A Trust is governed by, and construed according to, the law of the jurisdiction where it is established, (a) even when enforced elsewhere. Thus a Connecticut beneficiary could not be deprived in New York, by the New York statute forbidding alienation, of the power of pledging stock which he had under the law of Connecticut; (6) and in such matters the decree of the court establishing the trust in the original jurisdiction is conclusive in all jurisdictions; (c) but a trust is invalid if it is contrary to the law or policy of the jurisdiction where it is sought to enforce it. Thus a trust of land for a beneficiary in a jurisdiction where the beneficiary cannot hold land himself is invalid.1 A trust can be enforced wherever the property is itself,2 or wherever personal service can be got on the trustee,8 even though it concern land in another jurisdiction, since the court can commit the trustee for contempt if he refuses to obey its decree, or can appoint a trustee in his place to execute it;4 but if the trust is established by the judicial decree of one State, it will not be enforced by the courts of another State unless it concern real estate in that other State,6 and trusteeship be taken out there.
