kristin Henning
Download or read book Rights, Race, and Reform written by Kristin Henning and published by Routledge. This book was released on 2018-05-08 with total page 319 pages. Available in PDF, EPUB and Kindle. Book excerpt: In 1962, a 15-year-old Arizona boy named Gerald Gault may or may not have made a lewd phone call to a neighbor. Gerald was arrested, prosecuted, removed from his parents’ custody, and sent to a juvenile prison, all without legal representation. Gerald’s mother’s outrage at the treatment of her son eventually propelled the case to the United States Supreme Court. With its sweeping 1967 decision in In re Gault, the Court revolutionized the American juvenile court system by finding that children charged with delinquency have a constitutional right to counsel. This anthology, which commemorates the fiftieth anniversary of the Gault decision, blends, across its three parts, legal and historical analyses, oral history, and personal narrative to provide an overview of modern Supreme Court juvenile justice jurisprudence, the advocates and organizations that defend children in juvenile court, the role these lawyers have played in the fight for justice for accused children, and the contemporary challenges facing juvenile defenders and their clients. The authors are leading juvenile justice reformers, advocates, and scholars, all of whom have been deeply involved in shaping modern juvenile justice policy and practice and most of whom have represented children in juvenile court. This book is for everyone concerned about justice in America. The personal narratives about children in the system will intrigue students and academics, engage lay individuals who are interested in children’s rights, and guide professionals, legislators, and other policymakers involved in juvenile justice reform and criminology.
Book Synopsis The Mexican American Experience by : Matt S. Meier
Download or read book The Mexican American Experience written by Matt S. Meier and published by Bloomsbury Publishing USA. This book was released on 2003-12-30 with total page 488 pages. Available in PDF, EPUB and Kindle. Book excerpt: Mexican Americans are rapidly becoming the largest minority in the United States, playing a vital role in the culture of the American Southwest and beyond. This A-to-Z guide offers comprehensive coverage of the Mexican American experience. Entries range from figures such as Corky Gonzales, Joan Baez, and Nancy Lopez to general entries on bilingual education, assimilation, border culture, and southwestern agriculture. Court cases, politics, and events such as the Delano Grape Strike all receive full coverage, while the definitions and significance of terms such as coyote and Tejano are provided in shorter entries. Taking a historical approach, this book's topics date back to the 1848 Treaty of Guadalupe Hidalgo, a radical turning point for Mexican Americans, as they lost their lands and found themselves thrust into an alien social and legal system. The entries trace Mexican Americans' experience as a small, conquered minority, their growing influence in the 20th century, and the essential roles their culture plays in the borderlands, or the American Southwest, in the 21st century.

Book Synopsis Reverberations of Racial Violence by : Sonia Hernández
Download or read book Reverberations of Racial Violence written by Sonia Hernández and published by University of Texas Press. This book was released on 2021-06-15 with total page 323 pages. Available in PDF, EPUB and Kindle. Book excerpt: Between 1910 and 1920, thousands of Mexican Americans and Mexican nationals were killed along the Texas border. The killers included strangers and neighbors, vigilantes and law enforcement officers—in particular, Texas Rangers. Despite a 1919 investigation of the state-sanctioned violence, no one in authority was ever held responsible. Reverberations of Racial Violence gathers fourteen essays on this dark chapter in American history. Contributors explore the impact of civil rights advocates, such as José Tomás Canales, the sole Mexican-American representative in the Texas State Legislature between 1905 and 1921. The investigation he spearheaded emerges as a historical touchstone, one in which witnesses testified in detail to the extrajudicial killings carried out by state agents. Other chapters situate anti-Mexican racism in the context of the era's rampant and more fully documented violence against African Americans. Contributors also address the roles of women in responding to the violence, as well as the many ways in which the killings have continued to weigh on communities of color in Texas. Taken together, the essays provide an opportunity to move beyond the more standard Black-white paradigm in reflecting on the broad history of American nation-making, the nation’s rampant racial violence, and civil rights activism.
Book Synopsis The South China Sea Arbitration by : Yoshifumi Tanaka
Download or read book The South China Sea Arbitration written by Yoshifumi Tanaka and published by Bloomsbury Publishing. This book was released on 2019-11-28 with total page 320 pages. Available in PDF, EPUB and Kindle. Book excerpt: Beyond the scope of the dispute settlement between the Philippines and China, the South China Sea arbitral award can be thought to significantly influence the development of international law and the law of the sea. Accordingly, this book seeks to examine the South China Sea arbitration from the perspective of the development of public international law and its limitations. Specifically it addresses the issues of jurisdiction of the Annex VII Arbitral Tribunal, the historic rights, the legal status of maritime features, the lawfulness of various activities of China, and the role of the South China Sea arbitration in the international dispute settlement. In considering these issues, this book examines the South China Sea arbitration in three respects: (i) the clarification of relevant rules and obligations under the UN Convention on the Law of the Sea as well as international law, (ii) the protection of community interests at sea, and (iii) considerations of time elements in international law.
Book Synopsis Hague Yearbook of International Law / Annuaire de La Haye de Droit International, Vol. 24 (2011) by : Nikolaos Lavranos
Download or read book Hague Yearbook of International Law / Annuaire de La Haye de Droit International, Vol. 24 (2011) written by Nikolaos Lavranos and published by BRILL. This book was released on 2017-06-01 with total page 458 pages. Available in PDF, EPUB and Kindle. Book excerpt: The title of the Hague Yearbook of International Law reflects the close ties which have always existed between the AAA and the City of The Hague with its international law institutions, and indicates the Yearbook’s aim of devoting attention to developments taking place in the international law institutions based in The Hague. However, the Yearbook has a broader scope as well: to offer a platform for review of new developments in the field of international law. As of the 2010 Volume, the Yearbook will be compiled by a new and expanded Editorial Board, offering fresh ideas and a new approach. A newly established Advisory Board has also been added, including ICJ Judge Bruno Simma, Serge Brammertz, Prosecutor of the International Criminal Tribunal for the Former Yugoslavia (ICTY), Jacomijn J. van Haersolte-van Hof, advocate (advocaat) at HaersolteHof and arbitrator (The Netherlands) and Professor Peter Hilpold, Innsbruck University (Austria). Sections have been created on public international law, private international law, international investment law and international criminal law, containing in-depth articles on current issues. The breadth of the Yearbook’s content thus offers an interesting and valuable illustration of the dynamic developments in the various sub-areas of international law.
Book Synopsis Up Against the Wall by : Edward S. Casey
Download or read book Up Against the Wall written by Edward S. Casey and published by University of Texas Press. This book was released on 2014-09-01 with total page 313 pages. Available in PDF, EPUB and Kindle. Book excerpt: As increasing global economic disparities, violence, and climate change provoke a rising tide of forced migration, many countries and local communities are responding by building walls—literal and metaphorical—between citizens and newcomers. Up Against the Wall: Re-imagining the U.S.-Mexico Border examines the temptation to construct such walls through a penetrating analysis of the U.S. wall at the U.S.-Mexico border, as well as investigating the walling out of Mexicans in local communities. Calling into question the building of a wall against a friendly neighboring nation, Up Against the Wall offers an analysis of the differences between borders and boundaries. This analysis opens the way to envisioning alternatives to the stark and policed divisions that are imposed by walls of all kinds. Tracing the consequences of imperialism and colonization as citizens grapple with new migrant neighbors, the book paints compelling examples from key locales affected by the wall—Nogales, Arizona vs. Nogales, Sonora; Tijuana/San Diego; and the lower Rio Grande Valley of Texas. An extended case study of Santa Barbara describes the creation of an internal colony in the aftermath of the U.S. conquest of Mexican land, a history that is relevant to many U.S. cities and towns. Ranging from human rights issues in the wake of massive global migration to the role of national restorative shame in the United States for the treatment of Mexicans since 1848, the authors delve into the broad repercussions of the unjust and often tragic consequences of excluding others through walled structures along with the withholding of citizenship and full societal inclusion. Through the lens of a detailed examination of forced migration from Mexico to the United States, this transdisciplinary text, drawing on philosophy, psychology, and political theory, opens up multiple insights into how nations and communities can coexist with more justice and more compassion.
Book Synopsis The United Nations Convention Against Corruption by : Cecily Rose
Download or read book The United Nations Convention Against Corruption written by Cecily Rose and published by Oxford University Press. This book was released on 2019-01-24 with total page 699 pages. Available in PDF, EPUB and Kindle. Book excerpt: The United Nations Convention against Corruption includes 71 articles, and takes a notably comprehensive approach to the problem of corruption, as it addresses prevention, criminalization, international cooperation, and asset recovery. Since it came into force more than a decade ago, the Convention has attracted nearly universal participation by states. As a global and comprehensive convention, which establishes new rules in several areas of anti-corruption law and helps shape domestic laws and policies around the world, this treaty calls for scholarly study. This volume helps to fill a gap in existing academic literature by providing an invaluable reference work on the Convention. It provides systematic coverage of the treaty, with each chapter discussing the relevant travaux préparatoires, the text of the final article, comparisons with other anti-corruption treaties, and available information about domestic implementing legislation and enforcement. This commentary is designed to serve as a reference work for academics, lawyers, and policy-makers working in the anti-corruption field, and in the fields of transnational criminal law and domestic criminal law. Contributors include anti-corruption experts, scholars, and legal practitioners from around the globe.
