The extent to which European integration is influenced by this phenomenon is discussed in more detail in this paper. Also, the effect of a free trade agreement similar to the CETA, as a solution for Brexit and to counter political separatism. In addition to free trade and the abolition of customs duties, this solution also has negative consequences, provided that no concessions are made to the UK, especially in the area of services. These would have to be taken in order to respect the different economic structure of the UK compared to Canada. The traditional CETA would therefore have to be modified for the UK, which makes a CETA+ quite conceivable. Whether and to what extent Brussels will make concessions to the UK will have to be observed in the future. Already in January 2013 the British Prime Minister David Cameron has promised to renegotiate the European integration of the United Kingdom in a referendum. On 23 June 2016 it was followed by what many, not even the Brexit supporters, had seriously reckoned: In a referendum, 51.9% of the members voted in favour of leaving the EU. This triggered an unprecedented process in the history of European integration - differentiated disintegration. The day after the election, Europe was in turmoil, as can be seen from the following statements: Donald Tusk, President of the European Council, spoke of a "historic moment, but certainly not the time for hysterical reactions". Federal Chancellor Angela Merkel explained the result not only as a "cut for Europe", but also as a "cut for the European unification process".

Book excerpt: A product is originating if it has been wholly obtained within the meaning of Article 4, has been produced from only originating materials or has undergone sufficient production on nonoriginating materials within the meaning of Article 5. As long as the production is more than "insufficient" (according to Article 7), a product has undergone sufficient production (according to Article 5) when the conditions in Annex 5 are fulfilled. These conditions and rules are called Product Specific Rules (PSR) or list rules. The list rules specify what type of working or processing is required to be carried out on nonoriginating materials in order for the product to obtain originating status. The more commonly used and known list rules are a change in tariff classification e.g. change of tariff heading (CTH), change of tariff sub-heading (CTSH) etc., value added of nonoriginating materials or a specific processing which must be undertaken. In CETA the name and description of the list rules are different to those in other EU free trade agreements. This document provides guidance on how to interpret the list rules in CETA by providing the following information: (1) the list rule in CETA; (2) a short explanation of the list rule together with an example in CETA of a product by Harmonised System (HS) where the rule applies; (3) a comparison to the same type of rule referred to in other Free Trade Agreements (FTA), e.g. PEM convention. In the introductory notes to Annex 5 definitions and descriptions are provided.

To do so, it first examines the root causes behind the legitimacy crisis, ultimately arguing that it reflects a fundamental rule of law crisis within investment arbitration. In particular, it asserts that the normative standpoints of the legitimacy crisis form part of the rule of law, the uniting legal principle from which the legitimacy concerns stem. The book contends that the rule of law is not only the principal normative and causal assumption on which the legitimacy concerns are based, but that it could also be utilized as a platform to evaluate the investment arbitration mechanism in CETA's Investment Chapter. Based on this, the book evaluates CETA's Investment Chapter through the rule of law framework in order to provide a convincing account of the latter's ability to overcome the legitimacy crisis facing investment arbitration. It concludes that CETA's Investment Chapter is unlikely to completely solve the legitimacy crisis simply because it is just a patchwork of reforms rather than a comprehensive reinvention of the substantive and procedural law of investment arbitration. Lastly, the book offers meaningful insights into the way the challenges presented by investment arbitration should be addressed. The book is intended for academics researching international investment law and arbitration as well as for policy-makers focusing on reforming investor-state dispute settlement.
