Available in PDF, EPUB and Kindle. Book excerpt: While we often tend to think of the Third Reich as a zone of lawlessness, the Nazi dictatorship and its policies of persecution rested on a legal foundation set in place and maintained by judges, lawyers, and civil servants trained in the law. This volume offers a concise and compelling account of how these intelligent and welleducated legal professionals lent their skills and knowledge to a system of oppression and domination. The chapters address why German lawyers and jurists were attracted to Nazism; how their support of the regime resulted from a combination of ideological conviction, careerist opportunism, and legalistic selfdelusion; and whether they were held accountable for their Nazi-era actions after 1945. This book also examines the experiences of Jewish lawyers who fell victim to anti-Semitic measures. The volume will appeal to scholars, students, and other readers with an interest in Nazi Germany, the Holocaust, and the history of jurisprudence.

Available in PDF, EPUB and Kindle. Book excerpt: From Discrimination to Death studies the process of genocide through the human rights violations that occur during genocide. Using individual testimonies and in-depth field research from the Armenian Genocide, Holocaust and Cambodian Genocide, this book demonstrates that a pattern of specific escalating human rights abuses takes place in genocide. Offering an analysis of all these particular human rights as they are violated in genocide, the author intricately brings together genocide studies and human rights, demonstrating how the ‘crime of crimes’ and the human rights law regime correlate. The book applies the pattern of rights violations to the Rohingya Genocide, revealing that this pattern could have been used to prevent the violence against the Rohingya, before advocating for a greater role for human rights oversight bodies in genocide prevention. The pattern ascertained through the research in this book offers a resource for governments and human rights practitioners as a mid-stream indicator for genocide prevention. It can also be used by lawyers and judges in genocide trials to help determine whether genocide took place. Undergraduate and postgraduate students, particularly of genocide studies, will also greatly benefit from this book.

Book excerpt: Published in association with the United States Holocaust Memorial Museum The International Tracing Service, one of the largest Holocaust-related archival repositories in the world, holds millions of documents that enrich our understanding of the many forms of persecution during the Nazi era and its continued repercussions ever since. Drawing on a selection of recently available documents from the archive, this essential resource provides new insights into human decision-making in genocidal settings, the factors that drive it, and its far-reaching consequences. The sources that the author has collected and contextualized here reflect the full range of behaviors and roles that victims, their oppressors, beneficiaries, and postwar aid organizations played beginning in 1933, through World War II, the Holocaust, and up to the present.

Book excerpt: Kate Parlett's study of the individual in the international legal system examines the way in which individuals have come to have a certain status in international law, from the first treaties conferring rights and capacities on individuals through to the present day. The analysis cuts across fields including human rights law, international investment law, international claims processes, humanitarian law and international criminal law in order to draw conclusions about structural change in the international legal system. By engaging with much new literature on non-state actors in international law, she seeks to dispel myths about state-centrism and the direction in which the international legal system continues to evolve.

Book excerpt: This book examines the way international criminal courts and tribunals have interpreted the crimes against humanity proscription of other inhumane acts. This clause is consistently used in spite of the long list of more specific offences forbidden as crimes against humanity. The volume proposes that the current approach is based on a misunderstanding of the nature of the clause. Properly understood, the clause is an invitation to courts to create and apply retroactive criminal laws. This leads to a problem. A prohibition on the use of retroactive criminal laws, one which admits no exceptions, is deeply embedded in international law. The author argues that it is time to revisit the assumption that retroactive criminal laws can never be deployed in a fair legal system. Drawing lessons from an exploration on the way the prohibition on retroactive laws is applied in practice, she proposes a new framework for understanding the clause proscribing the commission of other inhumane acts. This book will be of relevance to anyone interested in international criminal law or criminal law theory. Gillian MacNeil is Assistant Professor at Robson Hall, the Faculty of Law of the University of Manitoba in Winnipeg, Canada.
