Book excerpt: On New Year's Eve, 1939, Elmer Rogers and his wife, Marie, were preparing for bed when a shotgun blast sent buckshot deep into Elmer's rib cage. When Marie ran from the room, screaming for help, a second gunshot erupted. The eldest Rogers child grabbed his baby brother and ran while the middle child clung to the bed frame, paralyzed with terror. The intruders poured coal oil around the house and set fire to the front door before escaping. Within a matter of days, investigators identified several suspects: convicts who had been at a craps game with Rogers the night before. Also at the craps game was a young black farmer named W. D. Lyons. As anger at authorities grew, political pressure mounted to find a villain. The governor's representative settled on Lyons, who was arrested, tortured into signing a confession, and tried for the murder. The NAACP's new Legal Defense and Education Fund sent its young chief counsel, Thurgood Marshall, to take part in the trial. They must be so, because the value that underlies them both is respect; and respect takes no compromise. Thus, in the search for truth as in the search for justice, a body of evidence that imposes a statistical compromise will not do. Only evidence that in principle allows reaching the truth and doing justice is good evidence. Once such evidence has been traced, the burden is on us to make good use of the evidence and reach truth and justice. We might or might not succeed, but once we have done our best on evidence that allows success, our judgements are justified; and as such, they can resolve conflicts over the truth and over justice.

In a binary system, there is a single evidential threshold, or standard of proof. If the standard is met, the verdict is 'guilty', the defendant is convicted, and punishment is permitted. If the standard is not met, the verdict is 'not guilty', the defendant is acquitted, and punishment is forbidden. There is no middle ground between the verdict of 'not guilty' and that of 'guilty'. An intermediate verdict represents such middle ground, intermediate between acquittal and conviction both in terms of the strength of the incriminating evidence that is needed to warrant the verdict and in terms of the severity of the consequences that the verdict may produce for the defendant. Justice In-Between is a study of intermediate criminal verdicts and advances a novel justification of such controversial devices, with the aim to produce a consensus amongst scholars subscribing to different theories of punishment. Indeed, the book shows that one cannot investigate the choice of the standard of proof nor, importantly, that of the verdict system, in isolation from the question of the justification for punishing. Justice In-Between studies historical and extant examples of intermediate criminal verdicts and engages with the debates that have accompanied them, including the popular argument that intermediate criminal verdicts are incompatible with the presumption of innocence. In doing so, the book offers an original account of the meaning and of the justification of the presumption. Book excerpt: The book aims to set out in which respects concepts are properly studied in philosophy, what methodological role the study of concepts has in philosophy's study of the world, why there are several viable methods of analysis and even conceptual analysis has its place here. Many of the considerations in this book nowadays are placed under the headline 'metaphilosophy'. The book starts with some bold theses in favour of a representationalist theory of meaning and concepts which serve as the background for the discussion in the following chapters. In contrast to paradigmatic ordinary language philosophy the book endorses a representationalist theory of meaning and concepts, thus agreeing with many of its critics in philosophy and the cognitive sciences. In contrast to many of these critics and supposedly the majority of cognitive scientists it endorses the viability of conceptual analysis as one method of philosophy. The book reflects on Frege's theory of concepts, because Frege's theory of concepts was one strand that inaugurated analytic philosophy. Frege's theory of sentential unity has barely been superseded, and the problems arising from Frege's understanding of concepts are still alive. Frege's theory and the related problems in Frege's logic as in the Grundgesetze der Arithmetik (most famously the antinomy known as 'Russell's Paradox' going back to Frege's 'Basic Law V') lead over to considering the proper approach to our concept of logic and the issue of psychological and ontological realism in logic and mathematics. The central part of the book starts by reconsidering the approach and the idea of ordinary language philosophy and its understanding of conceptual analysis. Although ordinary language philosophy cannot be the whole of analytic philosophy a proper understanding of conceptual analysis turns out to be one part of analytic philosophy. This part starts with a general discussion of ordinary language philosophy, but proceeds then by a methodological overview and attempts to engage in some ordinary language philosophy concerning epistemological topics.
