The Education Commission of the States (ECS) analysts reviewed laws in the 50 states in creating an online database that highlights how state charter school laws vary, particularly in how states establish standards and accountability for charter school authorizers, allow for appeals, provide assistance with start-ups and fund charter schools. Recently, attention to authorizers--the entities responsible for approving and overseeing charter schools--has increased. A growing number of states are establishing standards and reporting requirements that authorizers must adhere to. Six evolving policy areas in state charter school laws are discussed in this brief. Other rapidly evolving policy areas discussed in this brief are limits or "caps" on the number of charter schools allowed in a state, automatic performance-based closures and virtual or "cyber" charter schools.

As of October 2015, fully online charter schools operate in 26 (soon to be 27) states and enrolled approximately 200,000 students in the 2013-14 school year, comprising over 8 percent of all public charter school enrollments nationwide. Despite their growing popularity with students and families, online charter schools have received their share of bad press, thanks to reports of lackluster student outcomes and high-profile controversies over contracting for school management services with for-profit providers. This paper looks at the question of how state policy shapes the online charter school landscape. The authors reviewed the legal framework affecting online schools that operate as charter schools (as opposed to online schools operating on contract with a district or the state). The authors wanted to know: (1) In what ways do state laws vary? (2) How might that policy variation influence the ability of online charter schools to operate efficiently and effectively? and (3) What are emerging trends in state policy and how might charter online laws be improved? Overall, it was found that states' charter laws and administrative regulations create varied policy environments for online charter schools. With few exceptions, the regulatory framework targeting online charter schools is layered on to the overarching state charter law, which falls under the general education code. Moreover, the analysis shows that existing regulation arises in response to problems and concerns, not as a proactive set of policies to guide the unique opportunities and challenges of online charter schools. Book excerpt: The Civil Rights Project (CRP) is in the midst of an analysis of rapidly growing charter school enrollment, which the authors anticipate releasing next month. Similar to trends described in their 2003 report and in other research on racial isolation in charter schools, they find higher levels of segregation for black students in charter schools compared to traditional public schools. This finding is particularly striking given that the CRP has reported increasing segregation for black (and Latino) students in public schools for nearly two decades. In other words, charter school segregation levels for black students are even outpacing steadily increasing public school segregation. As new incentives for expanding charter schools continue to emerge, it is critically important for the federal government to issue and enforce new guidance on charter schools and civil rights policy. With many states pursuing the expansion of charter school programs--in the face of mounting evidence linking charters to increased levels of segregation--there should be no further delay. This paper describes the contours of state legislation relating to charter schools and racial diversity, as well as limited oversight activities to monitor compliance with these policies. The authors also highlight serious gaps in charter school enrollment data based on an on-going Civil Rights Project analysis of charter school racial, socioeconomic and linguistic segregation. They conclude with recommendations for designing charter school civil rights policy to ensure that the spread of educational choice continues to provide equal opportunities and integrated education to students from all backgrounds.
