The judgments these Tribunals produced have played a critical role in the development of international criminal law, particularly in terms of how courts currently understand genocide, crimes against humanity, and the crime of aggression. The trials are of tremendous historical importance, because they provide a far more comprehensive picture of Nazi atrocities than the main Nuremberg Trial (IMT). The IMT focused exclusively on the 'major war criminals'-the Goerings, the Hesses, the Speers. The NMT, by contrast, prosecuted doctors, lawyers, judges, industrialists, bankers-the private citizens and lower-level functionaries whose willingness to take part in the destruction of millions of innocents manifested what Hannah Arendt famously called 'the banality of evil'. This book starts by tracing the history of the NMT. It then discusses the law and procedure applied by the NMT, with a focus on the important differences between Control Council Law No. 10 and the Nuremberg Charter and on the protection of the defendants' right to a fair trial. The third section, the heart of the book, provides a systematic analysis of the NMT's jurisprudence. It covers Law No. 10's core crimes, crimes against peace, war crimes, and crimes against humanity, as well as the crimes of conspiracy and membership of a criminal organization. This study looks at war crimes committed during the Second World War in the USSR, Yugoslavia, Germany, and efforts to bring the perpetrators to justice. This led to successful postwar efforts to define and outlaw such crimes and, more recently, the creation of two international courts to bring war criminals to justice. This did not prevent the commitment of war crimes and acts of genocide throughout the world, particularly in Asia and Africa. The dissonance between the absolute prohibition against torture and its widespread violation raises important questions about the torture taboo in world politics. Does the torture taboo matter? Or are political realists correct in arguing that power politics rules? Barnes argues that despite the torture taboo’s violation, it still matters, and paradoxically, its strength can be seen by studying its violation. States hide, deny, re-define and outsource their torture, as well as torture without leaving marks to avoid being stigmatised as a norm violating state. Tracing a genealogy of the torture taboo from the eighteenth to the twenty-first century Barnes shows how the taboo has developed over time, and how violations have played an important role in that development. Through six historical and contemporary case studies, it is argued that the taboo’s humanitarian pressures do not cease when states violate the norm, but continue to shape actors in unexpected ways. Building upon the constructivist norm literature that has shown how norms shape state actions and interests, the book also widens our understanding of the complex role norm violations play in international society.
