Available in PDF, EPUB and Kindle. Book excerpt: This volume retraces Carl Lutz’s diplomatic wartime rescue efforts in Budapest, Hungary, through the lens of Jewish eyewitness testimonies. Together with his wife, Gertrud Lutz-Fankhauser, the director of the Palestine Office in Budapest, Moshe Krausz, fellow Swiss citizens Harald Feller, Ernst Vonrufs, Peter Zürcher, and the underground Zionist Youth Movement, Carl Lutz led an extensive rescue operation between March 1944 and February 1945. It is estimated that Lutz and his team of rescuers issued more than 50,000 lifesaving letters of protection (Schutzbriefe) and placed persecuted Jews in 76 safe houses—annexes of the Swiss Legation. Based on interviews with Holocaust survivors in Canada, Hungary, Israel, Switzerland, the UK, and the United States, this volume shines a light on the extraordinary scope and scale of Carl Lutz’s humanitarian response.

Available in PDF, EPUB and Kindle. Book excerpt: This four-volume set provides reference entries, primary documents, and personal accounts from individuals who lived through the Holocaust that allow readers to better understand the cultural, political, and economic motivations that spurred the Final Solution. The Holocaust that occurred during World War II remains one of the deadliest genocides in human history, with an estimated two-thirds of the 9 million Jews in Europe at the time being killed as a result of the policies of Adolf Hitler and Nazi Germany. The Holocaust: An Encyclopedia and Document Collection provides students with an all-encompassing resource for learning about this tragic event—a four-book collection that provides detailed information as well as multidisciplinary perspectives that will serve as a gateway to meaningful discussion and further research. The first two volumes present reference entries on significant individuals of the Holocaust (both victims and perpetrators), anti-Semitic ideology, and annihilationist policies advocated by the Nazi regime, giving readers insight into the social, political, cultural, military, and economic aspects of the Holocaust while enabling them to better understand the Final Solution in Europe during World War II and its lasting legacy. The third volume of the set presents memoirs and personal narratives that describe in their own words the experiences of survivors and resistors who lived through the chaos and horror of the Final Solution. The last volume consists of primary documents, including government decrees and military orders, propaganda in the form of newspapers and pamphlets, war crime trial transcripts, and other items that provide a direct look at the causes and consequences of the Holocaust under the Nazi regime. By examining these primary sources, users can have a deeper understanding of the ideas and policies used by perpetrators to justify their actions in the annihilation of the Jews of Europe. The set not only provides an invaluable and comprehensive research tool on the Holocaust but also offers historical perspective and examination of the origins of the discontent and cultural resentment that resulted in the Holocaust—subject matter that remains highly relevant to key problems facing human society in the 21st century and beyond.

Book excerpt: A timely guide to the complex financial markets and banking secrecy of Switzerland Since 1934, when Switzerland's federal bank secrecy law was passed, the line between myth and reality with regard to Swiss banking has been blurred. But over the past decade, there have been dramatic changes in the pressures brought to bear on all facets of the Swiss financial markets and banking sector. Recent developments and agreements have potentially weakened Swiss banking secrecy, and with that said, it is time for a book that lays out the history of Swiss bank secrecy and puts these twenty-first century changes in perspective. Swiss Finance is a thorough overview of the Swiss financial markets and the banking secrecy this country has become known for. It covers key topics to practitioners both abroad and in the United States involved in Swiss banking and the Swiss financial markets. Discusses what the Euro-debt crisis may mean for the role of Switzerland as a financial powerhouse Reveals how new secrecy agreements with the United States and Germany will impact private wealth management Addresses Asian competition for wealth management and tax havens Switzerland is one of the largest financial markets in the world and a global power in private wealth administration. Available in PDF, EPUB and Kindle. Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this practical analysis of sports law in Switzerland deals with the regulation of sports activity by both public authorities and private sports organizations. The growing internationalization of sports inevitably increases the weight of global regulation, yet each country maintains its own distinct regime of sports law and its own national and local sports organizations. Sports law at a national or organizational level thus gains a growing relevance in comparative law. The book describes and discusses both state-created rules and autonomous self-regulation regarding the variety of economic, social, commercial, cultural, and political aspects of sports activities. Self- regulation manifests itself in the form of by-laws, and encompasses organizational provisions, disciplinary rules, and rules of play. However, the trend towards more professionalism in sports and the growing economic, social and cultural relevance of sports have prompted an increasing reliance on legal rules adopted by public authorities. This form of regulation appears in a variety of legal areas, including criminal law, labour law, commercial law, tax law, competition law, and tort law, and may vary following a particular type or sector of sport. It is in this dual and overlapping context that such much-publicized aspects as doping, sponsoring and media, and responsibility for injuries are legally measured. This monograph fills a gap in the legal literature by giving academics, practitioners, sports organizations, and policymakers access to sports law at this specific level. Lawyers representing parties with interests in Switzerland will welcome this very useful guide, and academics and researchers will appreciate its value in the study of comparative sports law.

Available in PDF, EPUB and Kindle. Book excerpt: Data, in its raw or unstructured form, has become an important and valuable economic asset, lending it the sobriquet of ‘the oil of the twenty-first century’. Clearly, as intellectual property, raw data must be legally defined if not somehow protected to ensure that its access and re-use can be subject to legal relations. As legislators struggle to develop a settled legal regime in this complex area, this indispensable handbook will offer a careful and dedicated analysis of the legal instruments and remedies, both existing and potential, that provide such protection across a wide variety of national legal systems. Produced under the auspices of the International Association for the Protection of International Property (AIPPI), more than forty of the association’s specialists from twenty-three countries worldwide contribute national chapters on the relevant law in their respective jurisdictions. The contributions thoroughly explain how each country approaches such crucial matters as the following: if there is any intellectual property right available to protect raw data; the nature of such intellectual property rights that exist in unstructured data; contracts on data and which legal boundaries stand in the way of contract drafting; liability for data products or services; and questions of international private law and cross-border portability. Each country’s rules concerning specific forms of data – such as data embedded in household appliances and consumer goods, criminal offence data, data relating to human genetics, tax and bank secrecy, medical records, and clinical trial data – are described, drawing on legislation, regulation, and case law. A matchless legal resource on one of the most important raw materials of the twenty-first century, this book provides corporate counsel, practitioners and policymakers working in the field of intellectual property rights, and concerned academics with both a broad-based global overview on emerging legal strategies in the protection of unstructured data and the latest information on existing legislation and regulation in the area.

Available in PDF, EPUB and Kindle. Book excerpt: This is the first comprehensive English-language overview of competition law enforcement in Switzerland since the introduction of direct sanctions in 2004. It discusses the key issues facing practitioners: horizontal and vertical agreements (with a particular emphasis on distribution agreements), abuse of dominance, and the newly introduced provisions on relative market power and merger control. It also provides an overview of the key procedural provisions, leniency and amicable settlements, and fines. The book subsequently analyses the main differences between Swiss and EU competition law and explains why, to what extent, and how companies should conduct a separate analysis under Swiss law. It offers a comprehensive overview and accessible analysis, based on in-depth research of case law, for practitioners and in-house counsels who need to ensure compliance with competition law on a Swiss, European or international basis. It is also a valuable guide for all practitioners, academics and students interested in understanding Swiss competition law. Enforcement of competition law in Switzerland has intensified and is becoming increasingly important for global companies selling in Switzerland. Moreover, the fines have increased over the last twenty years, and many foreign companies have had to pay substantial fines in recent years. Lastly, the Swiss Federal Supreme Court has now extended the extraterritorial application of Swiss competition law to foreign companies where sales to Switzerland are possible.

Available in PDF, EPUB and Kindle. Book excerpt: The ICRC delegate in Budapest was instructed to act within the strict confines of the Geneva conventions, and his report in early 1944 warning of the immediate danger to the 800,000 Jews should Germany occupy Hungary was still being debated in the ICRC headquarters when the Germans invaded in March. Only in July 1944 did Max Huber, the director of ICRC, write to the Hungarian Regent in reaction to public pressure. The ICRC's attitude reflected that of the Swiss government which was concerned with maintaining neutrality. Concludes that if the ICRC had acted forcefully it would have been much more difficult for the SS and the Hungarians to carry out the deportations. In contrast, the ICRC delegate in Budapest in the latter part of 1944, Friedrich Born, established childrens' homes, took under his protection camps and buildings where Jews were interned, and lodged official objections when violations of this protection occurred.
