Book excerpt: La situación de pérdida de libertad de movimientos consecuencia de la pandemia de la Covid-19 derivó en el aplazamiento de elecciones y ha reabierto el debate en torno a la posibilidad de incorporar el voto electrónico en el ámbito español. Es por ello por lo que nos marcamos como objeto del presente trabajo dar respuesta a varios interrogantes: ¿qué es el voto electrónico? ¿dónde se ha implantado? ¿cuál es la realidad del voto a través de las tecnologías de la información y de la comunicación? A fin de dar respuesta a las anteriores preguntas dedicamos un primer capítulo al estudio de la realidad constitucional de los distintos tipos de votación a través de las tecnologías de la información y de la comunicación. Se estudiarán los principios de sufragio: universalidad, igualdad, secreto, libertad y personalidad del voto; y se propondrá la adaptación de la normativa al siglo XXI, principalmente la creación de una e-LOREG. Igualmente, se abordarán algunas cuestiones sobre por qué se idealizan los sistemas de voto electrónico y cuál es su relación con la confianza en el sistema político en el segundo capítulo. Como consecuencia, se explicarán algunos problemas sistémicos políticos y sociales que ayudarán a entender por qué las bondades del voto electrónico son todavía un mito. Los sistemas de voto electrónico presentan exigentes requisitos de seguridad que serán abordados en el tercer capítulo. Estos requisitos se entrelazan de tal manera que garantizar uno de ellos puede ocasionar que otro deje de cumplirse. ¿Es posible diseñar un sistema de voto electrónico que cumpla todos los requisitos de seguridad haciendo uso de avanzadas técnicas criptográficas? La complejidad del sistema electoral aumentará al incorporar tecnologías de la información que aumentan sus riesgos. En el último capítulo se pone de manifiesto la importancia de la gestión de la ciberseguridad en los procesos en los que intervienen las tecnologías y redes de comunicaciones.

Se utiliza en diversos países desde hace varias décadas y cuenta incluso con una dilatada historia en España, dado que las primeras pruebas piloto se remontan a 1995, durante las elecciones catalanas de tal año. Diversas razones han impedido que se haya implantado de forma plenamente oficial y vinculante, pero se ha aceptado para elecciones de carácter no político, como las universitarias, o en ámbitos privados, como en los colegios profesionales. El voto electrónico exige además una aproximación multidisciplinar ya que, además de los retos cibernéticos, su desarrollo adecuado también depende del marco legal aplicable, de medidas gerenciales apropiadas y, entre otros aspectos, de su adaptación a realidades sociológicas diversas. El libro se aproxima al voto electrónico desde el Derecho. Autores españoles e internacionales analizan, por ejemplo, la protección de los datos personales o del principio de igualdad, la implantación del voto electrónico en estados territorialmente descentralizados, los mecanismos de observación electoral, la jurisprudencia constitucional relevante recaída ya sobre la materia en diversos países o, de modo más general, la relación entre derecho electoral y voto electrónico y sus perspectivas concretas de futuro en España. Todo ello se acompaña de un análisis técnico y otro sociopolítico así como de dos estudio de caso: Noruega, a la sazón una de las referencias principales en el voto por Internet, y Venezuela, donde la administración electoral ha gestionado el voto electrónico en el marco de una aguda polarización política" (4ème de couv.).

Properly implemented, e-voting solutions can increase the security of the ballot, speed up the processing of results and make voting easier. However, the challenges are considerable. If not carefully planned and designed, e-voting can undermine the confidence in the whole electoral process. Technology upgrades in elections are always challenging projects that require careful deliberation and planning. Introducing e-voting is probably the most difficult upgrade as this technology touches the core of the entire electoral process—the casting and counting of the votes. E-voting greatly reduces direct human control and influence in this process. This provides an opportunity for solving some old electoral problems, but also introduces a whole range of new concerns. Consequently, e-voting usually triggers more criticism and opposition and is more disputed than any other information technology application in elections.
